trial day 38: the defense continues its case in chief #110

What is the reason why they wake up inmates between 3-4am on days of the trial... If trial does not start till 10:30 am?

they wake inmates early so that the inmate has time to brush teeth, clean up, eat breakfast. Once the inmate does this, the inmate then has to wait for the jailors to escort them to a holding tank, where inmate will wait until court starts.

the wheels of justice turn slowly, but it also moves slowly in the jail. the jailers will wake the inmate early, but it takes forever for the jailors to do paper work, head count, etc..once the jailers take inmate out of cell, then they have to wait for transport..which takes time, then transport carries the inmate to a holding tank at the courthouse, where inmate will wait a few hours before court starts.

its just how it is..its like this in many states..

LaViolette DID interview Jodi & she DID lie to Alyce about computer pics. Of course later changing story to match computer forensic evidence. Here's more info:

During Juan's cross of Jodi on Day 21, Juan mentions the hearing on August 8, 2011. This hearing was where Jodi tried to get Matt McCartney to lie for her about pedophilia accusations against Travis & attempted to slip magazines to him. LaViolette was in this same hearing & told Juan Martinez during questioning that Jodi had told her Travis was masturbating to images on a laptop (not pieces of paper on bed).

Separately, accounts say that Juan was furious about LaViolette's testimony and immediately filed a motion to preclude LaViolette from testifying about Travis Alexander in any way. Mainly because her testimony would be based on a lie from Jodi. Prosecutor could prove this was a lie because it directly contradicted Jodi saying she saw Travis masturbating to pictures on his bed NOT images on laptop.

On August 15, 2011, the judge granted the state's motion to preclude LaViolette from speaking about Travis and limiting her testimony about main issues of abuse.

Separately, I seem to recall that Jean Casarez was recently on HLN speaking about this same hearing where LaViolette and Juan got into it pretty heavily and that LaViolette didn't fare well against him. Apparently Jean didn't think LaViolette would hold up against Juan much better than on that day when he gets her on cross. Does anyone have that video?

I suspect she made the rope up to go along with one of the stories LaViolette will be telling about abuse victims and how they just go along with everything.

For those of us that are left on the board today, I have a question for anyone. These two pics show a tiny piece of rope, but I don't see any references for the pics??

I've tried to upload them here, will see if it works. I'm just wondering what these pics are? Looks to be on TA staircase?? Anyone have a comment? Were these ever discussed anywhere? Thank you.:seeya:

I don't know how rough pugs are with toys but the second picture looks like it could be part of a dog toy. (my dog will just up and decide to shred a toy and there can be parts like that lying around in the aftermath)

Did I just hear this right? That the killer is claiming she is being made to wake up too early for court.

Just to preface what I am going to say I will say this: I think JA is guilty of premeditated murder and she is a despicable human being, but she does deserve a fair trial. I don't think it is right that anyone should have to get up that early and then have to participate in their own defense.

Let's just say, if it was someone else and that someone else was innocent and was facing the DP, would that be fair? NO. And besides, the way I see it, it is a Constitutional issue. And this sheriff is on some power trip.

I have no idea.. I don't remember anything form before the last week..lol.. I think it was said no pillow was missing or something and I don't know if it matched anything with the other pillows in the house

Didn't they mention these pieces to be the tassles that were on the throw pillows?

In these pics that Trainfan34 included links to, they do look like they could be tassels from curtains or pillows, but the ones I posted on the staircase looked more like rope, but they could be tassels too. Silly me, I forgot something from this really long and convoluted trial.

IIRC those were not rope fibres but tassels from decorative pillows in Travis's bedroom.

Can she get a mistrial due to lack of sleep and food if she claims it diminished her ability to participate in her case? No doubt she'd love a do-over, anything to put off date with that pesky needle.

I don't know about grounds for an appeal, but from what I understand, this is the way things have been (waking up early, food, etc.) since Sheriff Arpaio was elected back in the 90's. She's no better than anyone else who has stood trial for a crime and IMO, shouldn't be given special treatment of any kind. :twocents: Her "friends" can complain til they're blue in the face, but if Jodi hadn't slaughtered Travis to death, she wouldn't be in this position in the first place.

This is an article from ABC about trial being cancelled for today.
Snippett;

The court did not provide a reason. Testimony is set to resume Thursday with a domestic violence expert who is testifying about the generalities of abusers and victims.

Psychotherapist Alyce LaViolette (la-VI'-oh-let) said Tuesday that many victims of such abuse don't report it and rarely tell anyone because they feel ashamed and humiliated.

So it says she is only testifying to the generalities of DM.
I can't wait for JM to turn her into a states witness!!!!

O' I think I just heard Beth Karas imply that it's Donovan who is the mouthpiece on this early rising complaint.

Well, there you go. Ms. Donovan called to complain. :what:
If Jodi is there that early, then she should nap before trial and at the lunch. She is entitled to purchase candy, cookies, protein bars, etc, why doesn't she eat one just before she leaves, or get permission to bring one with.

I feel like it's a test by Jodi to see if she could get court shut down for the day - now she knows she can. I agree, she should have been given medicine and something to eat - they take an early lunch then resume after as usual.

There is no doubt in my mind and that is what I am thinking.

I'm just going to say it, I don't care: Donovan is an idiot. She fell for Jodi in jail which is the only place she has interacted with her, which means she doesn't really know her. If Don thinks for one second that after this is all over, whether acquitted or convicted, that she will give two cripes about her then she has another thing coming. Unless Donovan has something she needs/wants, she is going to drop her like a habit. Weird how Jodi has no friends from the outside supporting her. Huh.

When O when will the princess learn that upon murdering her prince she has has had her self anointed princess crown reefed from her head, and she has been sent to the tower to live not so happily, for as long as that may be.

The end.

Honestly I think that she believes that she doesn't deserve to be punished. She doesn't care that she hurt anyone, she feels he deserved it. JMO of course, but it just seems that way to me. No wonder they have her on strong medications (tranquilizers IIRC?), I think she would have snapped a bit in the courtroom, if not.

They said her family is complaining of this too.

So is JA supposed to receive SPECIAL TREATMENT from the jail and court ??
(I certainly do not mean to jump on you about this ... I'm just sitting here with my jaw dropped because JA and/or her family thinks she should be treated any differently than any other prisoner housed at the jail and being transported to court daily)

I think not.
Maricopa County has been housing, feeding, transporting their inmates to court for years & years.
The courthouse runs the same basic way ... day and day out.

Thousands & thousands of inmates are handled and processed thru their system - from jail to court and back to jail at the end of the day.

I'm sure none of the prisoners like getting up early, or enjoy the food the are served.
This ain't the Ritz Carlton.

Yep...give me a second or 1000 :)....I was thinking while researching I should have done that....

Juan sent Wendi Andrino to death row
trial 17 weeks
WA on the stand 9 days
jury deliberated 2 1/2 hours.

She even managed to give herself
neck bruises that looked like she
was choked! :dunno:
