I assume the little guy's hanging on, because an early article linked on the thread says they were going to upgrade the charges if he died, and they haven't.

Given the severity of the injuries, I'm assuming they are life changing, however long he holds on. And depending on the laws of the area, sometimes charges for murder can still be laid if the death can be directly linked to the injuries sustained in the assault.
