I don't understand why this judge is letting Brophy get away with this nonsense. He has had PLENTY of time for any discovery needed. Good God, it's been a YEAR since they were in court. He's just dragging things out so his clients can stay free for as long as possible.
 
You know, on thinking about it, I'm wondering if the state is trying to split the two cases so one can be offered incentive
to accept a deal to testify against the other? That would cause Brophy to want to motion against it, and to demand more discovery as to what has been said and offered etc.
 
Considering this is telephone conference hearing and still on the court site on 3/20 - I shall post this until I hear anything different...

Barry (27/now 28) charged (6/24/19) & arraigned (10/16/19) with 1st degree reckless homicide (as a party to crime-Felony B). Both plead not guilty. $250K Signature bond.
Death was due to homicidal smothering/suffocation & blunt force patterned beating. The nature & pattern of injuries described on her body further demonstrated an utter disregard for human life. The charge is a Class B Felony & carries a penalty of up to 60 years in prison.
The victim was a child adopted (5/17/06) from China by a North Carolina couple David & Lisa Kaden. She was staying with the Barry family in Mineral Point (starting 4/24/18) because of a medical problem involving one of the family's other children. The arrangement wasn't approved by social workers or any government entity.

This causes me to ponder the adoptive parents, and wonder if there could be a group working to ensure the rights of adopted children.

No one seems to be bringing attention to Ms. Kaden's plight.

We were not experiencing a global pandemic when this child was murdered by her substitute caregivers.

The Kadens attended Black Hawk church when they were in Wisconsin. The adopted mom for years volunteered for Love Without Boundaries Foundation and had been an advocate for adopting older children from China.

They also had another two adopted daughters that no longer live with them. Anaia and Nina. Nina is on facebook livid that her parents knew the abusive behavior of the Barrys. It appears that Nina no longer connects with her parents. They are not facebook friends and there's zero facebook interaction between Nina and her parents. Anaia - she seems to just disappear from the Kadens' facebook.

One of Kadens' biological daughters Lexi also seemed to break tie with her family and she's standing by Nina. None of the Kadens were at Lexi's wedding. Lexi is the only one still seeing Nina and being there for Nina and Nina's daughter. The adopted mom and dad are absent being the grandparents for Nina's daughter. Something is very fishy there.

Selah was the 2nd out of the total of 6 adopted. She had a rare blood disorder.

Mother, daughter ordered to find separate attorneys in reckless homicide case

June 5, 2020

DODGEVILLE (WKOW) -- A mother and daughter charged in connection to the death of a girl in their care will each need to get their own lawyer.

An Iowa County judge ruled at a hearing Friday afternoon the two must find separate counsel because conflicts of interest could arise. The judge cited plea bargaining as a particular area of concern.

A forensic pathologist found evidence in an autopsy of blunt force trauma. However, other signs indicated Kaden suffocated to death. The complaints also said Kaden had "possible restraint marks about both wrists."

The two women are charged with first-degree reckless homicide and will next appear for a status conference on July 10 at 2 p.m.

Hopefully the state is setting up now to be certain of some justice for this murdered child.

Looks like the AG is definitely going to pit one against the other with plea deal offers. Of course Brophy doesn't like that idea. Tough. I'm thinking that one was the main culprit, and the other was the one holding the kid down. I'd be willing to bet that it was the mother who was the main abuser and the daughter was going along out of fear of the mother as well as a twisted upbringing which led her to go along with whatever the mother said.
