Leitch says the jury doesn't need to decide who the shooter was. "You may never be sure about every aspect of what happened, and you don't need to be. None of you need to decide exactly who did what."
by Adam Carter 9:55 AM

"We are not required to prove who did what."
by Adam Carter 9:56 AM

Leitch says the issue is, are you satisfied they were both in this together.
by Adam Carter 9:56 AM

I'd sure like to know why MM changed her statement. Originally she told the police that it was DM who was happy when she got in the Yukon that morning. On the stand, she added that they were both in a celebratory mood and bopping up and down in their seats. Which one is the truth?
She was hoping to marry MS at the time of first statement... now she is no longer protecting him, she has matured and moved on..

That's it. 1st degree murder for both

"If you are spending your time trying to decide who did what, you are missing the point."
by Adam Carter 9:57 AM

"You don't bring a gun to a scope and steal later mission. You bring a gun to kill, or be ready to kill if the plan goes sideways."
by Adam Carter 9:58 AM

Leitch says both are guilty either as being a party to the crime, or as the shooter.
by Adam Carter 9:59 AM

He says it's not on the Crown to prove a motive in the case.
by Adam Carter 9:59 AM

"It seems absurd to murder a man for a used truck, but that's what they did. Killers are not always rational."
by Adam Carter 10:00 AM

Leitch says the reason for the killing was Millard was tight on cash, and needed the truck to go to the Baja race.
by Adam Carter 10:01 AM

Then also says: "This wasn't a financially motivated crime. This was Dellen Millard taking what he wanted."
by Adam Carter 10:01 AM

"He could eventually sell assets to buy several trucks -- but he liked stealing things," Leitch says. "The fact is, sometimes people are just killers ... it is horrifying and senseless, but it is what happened here."
by Adam Carter 10:02 AM

The cleanup shows that the two were "in it together, all the way," Leitch says. If it was a surprise shooting, they would have acted differently in the aftermath. "They chose to work together because they murdered together."
by Adam Carter 10:03 AM

"We know you will come to the right decision here," Leitch tells the jury, thanking them for their service.
by Adam Carter 10:05 AM

"What happened to Tim is in your hands now, and we trust you to do the right thing."
by Adam Carter 10:06 AM

Leitch says Millard was complaining about his red truck being a gas guzzler as far back as 2009.
by Adam Carter 10:07 AM

Leitch says the reason for the killing was Millard was tight on cash, and needed the truck to go to the Baja race.
by Adam Carter 10:01 AM

This a dangerous statement. Millard had a quite capable truck. He didn't need a new one, he wanted a new one. Two different things.

Now talking about how it cost about $10K to get to the Baja race, and how it didn't go well.
by Adam Carter 10:08 AM

Leitch says the first step in the plan was to get a gun, which Millard did in Feb 2012.
by Adam Carter 10:08 AM

He got it from Iisho -- Matthew Ward Jackson.
by Adam Carter 10:09 AM

I wonder if the text of the Closing Arguments will ever be made available in their entirety as exhibits. Anybody know?

Susan Clairmont said that Leitch will give her his closing transcript so that it can be published. Dungey's wasn't written out, and Pillay said he might give it to her, but I guess he didn't.

Leitch says Millard was "proud of his new purchase," as judged by the photos he took of it.
by Adam Carter 10:09 AM

"16 months before the murder of Tim Bosma, Dellen Millard acquired the lethal force to kill him," Leitch says.
by Adam Carter 10:10 AM

Leitch says this was a plan "hatched" with Mark Smich, in "full force" by Feb. 2012.
by Adam Carter 10:11 AM

Leitch also talking about how Millard was telling Smich to get a licence, so he could drive during a mission.
by Adam Carter 10:12 AM

Leitch talking about Smich's text where he says they "need a plan" and "can't make any mistakes."
by Adam Carter 10:13 AM

Leitch now talking about where MIllard says he stole some practice ammo for Smich.
by Adam Carter 10:13 AM

Leitch says these texts show that Millard has the gun to kill Bosma, and the ammo to do the job. "These texts show they are working together to arm the handgun."
by Adam Carter 10:15 AM

"They're working together on the plan in these texts."
by Adam Carter 10:15 AM

Leitch now talking about when Millard got Schlatman to build an incinerator. "I submit to you it was a preliminary attempt to build an incinerator to carry out the plan," Leitch says.
by Adam Carter 10:16 AM

Is he saying that it cost $10,000 in gas?

Yes. It was actually $11,000 I believe. Can't remember whose testimony finally brought that out. I think it was LW1 who said the entry fee for the race was $11,000 but then it was clarified later that it was that amount just for the gas.

MOO

A diesel engine is about 25% more efficient, so in the grand scheme of things it would only save him about $2500 having a diesel, barely the cost of his gun. Not making a huge amount of sense.

"If it was really built to burn garbage, why did Mark Smich have an interest in this?" Leitch says, noting there is no evidence of it being used that way. "This is just a cover story."
by Adam Carter 10:18 AM

Leitch is really quickly running through the timeline here, attempting to show how the two had planned this all along.
by Adam Carter 10:20 AM

Leitch says given all the mission we've heard about previously, "why did the plan suddenly change to show your face to the person you planned to steal the truck from?" Leitch says they showed their faces, because "identifying them was a non issue," and they "planned to kill the target." "Dead men don't do photo lineups."
