Bert Nieslanik, an attorney representing Mallory and Macy Morphew, asked a judge to weigh in on the matter last week, calling the fact that Morphew’s remains were removed from Swan-Law Funeral Directors before the daughters could hold a memorial service “outrageous, cruel and shocking to the conscience.”

But Kelly, in her opposition Wednesday, said that it was Barry Morphew who had signed for the remains to be released to the Colorado Springs funeral home in January, and authorized them on Feb. 11 and Feb. 13 for their intended cremation a week later.

Prosecutors collected the remains on Feb. 19, the day before they were set for cremation.

Under the revised statutes added in 2024 to the act, Morphew should not have had the right make decisions about his wife’s remains. Under that statute, the definition of a victim is “any natural person against whom any crime has been perpetrated or attempted unless the person is accountable for the crime.”

Since Morphew was charged with the murder last summer, as a defendant, he is not considered a victim with the same rights as his daughters, Mallory and Macy. Suzanne Morphew’s brothers and sister are also considered victims.

ALAMOSA, Colo. (KKTV) - A judge decided Monday that she will give the daughters of Barry and Suzanne Morphew an opportunity to speak in court.

The latest timeline, according to court papers:

• Jan. 29, 2026: Barry Morphew signs off on moving Suzanne’s remains from the El Paso County Coroner’s Office to Swan-Law Funeral Home in Colorado Springs.
• Feb. 17, 2026: Law enforcement was notified by the coroner that Suzanne’s remains had been released to a funeral home.
• Feb. 18, 2026: The court issued a search warrant for Suzanne’s remains.
• Feb. 19, 2026: Suzanne’s remains are transferred back to authorities by Chaffe County Undersheriff Alex Walker. Her remains were set to be cremated the next day.
• Feb. 20, 2026: Attorney for Macy and Mallory Morphew, the couple’s daughters, filed a motion asking for the release of Suzanne’s remains.

A trusted legal expert familiar with the case tells 11 News the timing of the latest developments are strange because the Morphew family has had since April 2024 to claim Suzanne’s remains and did not try to until recently.

A brief eight-minute status conference was held March 30 for Barry Morphew with 12th Judicial District Court Chief Judge Amanda Hopkins. There was not a hearing held regarding the release of the late Suzanne Morphew’s remains to her children, Macy and Mallory Morphew, as requested during the March 9 status conference.

During the March 30 conference, Hopkins heard from David Beller, representing Morphew, and Anne Kelly, 12th Judicial District Attorney.

Beller said he anticipates being able to file motions in advance of April 13.

Beller said he anticipates being able to file motions in advance of April 13. He advised the court that the defense is anticipating filing Shreck motions relating to experts. In other states, Shreck motions are called Daubert motions. According to Thomson Reuters practical law, Daubert motions are “a type of motion which seeks to exclude the presentation of an expert’s testimony to a jury.”


Kelly said there was nothing additional from the People that the court should be aware of, and said that communication with Morphew’s defense has been “very strong.”

Daughters of Suzanne Morphew no longer asking the state to release remains

The daughters of Suzanne Morphew are no longer asking the state to release her remains. Her husband, Barry Morphew, is facing a first degree murder charge in connection to her death.

The couple's two daughters filed a motion last month to get their mother's remains back. The Alamosa County District Attorney fought that request.

Prosecutors argued the body is material evidence.

A hearing was scheduled for Monday, but the daughters withdrew their request before the judge could decide. They did not give a reason as to why they withdrew the request.

Barry Morphew chose not to take a side in the dispute. The remains will stay with the state as evidence. It is unclear who will get them after the trial.
