fall, 2010: L was the murderer's atty for over year- had good idea of "what I had on my hands"

L claims- had a woman -who "brutally" killed boyfriend, who wanted to claim he was "an abusive pedophile"- who tried to attack her on the day she killed him, forced her to defend herself- she wanted to "make these assertions on a high profile setting....attack Mr. Alexander's reputation on a worldwide stage"- wanted L to help her- L claims the attacks "were more important than the outcome of her case"

L didn't believe her claims- couldn't un-prove them and couldn't stop her from telling them on the stand

L states he was "ethically bound to help" the murderer tell story

L forced to "build a trial strategy around those claims"- would have liked to her to say nothing- argue for manslaughter because of "chaotic nature of her relationship" with TA- lost control after she realized that TA only used her for sex

L "had to run with her story..was entitled to the defense she wanted...what I thought did not matter in terms of strategy...wanted no part" of the murderer's "plan of attack of" TA

only way to get off, was to leave Office of the Public Defender- couldn't just give case to another atty- couldn't find ethical issue

L said he liked working as Public Defender, although he was tired of doing capital cases- did 2 capital trials in 2 years- high toll on his life- leaving the murderer behind "was a big motivating factor" - did not want to give up job because of a client- didn't like the murderer "at all"

Fall, 2010- decided, after the holidays, to leave to go into private practice to defend DUI , sex cases, "whatever came through the door"

Jan., 2011- told Office of Public Defender's he was leaving- his former Co-counsel would take lead and new co-counsel would be named

L told the murderer he was leaving - she was very unhappy- wanted him to stay 'til end of case because "she wanted me to, merely because it suited her interests"- she cried and "assumed the role of victim"- she called him every day- became frustrated that "she couldn't manipulate me into staying"

L "sensed that" the murderer "felt as if I should have seen being her lawyer as a privilege"- as time went on, she resented him- she felt that a friend had "betrayed her"

Judge Duncan asked if L had filed a Motion to Withdraw- not typically done when leaving the Office of PD so, he said No; she also asked if he had a "contract" (had he agreed to defend indigent criminals for county in exchange for specific hourly rate of pay)- L did not have contract

Judge Duncan said she didn't care what "typically occurred in these situations"- if L didn't want to accept case, file Motion to Withdraw

Office of PD had already assigned someone to the case, it would not delay trial, was commonplace for atty to leave and cases reassigned

Chapter 30

Spoiler Alert I Did Not Get Out


Feb., 2011- L wrote Motion and assumed he could leave

Judge Duncan wanted to hear oral arguments over motion

L wanted to get rid of the murderer ASAP so he can start new business

L didn't want to talk to the murderer anymore- thought new attys should, but he had to- still his client

"She didn't want to talk to me about her case. Instead her real desire was to convince me that I should keep her case" she used "every word Judge Duncan said to me at previous hearings to her own advantage..should take the contract rate for her case and move forward as Judge Duncan had offered" (pg. 175)

L states that the murderer felt that she had a right to ask him to put his "ambitions on hold to serve her ends"- the murderer was frustrated, shocked, angered that he didn't want to be her atty anymore, wanted nothing to do with her- "rejecting her case and her personally"- made her more determined to keep him

the murderer wrote letter to Judge Duncan- her mother wrote 1 too

-murderer explain to judge- unethical for L to leave; mother wrote that L should be forced to stay until case is done

day of hearing- attending- JM, members of PD Office, man who ran contract office for Maricopa

nothing resolved at hearing- L had to remain on case- 2 lawyers were appointed to represent the murderer because the murderer and L "had adverse interests ...related to my Motion to Withdraw"

L could make more money in DUI/ other cases- said that at hearing- if he was not allowed to withdraw, he had to submit affidavit about hourly rate he wanted

week later- murderer stood her ground with 2 new lawyers and opposed Motion

April 4, 2011- Motion denied because trial was scheduled to go to trial in Aug 2011

L was now "Trapped with Ms. Arias"- hoped the trial ended by early 2012- "the longer this case went on the more damage this case would cause my career"

the murderer was much more difficult after the ruling- "she was super pissed that I had wanted to leave her to begin with...not something she takes lightly...expressed her anger in both passive aggressive ways and ways that were all out aggression" (pg. 178)

the murderer told L that she was going to speak about him "in very unfavorable terms at the jail so that none of her fellow inmates would want to hire me"- L was to be the murderer's "personal lawyer" and wouldn't share him- she would also bad mouth him after the trial

"I needed to do as she desired, period...the golden handcuffs were firmly around my wrists"

I am finding Mr. Nurmi's book really interesting - and obviously amazingly cathartic for him :). He brings up some very good points about "how we got there". Really sad for both families, and of course all those affected, including the lawyers.

