He did appeal after all? Holy crap, I need to go back and read the thread since the last time I was here!

I need help on an off-topic thing again. Someone on another message board I frequent is missing her dad. His name is James Lund, and he was in the Washington/Oregon area. His last cell phone ping was from yesterday at 3 a.m. in the Warm Springs Reservation area. I feel awful for her, and I want to help. I suggested she post about it here, but her account is waiting to be approved. What should I do to help her? Where should I post? Please let me know, or if someone already knows, please go ahead and post about it. I PM'd Salem, but then it occurred to me that she might be on holidays or something.

So sad. My condolences go out to this young lady. Sorry for your loss. RIP James.

The lawyer who defended Tori Stafford's killer Michael Rafferty will also defend the man accused in a mass shooting at Toronto's Eaton Centre.

The 23 year old accused, Christopher Husbands, appeared in court briefly on Wednesday.

Escorted into a Toronto courtroom by six police officers, Husbands stood in silence during a proceeding to formally engage his new lawyer, Dirk Derstine.

A judicial pre-trial hearing has been scheduled for October 1st.

Husbands is charged with two counts of first-degree murder, five counts of attempted murder and one of criminal negligence causing bodily harm.

I had the pleasure of boating in the waters in front of the Kingston Penitentiary this week.

Of course I was thinking of sweet Victoria as I went by the Institution. :(

I was also thinking of Jessica Lloyd and Marie-France Comeau. :(

I spit in the water at both of the SOB's that took those 3 beautiful lives away.

Those innocent victims should have been alive, enjoying a beautiful Canadian summer day too.

You are not forgotten, Victoria, Jessica and Marie-France.

I flip them the bird every time I go by KP. It always strikes me that it isn't fair that filth like them get to live at such a beautiful spot, I wonder why we don't build the prisons on top of old garbage dumps or nuclear waste disposal spots. Guess that wouldn't be fair to the staff.:banghead:

I suggest instead of bringing back the DP, just hang a rope in their cell. I bet that would save the tax payers some money and also wouldn't place blood on anyone else's hands, yet the world would be rid of these Jack *advertiser censored**es.

Not related to this case, but of interest is the decision by Justice Mary Saunders of the BC Court of Appeal. Take heart folks ... i think even if Rafferty gets the extension and goes on to the Court of Appeal, he will be blown out of the water in the long run:

Thanks to Judge Heeney MTR will get tossed away. I am not afraid. Judge Heeney knew this day would come and thats why he did not let the certain evidence in the trial. THANK YOU JUDGE HEENEY!!

Brian Crockett, 64, was also charged with failing to provide a breath sample.

A highly regarded lawyer, Crockett was one of the prosecutors who oversaw the conviction of Michael Rafferty in the kidnapping, sexual assault and murder of eight-year-old Tori Stafford.

Proof positive that no one is immune to stupidity and irresponsible, reckless behaviour thanks to alcohol. What an embarrassment.

Well, you can be sure he'll have the best legal representation. Of all people, he would have known that failing to provide a breath sample gets the same penalty as blowing over, but I bet there's all kinds of defence angles possible.
 
Drivers often have the notion that they can “beat the charge” by not blowing into the machine, thus avoiding any reading of alcohol. What they don’t know is that a conviction for either failing or refusing to provide a breath sample carries the exact same penalties and consequences as a conviction for driving while impaired or driving “over 80″. The charge of failing or refusing to provide a breath sample is much more difficult to defend at trial than one of the other two charges.

If convicted, the penalties for all three offences are the same. You are saddled with a criminal record. You are prohibited from driving for a minimum of one year. And, you face a fine of not less than $600.00. If it’s your second time around, you’re looking at jail. And, if someone is hurt or killed as a result of your drinking and driving, the penalties go up.

Well it's pretty apparent according to that reporters article (if it's correct), BC was impaired. By failing to provide a breath sample, he must have been quite inebriated. I assume it would be easier to try and explain away the reason why he failed to give a sample then to face the embarrassment of a very high reading. I find it totally amazing, someone with his salary (over $199,000) couldn't afford to call a taxi hahaha. I guess if he doesn't retire now he may be taking a taxi to work each day. Crazy what alcohol will make some people do. Thank God he was caught and no other lives were involved. JMO

I suppose he could argue extreme psychological trauma due to the cases he oversees... *sigh*. I almost feel bad for the guy... almost. :eek:hoh:
 
Yes, it's a Catch-22 because being impaired also prevents one from making wise choices. Just shows we're all human, even highly paid crown prosecutors. Except the wealthy and connected can usually buy their way out.
