Jovon Gaston, 26, is one of three men charged with capital murder in connection with the 2011 stabbing death of Wellborn Elementary School teacher Kevin Thompson. In court Wednesday, Calhoun County Circuit Judge Bud Turner set Gaston’s trial to begin Sept. 28.
Nicholas Smith, 26, was sentenced to death after being found guilty July 2, 2013, for his involvement in the killing. Prosecutors in Smith’s trial alleged that the three men kidnaped the victim, drove him to several ATMs in Anniston and Jacksonville and robbed him at gunpoint of $400. Prosecutors believe the men then drove to a secluded portion of U.S. 278 outside of Piedmont where Thompson was stabbed to death and left by the side of the road.
The Alabama Court of Criminal Appeals on Friday reversed the death sentence that 29-year-old Jovon Dwayne Gaston received for his capital murder conviction in the killing of Calhoun County teacher Kevin Thompson.
The court refused to overturn Gaston’s conviction. But it says he deserves another sentencing hearing because a judge failed to tell jurors how to weigh the testimony of relatives who were affected by Thompson’s slaying.
A Calhoun County judge on Wednesday approved a request from defense attorneys in a 2011 capital murder case to poll the community on its knowledge of the case.
