Judge ruled mom may have provisional contact with the daughter: Only if dependency court allows and can't talk about the case. Daughter is a minor -- I think she's still at detention center.

I'm on it Niner thank you! I will be on-site to witness the judge's decision for this one, as it will be the most important decision for the case so far. Now that our County is starting to open back up it will be interesting to see what kind of publicity the case gets, if any. . .

Motion to dismiss is fairly routine and IMO rarely granted - perhaps overwhelming proof by the defense ? I highly doubt it - our courts are using Zoom and Office meeting even on MTD’s (just had one in a civil case)

ORDER DENYING MOTION

Don't know "which" motion this is denying as you have to pay to see it.... Thinking this is probably for the motion for dismissal since they have a trial date set.

I believe you are correct.
I'll have to pay for it to find out

Niner: Motion denied to strike last minute declaration from Brian Carpon, it had NO bearing on the case.
2nd - Judge said it was a "close call" on the Assault 2 (by poisening) " In a Knapstad motion the court has to establish a prima facie case of guilt In the light most favorable to the state" . . . He determined that there was evidence to proceed despite the fact that ALL test came back negative.

I am leaning towards lack of evidence on the state's behalf.

re my bold & red - does that mean the victim's tests came back negative for "poison" ?? TIA! I think that is what it says, but wanted to make sure. Didn't she have a cupcake left over though?

YES all TOX tests that were run on ALLEGED victim and all items used to make the cupcakes that were siezed in search warrant came back NEGATIVE.
(Including 1 left over @ ALLEGED suspects home) NO GHB or ANY other substance to be considered "poison". =)
The ONLY evidence that has been submitted otherwise is hearsay and vague text messages from a bitter ex-boyfriend. . . I don't think that will survive a jury trial in this case
