I think HHJP will keep her in, if you remember the indigency hearing when the JAC attorney was complaining about costs, they realized she was way too far into the case to have someone else start over.
 
Hmmmm didnt she claim during the indigency hearing that she was working for free may have picked that up wrong and im sure someone will let me know but iirc she did say this, so it cant be for "fiscal" reasons
 
I completely agree else this has to be a MAJOR blow to the Defense, which has been more focused on sentencing than the trial.

Well yes, they have to know they haven't got a hope in hell of avoiding the verdict. What the sentence is has to be their main focus.

So now I'm wondering which way are they going to go with the mitigation....

(6) MITIGATING CIRCUMSTANCES. Mitigating circumstances shall be the following:

(a) The defendant has no significant history of prior criminal activity.

(b) The capital felony was committed while the defendant was under the influence of extreme mental or emotional disturbance.

(c) The victim was a participant in the defendant's conduct or consented to the act.

(d) The defendant was an accomplice in the capital felony committed by another person and his participation was relatively minor.

(e) The defendant acted under extreme duress or under the substantial domination of another person.

(f) The capacity of the defendant to appreciate the criminality of his conduct or to conform his conduct to the requirements of law was substantially impaired.

(g) The age of the defendant at the time of the crime.

I think AL probably told her. However, that means CM is now the "mitigation specialist" also. Maybe he just wants to steer clear of KC until she settles down a bit and let JB continue the smoothing over phase. Really do hope the Court appoints another DP qualified attorney to help CM out. That is how it works here anyway, who knows in Florida.

I think the timing was planned to give AL's mitigation specialist the time needed to complete her visits and report.

After all of the number of hours AL specialist spent with Casey she would have plenty to complete a profile and report. I think that there are no more visits necessary for a mitigation specialist other than court appearances so CM only has to build on that.
 
What happens with "Mort" now?...guess CA will be losing the only "PI" she now trusts! :woohoo:

I remember Judge Perry telling the Defense to use local P.I.s in whatever out-of-state locales they were doing their investigating or research.
To use local P.I.s in the Orlando area who Mason and JB are familiar with.
 
Another one bites the dust......

I think that this is a mix of:

1. A clash of personality/style between AL and Cheney

2. AL not being well received in the Florida courts

3. AL realization she is on a path towards a Lose-Lose

4. $$$$$$, the indigent fees do not cover her high priced costs

I have to agree with all of your above, plus, I would bet that DePaul University is sitting with a mighty p-o'ed look on their paperwork for the money that was drained from their accounts for Casey, who isn't even a resident of Illinois. {realizing that this fund was also for other/many out of state people also}
But, Miss Casey certainly cleaned out that account, much as she has been known to in the past ~

Also, perhaps as things progress, maybe Andrea Lyon was more concerned about "other money info" coming out, that has yet to be accounted for that many have questioned.

Her "clean record" certainly plays into this also, IMO.
This entire family have been unco-operative from the get-go.
You can only beat the drum for so long before the echo rings bad in your ears if the players aren't following the sheet music.

So, along with Andrea Lyon, byebye Mort and and Jeanette.

I believe when the dust settles, that Judge Perry will order them to procede on schedule.
There should be plenty of notes and recordings for someone else to pick up and catch up.

Bye bye Mort and his finely honed investigating skills with trying to get searcher Joe J to say he searched with Laura B, when he did not, and to say he agreed with the info on the TES search form they showed JJ. Guess Mort won't be around to back up that illegally recorded audio tape??
 
Wow, I come over here after being in the Kyron Horman forum all day, and see this! Can't say I'm surprised. I figured that was going to happen when she quit coming to any hearings and was so bad over the phone in that one hearing. Big blow to the defense team, but at least we won't have any histrionics or Lyon drama in the courtroom for sentencing.

And Depaul, I imagine, is breathing a HUGE sigh of relief right now. They might have even given her a raise as a reward for finally leaving this case...
 
Cindy's letters to the Inmate clearly showed there was a rift between the roaring lyon and JB, in how to handle the Inmate's "image" and how to have her communicate with her family.
 
Wait just a minute. Wasn't this case pushed back so far mostly because of Lyon's teaching schedule? If that's the case and she's now gone...ooooh, defense. This could be a really, really bad move for you! HHJP is not going to like the one reason this case was pushed back so far LEAVING, especially since he made special arrangements because of Lyon! Could this mean the trial gets moved up now?

I just looked at my notes from the JAC Budget hearing and Judge P said nobody is irreplaceable.
The Judge said Jeanene had gathered what she has done, and asked if someone in FL could take over from her work. They went to a sidebar.
The Judge said they can keep her, but Jeanene must keep detailed records to make sure of no duplication.
Judge said he would go over her billing with a fine tooth comb and so would JAC - may get cut.
Rate goes down to $ 40/hr in July.
Just because the Judge said the Defense could keep her on - does not mean that Jeanene (or Lyon) could make the decision for herself to leave the case, when she feels her work is at a point where another mitigation expert could take over. IMO

I guess I see this differently. I know that universities don't pay as much as you'd think. In addition, I don't believe AL made tons of money on her book. I've known many people who have written books in academia, a very few of them make all that much because they don't appeal to the masses. Has anyone seen her book on the NY Times Bestseller List?

I really do think she can't afford to pay her expenses for the case. Remember, the trial itself will last about two months. How can she afford hotel, meals, airfare, etc.?

However, I do think she is happy to be out of that hot mess. I agree that she would face an uphill battle. In the other states where she has tried cases, it only took ONE juror to nix the death penalty. In Florida, the jury's role is advisory and it only takes a majority (I think 6-6 works, too, but I could be wrong). That would mean convincing SEVEN jurors, not the one that she is used to.

Had Strickland still been on the case, there would have been a good chance that he would not have agreed even with a majority vote. Belvin Perry is a different judge who has dished out the death penalty... even against a woman.

As for Jeanene, the mitigation specialist, I expect to see her all the way through the case. The judge approved her expenses. While she came in along with Lyon, she is independent of her.

Well she can still "help", but first KC has to get a high school diploma! She'll have to get into a college - earn a 4 year degree with a decent GPA, and then take the LSAT - and then apply! You just can't "GET" or "PUT" someone into law school! :crazy::croc:
 
O/T a bit, but isn't it ironic that not too long ago we were all complaining that there wasn't much new to discuss until a set of released docs appeared and now this news is dumped in our laps right after the letters were released. Now, how is Ashton handling this news.

Oh I forgot CM was qualified and hasn't it been awhile since his last DP case.
 
Just seeing this so I haven't read every article linked yet, but in re. a few concerns posted so far -

I don't this will have ANY affect on the May 2011 trial date. I predict that stands as is.


I think this decision is primarily due to:

-- AL not wanting to ruin her perfect record

--she already had her hands full with JB, then CM holds the presser from hell after the 6/21 status hearing :innocent: ...pretty sure she was hitting the sauce pretty heavy that night

-- and of course $$$$$$

Yeah I never thought she would stay on until trial. She would be a fool to stay on this case.