I'm sure you're very busy right now working on volumes two and three of your grievance letter. Any thoughts about what you'll self-publish next? Just because there are already two books entitled "How to Lose Friends and Alienate People," that doesn't mean you can't use this title as well. Just sayin'. And maybe if you stop all the blatant, ham-fisted attempts at self-edification (wink), you just might be able to de-alienate (wink wink) people, at least a tiny bit. It's not likely, but you just never know.

For now, though, and for the foreseeable future: no soup for you.

You know what bugs me about all the self-edification (great word)? He says he had to go with Jodi's allegations that Travis was an abuser and a pedophile because he has to follow his client's wishes. But he didn't use the pedophile letters, although she wanted him to. And he didn't use the ninja story. He didn't call the witnesses she wanted. He's made it very clear that if he thinks something is a bad idea, he won't do it. I can only assume he went with the abuse BS because he was just fine with it.

My Initial review of the Evidence as it Related to the Relationship


L talks about relationships between killer and victims- the murderer's and TA's - "atypical" and often considered second degree murder or manslaughter..rare for these crimes between romantic partners/lovers to be charges as capital offense.

Nurmi: don't forget to put verifiable stats and citations in the notes section you're no doubt including. It's not that we won't believe you otherwise, it's just that, well, yes actually, we absolutely won't believe you otherwise.

the murderer described relationship (in 48 Hrs program) that it was sexual- boyfriend/girlfriend, but labeled it as a "friendship"

What possible difference does it make what Jodi chooses to label anything on any given occasion? News flash: SHE LIES.

Nurmi, are you just deliberately trying to piss people off, or are you actually claiming that there's some sort of relationship rule book out there that everyone except Travis is guided by? And you seem to have been absent the days we went over fallibility, manipulation, duress, and Jodi being sick, twisted, and relentless, as well as armed and dangerous. Maybe, just maybe, that had just a teensy bit to do with Travis' behavior on the day he was murdered.

L had suspicion viewing photos taken on TA's camera that day ("very graphic")- that their relationship "was longstanding, intense and unrestrained"

L heard from former colleague ("who was Jewish") referred to JM as "Hitler"

So, Nurmi, you heard this, did you? Fine. I heard that you sleep in bright pink footie-pajamas with tell-tale stains on the flap, and a former colleague of mine referred to you as "that weird pervert."

goes on to talk about things/stories that JM said/did- "but suffice it to say he was not well thought of within the defense community, not because of the convictions he obtained but because of the way he operated." (pg.89)

Suffice it to say that this isn't a popularity contest. And when did you become the voice of "the defense community?" Are you representing the entire "defense community" or just the Jodi Arias "defense community?" I'm guessing it's the latter. In either case -- it's irrelevant.

Look, Nurmi, here's the deal. I know writing isn't really your thing, but here's a little tip. Zero corroboration = zero credibility. Thought you would have learned that by now.

This is just me, but I take particular exception to the Nazi reference from a "supposedly" Jewish counterpart. No one should ever go there unless they are speaking of their own experience (regarding Nazi Germany). That kind of inflammatory language is tremendously insensitive and has no place in a case like this. Especially with tensions regarding religion being what they are, shame on you, Nurmi.
 
If he had gone with just BPD and tried to prove diminished responsibility, he would have achieved the same result most likely without boring the world to tears for months and making himself a laughingstock. I guess if your client insists it was self defense and is so deluded as to think someone might buy it you would have to go with it, but for heavens' sake.

Jodi really is just a turd in life's punch bowl. Pardon me for just a sec while I lump Nurmi and Travis together. Both far from perfect, but both living fairly normal lives, all things considered. Enter Jodi. She's like an evil tornado hopping around causing low-level damage here and there... till she catches a glimpse of a target and just parks herself there until she's torn it to shreds. It must have been infinitely worse for Travis, of course, but it looks like she left Nurmi pretty well shredded. I believe Jodi brought out the very worst in him (and the worst of Nurmi is pretty awful), and she made sure she did it in the most public, reputation-destroying way possible. And this was in the context of a professional relationship. I can't even imagine what it would be like to have to deal with her on a personal level.

I'm suddenly reminded of a scene from the beginning of "Silence of the Lambs," when Clarice first gets the assignment to talk to Lecter:

"Be very careful with Hannibal Lecter. Dr. Chilton at the asylum will go over all the physical procedures used with him. Do not deviate from them for any reason whatsoever. And you're to tell him nothing personal, Starling. Believe me, you don't want Hannibal Lecter inside your head. Just do your job and never forget what he is."

I completely agree about the Hitler comment, especially with the backdoor way Nurmi slips it in. He's not comparing anyone to Hitler, his "former colleague" is. Even if he does have a former colleague who said this about JM (not that I believe him in the slightest), it was Nurmi's decision to include that particular reference in his book. If JM really is held in as much disdain as Nurmi says he is, he (Nurmi) ought to have a generous supply of other insults he could have used.

As usual, his attempts to "de-edify" JM backfired completely.

only had a part-time secretary, who didn't know capital cases now- who was now being paid by L

since he was not the murderer's "contract attorney", he now had to pay for her phone calls to him- if L was not available to accept calls, secretary would not answer

"...not accepting Ms. Arias' calls meant hanging up on her so that I wouldn't be charged for them. Even though I explained this to Ms. Arias, she did not like how I was running my business. She did not like being hung up on" (pg. 182)

she could still call other members of her team tho'- most calls from her had nothing to do with her case

the murderer would call and comment on what time L arrived/left work, she commented on how long vacations

"..she understood the need for vacations but that time I was away was too long"

Jail Visits With Ms. Arias


L told Wilmott/MDLR that murderer's visits would usually last 2 hours long - (they didn't believe him)- the murderer craved and demanded attention

visits were at county jail- Estrella- Maricopa's only jail for women- not in a good part of town- old, musty, drab, lifeless building

- must remove everything from pockets to enter visiting rm- other inmates and their visitors there also

- L talks about heartbreaking scenes in room- women, children sometimes crying

the murderer 's "classification...we had to visit in a special room reserved for 'high security inmates'.." she had to be escorted by 1, 2,or 3 guards

L describes the visitation room

L heard the murderer's chains shackled to her ankles before he saw her- with her hands chained to a belt- one hand would be un-cuffed when she entered rm

the murderer would 1st complain about the guards that accompanied her to visits

visited her at least once week, but L was on on another case during this time and visited once/twice month- she wasn't happy about that- she would call to complain- constant phone calls- almost daily

visits lasted about 2 hours because the murderer trying to convince L to file/not file a certain motion; and/or talks about "her cat, what was happening in her pod, whatever the latest drama with her Mom happened to be, how she did not have enough money to order what she wanted on commissary..." (pg. 189)

L listened to her whining to build trust with client

L relates 1 discussion: her "sexual escapades" with TA- "for whatever reason (probably because she was a victim of sexual abuse as a child) Ms. Arias decided she wanted to inform me of the current state of her vaginal grooming. In doing this, she went too far......the ABA guidelines do not require you to listen to that kind of stuff"

L claims visits were manipulation "into acting in accordance with her wishes"

L relates another discussion about a motion: she tried to talk him out of filing motion, wanted it withdrawn- "I would not do it and Ms. Arias started to cry and ultimately pitched a fit. She put her head down on the table and cried loudly" she "droned on like a child who was not getting her way and she kept going while I just sat there" (pg. 191)

-L claims he could see how she manipulated her parents as child- tantrum until "her demands were met"

-when she wouldn't stop crying, he got up, she cried louder "it was her 'hail Mary'. it did not work, I left"- days later she called and "vigorously scolded" him

L claims that in last book, it will include letter to the murderer from him

only 2/3 times in his career that L saw naked pictures of clients in his cases

"I have never had a murder case in which nude pictures were part of the evidence collected in the case"

most pics were "very pornographic"- murderer's vagina+ anus

included "mild pics"- and those of the murderer lying on bed like a "blow-up doll"- TA "flashing peace sign"

photos showed that the murderer was at TA's house on 6/4/2008- made her prime suspect

