There is no good explanation other than media. So much media on Idaho that no cost is being spared, jail accommodations are as good as it gets (even a private t.v. yo watch the coverage), and 3 attorneys. Even suit and tie for hearings as opposed to yellow jump suits.

The motion makes clear that Kohberger’s attorneys plan to put forth a motion to dismiss, and referenced their client’s decision to stand silent at his arraignment, saying he did so “to preserve his right to contest the indictment.”

Court TV will be at the motions hearing on June 27, and will have full coverage on Court TV both on-air and online.

A request by lawyers for Bryan Kohberger, the suspect in the University of Idaho murders, to pause legal proceedings to evaluate whether the grand jury that indicted the 28-year-old was biased is laying the groundwork for his lawyer to file a motion to dismiss the case, a legal expert said.

Kohberger, a Ph.D. student at Washington State University's Department of Criminal Justice and Criminology, is accused of breaking in to an off-campus home in Moscow, Idaho, in the early morning hours of November 13, 2022 and stabbing to death four University of Idaho students: Ethan Chapin, 20, Madison Mogen, 21, Xana Kernodle, 20, and Kaylee Goncalves, 21.

Kohberger was indicted by a secret grand jury enrolled by the state of Idaho on May 16 on four counts of first-degree murder and a single count of burglary.

Bryan Kohberger's legal team may have found a new way to attempt to have his murder charges thrown out following a court document filed this week.

On Tuesday, Kohberger's lawyer, Anne Taylor, who serves as the Kootenai County chief public defender, called on the state to provide the full record of the grand jury proceedings following his indictment on four counts of first-degree murder and one count of felony burglary.

"Release of the grand jury proceedings, governed by Rule and Statute, are materials necessary to Mr. Kohberger's defense," the court document said. "A grand jury was empaneled at a time when the small community of Moscow, Idaho had been exposed to 6 months of intense local, national and international media coverage.

"Because the state has provided extensive discovery, Mr. Kohberger knows that exculpatory evidence exists. Whether a fair and impartial panel of grand jurors was assembled amid intense media coverage is a significant question the Defense must evaluate."

I dunno- just a guess - their ploy won't work!!!

#BryanKohberger's defense team has filed another Motion to Compel. This is all in advance of the evidentiary hearing to be held on June 27. They have 51 Terabytes to go through. Maybe they are through it already and just missing these items... In any event, this is routine. More importantly, the clock ticking re: the death penalty decision. 60 days from May 22 is around the corner.

"Mr. Kohberger knows that exculpatory evidence exists. " I find this statement interesting. How does he Know? #BryanKohberger will be his defense team's best asset because if he did these murders, he was there, and he knows everything that happened. He knows if any LEO has misinterpreted any information. What exculpatory evidence is BK talking about?....Only BK knows (and now his defense team)

I love the prosecution's answer to the defense's motion to stay. In a nutshell, the defense is saying, stay the proceedings and then we (the defense) will give you a reason to stay the proceedings. Only the defense must provide the court a reason to stay the proceedings, First.

Quick recap on Brady and Giglio issues, which the Defense will continue to try and raise as they put the #idaho4 investigation under a microscope. Easy to understand definitions of both attached.

The Latent shoe print found at 1122 King Road. Good explanation of the process used to obtain the shoe print referred to in the affidavit. Was there only 1 print? Certainly only 1 print was mentioned in the Probable Cause Affidavit, but that doesn't mean there weren't more found. Recall #BryanKohberger wore a size 13 shoe. Also, I often refer to Locard's Exchange Principle. Now more than ever, forensics makes it nearly impossible to hide leaving something behind or taking something with you if you go somewhere...especially if you go to 1122 King Road and murder 4 people.

MOSCOW, Idaho (Scripps News Boise) — Prosecutors for the case against Bryan Kohberger, charged with the murders of four University of Idaho students, have asked for an increase in funds.

Latah County Prosecutor, Bill Thompson, submitted a request for a $135,000 budget, a significant increase from the standard $15,000 that the office has as a typical baseline.

[...]

This comes on the heels of the Lori Vallow Daybell trial, said to have already cost Idaho taxpayers over $3.6 million as reported by East Idaho News.

Newly released court documents say DNA collected from Bryan Kohberger is a statistical match to DNA found on the knife sheath found at the crime scene. We knew genealogical DNA connected back to Kohberger's dad -- but this direct connection to Bryan Kohberger is new to me.

Prosecutors: Kohberger’s DNA matches knife sheath

  • DNA collected from Bryan Kohberger is a statistical match to knife sheath
  • Genealogical DNA previously connected back to Kohberger's father
  • Last month, Kohberger didn't verbalize a plea to murder charges

Updated: JUN 20, 2023 / 11:09 PM CDT

(NewsNation) — Prosecutors are publicly linking University of Idaho murder suspect Bryan Kohberger’s DNA to a knife sheath found at the crime scene, according to new court filings.

It was previously known that genealogical DNA connected back to Kohberger’s father.

“A traditional STR DNA comparison was done between the STR profile found on the Ka-Bar knife sheath and Defendant’s DNA. The comparison showed statistical match,” according to the court filing.

MOSCOW, Idaho — Prosecutors in Idaho say DNA found at the scene of the University of Idaho murders belongs to Bryan Kohberger.

Updated: 6:38 PM EDT June 21, 2023

They wrote in new court documents that it's a one in 5.37 octillion chance it could be anyone else.

An octillion has 27 zeros after it.

Dr. David Rusak, the head of the forensic chemistry program at the University of Scranton, says that is strong evidence against the native of Monroe County.

"The chances that this DNA came from someone other than the suspect are just astronomically slim."

DNA on the scene was "5.37 octillion times more likely" to be from Kohberger's genetic profile than an unrelated, random person.

MOSCOW, Idaho — A new filing has been released in the case of the University of Idaho Murders which expands on an affidavit released in January.

These documents brought details of the case into the public eye for the first time, including the methods police and the FBI used to hone in on their suspect. At the time, the affidavit confirmed that DNA on the knife sheath recovered from the crime scene was linked to Kohberger.

[...] The FBI created a DNA profile using the knife sheath with the hopes of testing it against a sample from Kohberger.

[...] According to recently released documents, a short tandem repeat (STR) profile was developed using the evidence on the knife sheath. This process identifies protein sequences in a sample that can be compared to someone's DNA profile. Because these sequences are unique, a statistical match can be made based on these STR profiles.

[...] The STR profile was compared against Kohberger's own DNA sample from a cheek swab, and profile scientists concluded that "the STR profile is at least 5.37 octillion times more likely to be seen if Defendant is the source than if an unrelated individual randomly selected from the population is the source."

The beauty of the DNA sample collected from #BryanKohberger was that law enforcement got a Search Warrant to collect it. Why? If they conducted the search incident to arrest or administratively pursuant to processing, the defense would have had more avenues to contest it. A Judge said they had PC to collect BK's DNA sample. Great job by LE closing the loop on loop holes especially considering the Sheath is the Dagger the prosecution needs to win this case and ensure justice is served for the victims. We talked about it last night on @ChrisCuomo

Many are asking about where the sheath was found. Specifically it states below in the new documents. This is just more specific than what we already knew. It was a murderous assault, a rage, and the person who did this did not have the sheath secured properly. Without the sheath, it would seem the case would not have broken as quickly.
