*Scheduling Conference Hearing (@ 11am ET) – WI – Ethan J. Hauschultz (7) (April 20, 2018, Manitowoc; burned & buried in “coffin of snow”) – *Timothy Scott Hauschultz (48/now 55) (great uncle) arrested (2/1/19), charged (2/4/19) & arraigned (3/20/19) with first-degree reckless homicide, 3 counts of substantial battery & 3 counts of physical abuse of child — intentionally cause bodily harm, intentionally contributing to the delinquency of a child-death as a party to a crime, 2 counts of physical abuse of child — intentionally cause bodily harm, intentionally contributing to the delinquency of a child-felony & a misdemeanor battery. Plead not guilty. $100K cash bond. Reduction in bond denied (12/6/21). Bond reduced (3/16/22) to $75K cash. Posted $75K cash bond (6/15/22) with conditions. Manitowoc County
Trial was set to begin on 2/23/26 was postponed on 1/21/26. There will be 5 alternate jurors.

1/21/26 Update: Motions hearing held with Judge Carey J. Reed presiding. Appearances: Attorneys Jacalyn Labre & Jill Vendetti appear via ZOOM for the State; Attorney Donna Kuchler appears via ZOOM for Defendant Hauschultz; Defendant Hauschulz appears via ZOOM from a separate location. Interpreter Tarra Gammernos is sworn in to interpret ASL for proposed juror. It was determined that juror can participate without an in person interpreter as long as a microphone is used by the parties. Court excuses the juror at 1:07pm. State's motion to adjourn. Pursuant to Defense's previous understanding of adjourning the trial, it objects to an adjournment. Defense renews its request to reconsider the plea agreement previously presented to the Court. The parties have further discussion on how to proceed given the current circumstances. The Court determines that, given the new facts presented prior to the hearing today, the February trial dates will be adjourned. Court will scheduled a status conference to determine what needs to be scheduled next after the scheduling conference is held in Damien's case at 3pm this afternoon. Status/review hearing set, via ZOOM, with the parties 1/28/26 @ 9:30am. 1/22/26 Docket update: Bond Motion filed.
1/28/26 Update: Status conference hearing held with Judge Carey J. Reed presiding. Video conferencing. Defendant Hauschultz appeared by video. Attorney Donna Jean Kuchler appeared by video for Hauschultz. Attorney Jacalyn Christie Labre & prosecuting attorney Jill L. Vendetti appeared by video for the State of Wisconsin. Matter was previously adjourned pending the status of the Damian Hauschultz case which is now scheduled for a status conference on 3/3/26. Defense brief has been filed, States response to be filed prior to the status conference. State requests a scheduling conference in this file after 3/3/26. Defense has no comment at this time. Motion for modify Bond. Court addresses the motion filed by defense on 1/22/26. Defense is requesting a modification to the defendants bond to permit the removal of the GPS monitoring due to the continuing delay of the trial. Defense argues the defendant has been in complete compliance of bond. The State argues that their position has not changed. The GPS monitoring was a contributing factor behind the reduction of the cash bond & is still appropriate at this time. Defense replies. The Court denies the motion finding that the condition of the GPS monitor is warranted as a reasonable condition of bond. Next scheduling conference on 3/18/26 @ 11am.

Hauschultzes were court appointed guardians for Ethan & his 2 siblings in 2016.
*Damian L. Hauschultz (14/now 22) – Plea hearing on 6/25/21 & plead guilty to 1st degree reckless homicide & was sentenced on 9/2/21 to 20 years in prison & 10 years probation. Filed official appeal on 12/9/22. Court of Appeals acknowledged on 4/11/23. Appeals denied (3/13/24). His 2nd appeal was denied to be heard in the Appeals Court (9/12/24). Won appeal for resentencing (3/3/26). #2022AP000161 Will be re-sentenced on 4/24/26..
*Tina McKeever-Hauschultz (35/now 43) (great aunt) – 3/12/21: Plead no contest to 2 counts of child abuse-failing to prevent bodily harm & the 2 counts intentionally contributing to the delinquency of a child were dismissed. Sentenced to 5 years in prison & 5 years extended supervision. Was released in January, 2025 &
now serving 5 year extended supervision.

MANITOWOC (WLUK) – When Damian Hauschultz is resentenced for the 2018 death of his step-brother, Ethan, 7, he wants the judge to have an updated pre-sentence report – so the defense has asked for the April 24 hearing to be postponed.

Hauschultz is now 22 years old but was 14 at the time of Ethan Hauschultz’s death. Damian pleaded guilty to reckless homicide and was sentenced to 20 years in prison. His case was presided over by Judge Jerilyn Dietz.

MANITOWOC (WLUK) -- Damian Hauschultz’s resentencing for the 2018 death of his seven-year-old stepbrother, Ethan, was postponed for two months to allow a new presentence report to be prepared.

Prosecutors agreed to the resentencing and it was set for April 24. However, Damian’s attorney wanted a new presentence report prepared for the judge to use. This report is a prepared by the state Department of Corrections, which reviews the facts of the case and offers a sentencing recommendation.

On Monday, Judge Samantha Bastil agreed to the request and Damian's resentencing hearing was rescheduled for June 19, court records show.
