Asking For Help

There also is no 'ring line'. Interesting observation!!

Wondering if you are planning to get either permission to reproduce or to pay for reproduction rights to any of these photos and diagrams that you might use in your 'published' book?

Getty owns rights to many of the photos, as well as Denver Post, and miscellaneous others.

I wondered that too SuperDave. A lot of these pictures were everywhere for awhile, so are they in the public domain? I would hate for you to get trouble.

Also, is anyone else bothered by the picture below? How did they get that look on JonBenet's face? It just doesn't seem appropriate.

JB was a sexualized child, IMO. Remember Patsy said she was going to be a "sexy witch" for Halloween? :tsktsk:

I'm glad you brought that up, nora. I'll have to bring that up with them.

(Incidentally, I'm curious as to why published was used in quotation marks.)

Good question. Given their origins, I figured most of them would be public material. I know others have used them.

Dave, there may be a difference in them being in the public domain versus being used in a book. Might want to pose that question.

Good idea. They must get that a lot, though. When I spoke to one of them, they asked if I wanted photos in it.

That's what I was thinking. If they are public material...do you even need permission???

JB's arm looks bruised:

I don't think this is proof of physical abuse. This part of the arm is easily bruised and may not be the result of being held too tightly or being grabbed. Fair skinned children often bruise easily. Mothers often grasp their children's arms in this fashion. But these photos do make me wonder....

JonBenet's pictures are not in the public domain. Zuma Press owns all (or most of) her pictures and if you want to use one in a TV show or a book, you have to pay licensing fees. JonBenet's pictures are copyrighted.

Here are articles about it:

http://www.poynter.org/uncategorized/76899/story-behind-the-picture-who-owns-jonbenet-photos/

http://www.nppa.org/news_and_events/news/2006/08/copyright.html

The problem in this instance stems from the fact that since the case first became news in December of 1996, the Associated Press, Reuters, and Agency France-Presse, among others, have distributed many of these same images without the permission of the copyright holders or their agent, ZUMA Press. Now, renewed interest in the story has only exacerbated the copyright issue. AP, Reuters, and AFP have issued “mandatory kill” notices to their clients advising them to remove the images from their archives, servers, and databases, and that ZUMA Press is the agent representing the copyright owners.

I'm not well versed in copyright law. Please tell me the licensing fees for the photographs doesn't end up in JR's pockets?

KariKae, unless I'm mistaken, the Ramseys would have been paid for these photos when Zuma bought the copyright, so I guess the answer is yes.

What a wonderful thought. Maybe I should just scrap the idea of photos. It's too bad, really. I was hoping that the photos would remind people that these were real, flesh-and-blood people.

The pageant photos and videos of JonBenet were sold to a photo licensing agency by Randy Simons and another photographer (Mark something?) right after the murder. They were the ones who took the photos and the videos so they owned the rights to them; not the Ramseys.

I bet that Judith Phillips has some photos that she would let you use. I know that you know that she posts on here sometime..under the "hat" COOKIE. She is an ex-friend and photographer of the Ramseys. She used one of her pictures of JB and the family...on the cover of her husband's (Doc) book about the Ramsey's. She would probably be more than happy to let you use them...without charge.

You are an amazing person with a great wealth of knowledge!

We have sent messages back and forth to each other in the past. You wouldn't believe one of the Ramsey stories that she told me. Her husband, Doc...has part of his book posted over at Forumsforjustice.org if you want to check it out. And I am quite sure that she wouldn't mind helping SD with his book...don't want to speak for her..but, IMO..there shouldn't be a problem.

Be careful with the copyright rules though,Dave.