L claims that photos were "undisputed that" TA took the photos- he chose to take "graphic objectifying pictures" of the murderer- TA was "really into" the murderer "in a sexual way"- not only nude pics but "graphic pictures of her vagina and anus"

L claims pics were "a big deal" to the murderer- the pics played "huge role" in L's trial strategy to save her life- pics couldn't be "contradicted"

-image was important to murderer- not happy to show pics- she whined, nagged, cried, "hours on end...the whole world was going to see her vagina"- L wasn't concerned about her image

"...it was not as if her image was otherwise pristine, she had killed someone, my job was to save her life not her image" (pg. 185)

but L did file motion to restrict access on the monitors "Can we not throw my client's vagina up on the courtroom monitors"- motion denied and shut the murderer up

L didn't want them published before trial began- wanted them to be "quite impactful as evidence...at trial"- the murderer agreed

L claims that the murderer saw him as her boyfriend ("in her sick twisted mind") and it was OK for him to see pics

L filed many more motions- "and 'she creeps me out' is not a viable legal motion. trust me, if it was, I would have filed it" (pg. 186)

Viva Las Vegas


L states the murderer has a "very self-destructive streak"- in this chapter he will tell us how he took steps to combat it

L reminds us again that this book is his thoughts/things he did before the trial

L talks about the murderer's "most prominent self-destructive acts"

-the various stories she told Det. Flores

-the ninja story she told on her CBS interview

"and in perhaps what is the stupidest thing I have ever seen a defendant do, Ms. Arias gave an interview to Inside edition whereas she said that no jury would convict her" (pg. 187)

L reminds us that all these things happened before he had her case

L was worried about what other things that he didn't know about that the State would bring up at the trial- he believed she was doing self-destructive things (SDT) behind his back

L talks about "ethics"- how much time trying to stop SDT that client attempts? obligated to stop her? stop her in a "covert manner"?

L called AZ Bar's "Ethics Hotline"- he "could and should act covertly"- they felt if it saved client's life, he should act- his ethical duty is to save the murderer

L said it drove him "nuts"- wanted to escape to Las Vegas for 3/4 days

L now talks about flying to Las Vegas- he became suspicious about the murderer and someone living in Las Vegas from her jail calls- thinks hiding evidence- something that might be humiliating to the murderer (she was all about "image")- might help her case instead?

L states he couldn't just call the person- her "helper" would check with the murderer before handing any evidence over- "these people were basically under Ms. Arias' control"

"(On a related note I used to joke with my fellow team members, those I had before the shakeup, that if Ms. Arias ever walked out of jail that there would be twenty guys waiting and holding flowers thinking that they were her one true love or that she would reward them for their efforts)" (pg. 200)

So- behind her back- without the person knowing they were coming- Wilmott, someone called "Bud" and L went to Las Vegas "on a covert mission"- knew where this person lived, but not where he worked

they went to his apartment where he lived with MOM- she was scared- she wouldn't open door- left card- he called later on, same day- wanted to talk- met next day @ coffee shop MGM Grand

L talks about Wilmott: that night they went out for drinks- got to know each other better

"The more I knew of Jennifer the more I liked her. We were becoming more than co-workers, we were becoming friends"

L was impressed with Wilmott's drinking "skills" and "no worse for wear" the next day

L worried that the man would bail out, but he did come and "gave up everything he had related to" the murderer and promised to send L more things in the mail- L claims the man was scared

the murderer was hiding something from L, but "it really was nothing of importance to her case"

L talks about another Las Vegas thingy:

"I think the story is an important one because my relationship with my teammates will become an issue down the road as this story moves forward...how much damage Ms. Arias needed to do to these relationships in order to cause the sort of divide she needed in order to get the control she needed" (pg. 202)

L and Wilmott were traveling with their spouses and they went to dinner and Air Supply concert- talked about kid puking behind them while they were eating- "..the experience was the sort of thing that friends joke about down the road and Jennifer and I did for a while"

Is it wrong to love the fact that L. Kirk was forced to listen to JA for hours. Kinda a bit of karma for what we had to endure from him talking in that whiny little voice for HOURS. Sheesh. Acorn... Tree.

It is not wrong to love that fact! Not at all!

I was laughing at his comment about how the killer creeped him out. LOL...old Nurms gives off a respectable amount of creep vibes as well. Apparently he is not aware of this though it is difficult to believe it has escaped him.

Although I'm only "reading" this book through YN's wonderful posts, I get the feeling that self-awareness is totally lacking in L. Kirk as much as it is in JA. They both seem unaware of how they appear to others and only see what is reflected in their own mirrors. I really thought I couldn't like him less than I did at trial, but I've discovered a new bottom. I despise him and his meanderings through HIS truth. It sure isn't the real truth.

L talks about "this is your brain on drugs" because he called the murderer "Jodi"

"take the egg but do not crack it, smash the egg into the pan, shell and all....find some fecal matter, throw it into the pan, add a chopped up dead rat and scramble the whole mess up. Once completely cooked this concoction would approximate the effect Ms. Arias would have on my brain"

L states- every time he left jail after meetings, he was "exhausted...brain was mush"- phone conversations too

L talks about a theory he heard a "pundit offer this theory about" the murderer on TV program (doesn't remember who)- L thinks theory is "highly insightful"

-the theory: murderer "had abilities like those of a cult leader...she possessed a unique ability to convince people that she was telling the truth, without actual proof, simply because she was the person saying it" (pg. 204)

L talks about Donovan being one of the cult members and others: a reporter tried to see the murderer while in jail to interview her, but couldn't- he did speak to several women who were her "pod mates" who "almost universally" supported the murderer- holding up signs "Free Jodi"....a few asserted her innocence"

9 Out of 10 Days


L talks about the "sentiment behind"...... "I did not like Ms. Arias 9 out of 10 days" comment in his closing of guilt phase of trial

"...as talking about this comment was not really optional talking about the sentiment behind this comment would provide you with enough understanding of what I learned about Ms. Arias as I prepared for trial...I am not going to deal with why I made this comment during my closing argument in this book." at this time (pg. 206)

Is it true? "Yes"

L states that many people believe that because he was the murderer's atty, that he " believes her story" and "support her actions and that I like her as a person...none of these things are true"- he did not ask to be her atty and was appointed and forced to remain as her atty when he wanted to leave

"...I did not believe her claims of self-defense, I did not support what she did on June 4, 2008....I did not like Ms. Arias"

L states, that as an atty, he doesn't try to be friends, have feelings- they are just clients- in capt'l cases, they have murdered someone- "I tend to exclude killers from my peer group", so he doesn't "like" his clients "in the sense that the word is most commonly used", but he does "like" some of their "likable qualities"- or "I feel highly sympathetic for their situation and/or personal histories, so in that regard it can be said that I do 'like' some clients"

L claims, because of confidentiality, he can explain some things, but not all "tip of the iceberg"

Some reasons:

-she was happy to ruin his career "by forcing me into a position where I would have to help her make these assertations against" TA- (not how he wanted to defend case)- they would never had come to trial- what he wanted/ damage done to him, didn't matter to her

"..she was smart enough to know that I would have to go with her defense if I could not prove her wrong" (she PP Legal lawyers to answer her questions)when he was trying to leave "she wanted me to wanted to be nice...act like we were friends...She wanted me to drink the Kool-Aid...to join the 'Cult of Jodi' "

L started to "dislike" the murderer after he was forced to stay on as her atty Spring, 2011- after that "she knew that I could not get away and decided that she could treat me any way she wanted because of this reality"

-she threatened his business, wanted him at her beck and call.."I was the attorney and she was the boss"

"...it is more accurate to say that I disliked and /or despised her 9 out of 10 days"

"what about the tenth day?....the tenth day simply accounted for the days I did not have to deal with her or think about her case...if I did not have days like those where I didn't think of Ms. Arias, trust me, it would have been 10 out of 10" (pg. 209)

Thanks YESorNo for reading the book and sharing. Knowing how the murderer was through out the trial, 'reading' what KN 'wrote' and taking that for what it is worth, I can only imagine what the prison officials, guards and others that work there must have to deal with in regards to the prisoner and other prisoners. I never could do that....I have one big headache just reading KN 'stuff' through you!!!!

