Regarding the penalty phase, in the Verdict video I heard the judge mention Dr Lazarou. . . sounds like for the prosecution. This will be interesting. She is a forensic psychiatrist and testified for the prosecution earlier this year in the Jonchuck trial and Nachtman trial.o_O

Back in court this morning for the start of the penalty phase of the Granville Ritchie trial. The same jury that yesterday found Ritchie guilty of the murder of Felecia Williams will be asked to sentence him to death. @TB_Times

Prosecutors have cited two aggravating factors that they say qualify the death penalty. 1. That the victim was less than 12 years old. 2. That the murder was committed during the commission of sexual battery and aggravated child abuse. @TB_Times

Ritchie's defense has said they will argue 12 mitigating factors, which might make life in prison more appropriate. The factors they've cited include a lack of prior criminal history, childhood mental and physical abuse, a childhood head injury ... @TB_Times

... exposure to poverty and violence during his upbringing in his native Jamaica, and kindness and generosity to others. @TB_Times

If the jury finds that at least one aggravating factor outweighs the mitigating factors, they can impose a death sentence. Their final decision must be unanimous. If they are not unanimous, the sentence will be life in prison. @TB_Times

Correction: As openings begin, ASA Jennifer Johnson says there is a third aggravating factor they intend to prove: that the murder was especially heinous, atrocious and cruel. @TB_Times

A female juror started crying during Felecia Demerson's impact statement about her daughter Felecia Williams. The judge took a short break and spoke to juror. The juror said she was sad about someone close to her who died and it brought back those feelings. @BN9 #bn9hillsborough

  1. Dan Sullivan‏Verified account @TimesDan 2h2 hours ago
Before court resumes, the juror is brought in and questioned. She says she recently suffered a loss and the victim impact testimony brought back the feelings of grief. But she says she thinks she can continue on and put that aside. @TB_Times
  2. Dan Sullivan‏Verified account @TimesDan 2h2 hours ago
ASA Scott Harmon responds that, from what he saw, the juror handled the situation responsibly, shieding her face from the other jurors, and notifying the judge she needed a break. The judge agrees. @TB_Times

With the jury out of the courtroom, attorney Daniel Henrnandez asks Judge Sisco to strike the entire panel because of the juror's display of emotion. @TB_Times
