4/2/24 Update: Day 4 of preliminary hearing. The first witness called, Oshe White, was wounded in the melee a& later failed to appear, leading to him being taken into custody & ordered held until testimony scheduled for Tuesday. Next up was Ike Harris, a cousin of Sergio Harris, one of the six people killed that night. But as soon as prosecutor Brad Ng began his questioning by asking whether Harris had been at the scene on April 3, 2022, Harris invoked his Fifth Amendment right against testifying. After determining that Harris planned to answer other questions the same way, Judge Gilliard ordered he be granted immunity to testify. Preliminary hearing continues on Wednesday, 4/3/24 @ 9am.

Man shot during K Street shooting called to testify in preliminary hearing

The judge granted him immunity as he testified in court, but he said he couldn’t recall most of what happened that night when prosecutors asked him questions.

At the time, White identified the man as suspect Smiley Martin, but he said in court he couldn’t remember.

4/8/24 Update: Witness Oshe White, who was struck by bullets 4/3/22, but survived, either couldn’t recall or disputed Mrghan Cunningham’s narration of events depicted in the footage. Cunningham, who represents defendant Smiley Martin, repeatedly played scant seconds of videos taken moments before gunfire broke out from two groups gathered at 10th & K streets. As an uncooperative witness, White has been ordered to be placed in custody to compel his testimony. He invoked his Fifth Amendment right when he first took the stand last week. Cunningham attempted to establish it was White & his cousin, Sergio Harris, who instigated the shooting — an allegation refuted by White. Harris died in the shooting. White’s cross examination was scheduled to continue 4/30/24, after which the preliminary hearing will continue in August. Next preliminary hearing on 4/22/24 @ 8:30am. Preliminary hearing which continues on 4/12/24 @ 8:30am.