Thanks a bunch....bunches of flowers, drinks, good food, lots of fun movies and big vacation to what you are doing and a shopping spree....you get to enjoy....wish I could make it all come true for you.
 
Reading Nurmi's description of JA's effect on his brain, and the "cult of Jodi" just drives home to me the effect she had on Travis. She would not let go of Nurmi and was determined to bring him down, and she did the same thing to Travis.

Although it seems that a lot of Nurmi's book is self-serving, trying to salvage his reputation, I'm really glad he has written it because it gives us an up close glimpse in JA's mind...from a safe distance. She is a master manipulator. I can't imagine having to defend her. And I do have some compassion for him, even though I don't like what he did.

I truly appreciate that our legal system affords even someone like JA an adequate defense. Nurmi was required to defend her the way SHE wanted to be defended. In doing so, he faced the wrath of the public, but she will never be able to win an appeal based on an inadequate defense. As horrible as it was to see Travis trashed during the trial (and I do believe that Nurmi went too far), if that prevents JA from winning an appeal, perhaps it was a necessary evil. Nurmi did his job, and as much as I hated watching him do it, he did what he was required to do under our system of justice. The real villain here is still JA. May she fade away into oblivion...the worst possible punishment. JMO

L talks about "this is your brain on drugs" because he called the murderer "Jodi"

"take the egg but do not crack it, smash the egg into the pan, shell and all....find some fecal matter, throw it into the pan, add a chopped up dead rat and scramble the whole mess up. Once completely cooked this concoction would approximate the effect Ms. Arias would have on my brain"

L states- every time he left jail after meetings, he was "exhausted...brain was mush"- phone conversations too

L talks about a theory he heard a "pundit offer this theory about" the murderer on TV program (doesn't remember who)- L thinks theory is "highly insightful"

-the theory: murderer "had abilities like those of a cult leader...she possessed a unique ability to convince people that she was telling the truth, without actual proof, simply because she was the person saying it" (pg. 204)

L talks about Donovan being one of the cult members and others: a reporter tried to see the murderer while in jail to interview her, but couldn't- he did speak to several women who were her "pod mates" who "almost universally" supported the murderer- holding up signs "Free Jodi"....a few asserted her innocence"

a week after judge Duncan ordered L to remain the murderer's atty- PDO's administrators decided that having L as non-employee was problem- being in charge of their employees- didn't have control over him

L had to file another Motion to Withdraw

L states the PDO said that there was no problem with his conduct- it was "not about me, but their system..[L] was not ordering these people to do inappropriate things, this motion was denied"

L wishes he had original team "throughout the case"

at same time, one of the experts became ill- wouldn't be available to testify at trial- allowed to withdraw

L states that this type of expert "was a huge loss to" the murder's case

L talks about law and defendant's "unrestrained right to not only defend themselves against the charges but to defend their life by presenting mitigating factors to their jury...These rights are absolute" (pg. 214)

L needed to find new DV expert who could be ready for trial Nov., 2011

after some time, L found ALV - counselor DV relationships in various settings- no PHD so was risky- "she was one of the few experts willing to give it a go, out of a modicum of desperation, I was willing to consider using her"

L sent her some material, talked on phone a few times- impressed with her

"Alyce was both very knowledgeable on the subject of domestic violence and quite likable as well" but no PHD

ALV was "not sold on taking the case"- before taking case she wanted to meet the murderer- spent "greater part of the day" with the murderer

L, ALV, and Mit Spec met over dinner- "I greeted Ms. LaViolette with a hug and said she 'Okay, I'm in' "

Chapter 38

I Lose My Team


L thought that trial would start Nov., 2011- he was "excited. The thought of being rid of Ms. Aris by the summer of 2012 and being able to move on with my life was exciting" (pg. 217)

OPD had a conflict of interest- could no longer be involved with murderer's case

L explains some conflict of interests and:

"As it relates to the Arias case this conflict likely arose because...something was discovered about a newly listed witness or something was discovered related to an old witness that would not allow the Public Defender's Office to be involved in the case from an ethical standpoint" (pg. 217)- L doesn't know what conflict was tho'

Judge granted PDO's request- so L had no team

L states that he thought the murderer wasn't unhappy about a new team

"As for MS. Arias.....I don't even think she was unhappy about the ruling. Ms. Arias could not seem to manipulate any of the people she was losing so I suspect that in her mind she at least now had a chance to manipulate her new team members" (pg. 218)

