As the search continues for #CodiBigsby, many are reminded of the death of Noah Tomlin 2 years ago. A memorial for Noah sits across from the Steam Plant where the 2-year-old was found in 2019. Tonight, police are back there looking for Codi. Eerie doesn’t begin to describe it.

Court documents uncovered by our team on Tuesday show an assault allegation made in 2018 against Cory Bigsby, Codi’s father. The assault claim was made by Codi’s mother.

She told police that during a fight, Cory Bigsby threatened to kill her. When she defended herself by grabbing a knife, Bigsby bit and choked her, according to the court documents.

The charge was nolle prossed, meaning it will not proceed in court unless further evidence comes to light. An official source tells WAVY-TV 10 that the reason for doing so is because the victim, Codi’s mom, refused to cooperate or appear in court multiple times.

Investigators were standing guard at the father’s home in the Buckroe Pointe neighborhood.

“The investigation does not indicate that he was abducted,” said Hampton Police Chief Mark Talbot. “There’s just no reason to believe it.”

Police have been knocking on doors, talking to those in the Buckroe Pointe Apartment Townhomes community, where neighbors say Codi lived with his three siblings.

Police Chief Mark Talbot said that evidence hasn’t matched stories they’ve received from Codi Bigsby’s father about when Codi was last seen. Talbot and police spokesperson Sgt. Reggie Williams could not share what that specific evidence was in a press conference Tuesday morning.

10 On Your Side is still working to learn more about the child’s mother, who police say is from Washington D.C., including when was the last time she saw her son. Talbot did not have those details when asked by WAVY’s Andy Fox, and police have not publicly shared her name.

Though Bigsby’s father and mother are both considered persons of interest, Talbot said there’s still no information that makes police believe Codi Bigsby was abducted at this time (which Talbot says would trigger an Amber Alert). Talbot added during the briefing that he did not want to comment on whether there was a history of neglect.

Police say they are expanding their search grid and searching areas that have not yet been searched. Officers will now use K9s and UAVs during the search. Emergency management and volunteer crews will continue to assist in the search.

They say their search at the NASA Steam Plant has concluded.

Sergeant R.C. Williams provided updates on the status of the investigation. He said Codi's father, 43-year-old Cory Bigsby is considered a person of interest in this case.

LE - Today our search is expanding. We're going to be checking new areas of the grid that have not yet previously searched. We're going to continue today using volunteers. We're going to be working with our partners at the Virginia Department of Emergency Management and you're going to continue to see a wide variety of resources being used out here, to include canines and UAV's. Last night we did have a team at the Hampton NASA Steam Plant. Today we are no longer there, our mission there is complete and our efforts have concluded at that location.

Moving on to the status of the investigation. I'm going to provide some clarification on the person of interest in this case. The person of interest in this case is Codi's father. His name is Cory Bigsby, he is a 43 year old Hampton man. At the conclusion of this press conference his photo is going to be available for you on our Twitter platform for your reference. Cory is still with us at Police Headquarters, he is there voluntarily and he is choosing to answer our questions.

Here's what we need from the public - We're still seeking information on Codi's last known whereabouts. We're also seeking information on his father's whereabouts. Any information that you have could potentially be of value. We're seeking information specifically regarding where he goes, where he shops, who he's with and what he does. We're also asking for residents of the Old Buck neighbourhood and surrounding areas to check their own property. Residents are much more familiar with their own property. They would be more likely to spot something that's out of place or suspicious. And in that case if you find something that you believe to be suspicious, contact police and we'll send someone out to you.

That's all the information and updates I have for you this morning. I have time for just a few questions.

Reporter - Sergeant are you ruling out the child's mother as a person of interest?

LE - We're not ruling anything out specifically at this time. Our focus is going to be towards the father for the current investigation.

Reporter - Are you going to be looking at the landfill any time soon?

LE - I don't anticipate that, but if that changes I will certainly update you.

Reporter - Has the father or the mother, anyone, been charged with anything at this time?

LE - No formal charges have been issued at the current time.

Reporter - How long has he been at the Police Headquarters?

LE - He has been at Police Headquarters since the day he reported Codi missing.

Reporter - Has this become a recovery effort at any point or still search and rescue......?

LE - There's been no shift in the ? of the investigation.

Reporter - Does the Police Sergeant have any record of calls to that address?

LE - I don't have that information with me right now.

Reporter - You mention other children were in the house, where are those children at this point?

LE - I can tell you that the children are safe.

(Reporter asks if the kids have any information to share.)

LE - I'm not able to discuss the specifics of that element of the investigation.

Reporter - Are you able to discuss at all the conditions of that home when you guys were there?

LE - I wouldn't be able to discuss that either.

Reporter - The dogs you're using - Are they search and rescue dogs, cadaver dogs?

LE - A combination of both.

Reporter - Are you still searching water..?

LE - Any waterways that fall within the grid are certainly being considered in the search.

Reporter - Sergeant can you talk again about the amount of co-operation you're getting from Cory Bigsby and types of questions you're asking?

LE - I would not be able to go into that element.

LE - He is choosing to be there voluntarily and is answering the questions we are asking.

Reporter - How wide is the grid expanding to?

LE - It's about a mile radius at the current time.

Reporter - A mile radius from the house?

LE - From the apartment complex.

Reporter - Like a circular mile out?

LE - Approximately a mile radius.

Reporter - And how is that different from where it was yesterday?

LE - The grid itself hasn't changed we're just expanding the areas within the grid that we're searching. We're searching new elements that were not previously searched.

Reporter - Have you received any leads in the last 24 hours that you consider promising?

LE - That's not something I would be able to discuss.

At the end when the Sergeant went off camera a reporter can be heard asking if the father had been sleeping there and the Sergeant replied that he's been there since Codi was reported missing.

"The first place you will search is at the child's house," said James.

Then, James says, investigators work to talk to friends and family. The investigation is 24 hours a day, and all resources are utilized.

"Officers on the street are doing their searches at the exact same time investigators are doing their tactics and techniques, like talking to family, friends, local hospitals, police agencies, social services, " said James. "Family history and background checks are made; risk factors or any illnesses the child may have."

Family - like Cory Bigsby, Codi's father, as well as Codi's mother - is also questioned immediately.

"Any questioning that is going on is all voluntary, and parents, anyone, can leave anytime they want. Police cannot hold them against their will unless they believe they have evidence that crime occurred," said James. "Parents are always the number one suspect until they are deleted - that is natural," said James.

Search warrants for the home and for cellphones are executed if there is probable cause. A grid search starting from the home is also vital.

10 On Your Side confirmed on Thursday afternoon that an attorney, Jeffrey Ambrose, had been retained for Cory Bigsby, although Bigsby had not yet told police he requested an attorney. The attorney said they were directed to the Hampton Commonwealth’s Attorney’s Office and had not yet spoken with Bigsby.

Hampton police have not said when Codi was last seen by anyone outside of his family, with the FBI post raising speculation that he has been missing since Christmas.

I just spoke with Ambrose. He tells me he went to the Hampton Police Division earlier today to speak with Cory Bigsby, but was not allowed to see him. He says officers told him that because he is there voluntarily and had not asked for an attorney, they couldn't talk to him...

Ambrose said he and co-counsel went to the police headquarters earlier Thursday afternoon but was told he wasn't allowed to enter, because Cory didn't request an attorney and was present voluntarily.

According to Ambrose, he requested that detectives inform Cory that legal counsel hired by his family was present. He said he was told that they wouldn't do so, and wouldn't answer further questions on the matter.