L wasn't happy- he didn't know when case was going to trial- couldn't go to trial until the murderer had "a complete defense team"- problem not just finding them, but new team needed time to "get up to speed on the case"

"My sentence had gotten longer....I would be working on the case without the team with for about two years...I felt I was screwed....I really cared for these people...they would no longer be helping me on a daily basis...they had a great deal of knowledge about the case" (pg. 219)

L states that he was her only lawyer- former team members were happy to be out- they did not have positive feelings for the murderer

"..in addition to continue to develop the case with Alice LaViolette, I had to bring a whole new team on board. I had to educate them on Ms. Arias' case and more importantly about Ms. Arias as a person. The latter being of the most importance because frankly I knew I had to do it quickly before Ms. Arias was able to figure out how she could manipulate them." (pg. 220)

Chapter 39

Building a new Team


L had to figure out "where these people were coming from....all qualified attorneys in Maricopa Countywere one potential source...another... the 'county contract list'..a list of Capital Attorneys, Investigators and Mitigation Specialists...maintained by Maricopa County" (pg. 221)

L states that Judge Stephens asked him to use the "county contract list" and gave him a week to find his team- the murderer had her own list for Co-counsel for L, but never presented him with list (he would have ignored her list- and that would have caused more problems)

L states that, at the time, he thought his new team wouldn't have much work to do as "most of the work had already been done"

L states he had his own theories on how best to proceed in case "virtually every fact from every angle possible. This is not to say that I was not open to new thoughts..I realized that it might be hard for some people to accept my thinking because as they learned about the case they might have their own theories...or what evidence to present to the jury" (pg. 222)

L states that this new team might be frustrated when presenting their theories- they "might get frustrated when I explained that the former team already considered their thoughts and in essence, dismissed them"

L was looking for teammates who would understand where the case stood "and accept the strategy that had been mapped out without too many problems"

L used the "county contract list"- wanted Co-counsel who:

- able to choose the rest of team with him

- who was experienced in capital cases, contribute their own thoughts, follow his directions, work hard, who "Ms. Arias would like enough that she would not waste my time complaining about them"

L's 1st choice was too busy with another case- 2nd choice was also too busy

L then contacted Willmott- he had worked with her before, smart, easy to get along with, hardworking

Willmott didn't have capital trial experience- so, was 3rd choice

L thought the murderer would like her- "..(little did I know until later on) and she would not 'go rouge' "

"Looking back, in many ways I wish that I never would have called Jennifer and not for the reasons you think."- when he first made the call "at the very least we shared a pleasant acquaintanceship if not a somewhat distant friendship"

"However, now, I believe that what we went through together created a level of distaste for each other and I realize that such distaste would not exist if I had not made that call" (pg. 223)

Willmott accepted- join in the case- "her life was forever altered and seemingly for the worse" she "would never had said yes had she know what was to come"

-eg.-she was threatened and so were her children, "ugly things" were said about her on social media

L wishes that Willmott had to go through those things- she never complained about being on the case "nor, to her credit did she ever admit that she wished she would have simply hung up on me that day" (pg. 224)

L talks about how "wonderful" Willmott is

"she is someone with whom, if the stars ever so align, that I would be proud to once again call my friend"

L and Willmott discussed who team would be- L didn't only knew 1 name for Mit Spec- Willmott suggested MDLR who did a lot of capt'l cases, great with clients

L met with MDLR-

"found her smart, intelligent and to be a very compassionate person..let me say a few words about Maria to all those who choose to cyberbully her."

In future books, he will "references choices Maria made that I was not happy with...things I wish she would have not said...However.....those who bully Maria should know that she is a smart, kindhearted woman, a woman of faith with a goos sense of humor....may not be perfect.....she is someone who is worthy of your respect, not your distain" (pg. 225)

final member of team- "Bud"- the investigator....not much work for him in beginning- most investigating done already, but did lots more later on

"Bud" meant "a lot to me on a personal level. He became a huge asset to me because we shared the same outlook on" the murderer- he passed away at end of 2nd trial

the murderer 1st met Willmott , when they appeared before Judge, L states that "ironically" it did not "seem" that the murderer like Willmott "Ironic because of how much that would change over time"
