*Trial continues (Day 8) (@ am ET) - Canada – Thanh “Tien” Ly (46) (found Mar. 28, 2022 on a sidewalk in the area of Eastern & Berkshire avenues, west of Leslie Street, around 1:30pm in a garbage bag dismembered; ID'd on Mar. 31, 2022, Toronto) - *Dallas Ly (20/now 22) son arrested & charged (4/2/22) & arraigned (4/3/22) with 2nd degree murder. Plead not guilty. Remanded to custody (4/3/22).
Trial began on 4/29/24. Crown rested their case on 5/7/24. Defense started on 5/8/24.
Justice Alfred O'Marra presiding. Assistant Crown attorney Jay Spare. Defense lawyer Marco Sciarra.

5/13/24 Monday, Trial Day 7: Defense witness: Psychiatrist Dr. Mitesh Patel, who interviewed Ly on several occasions & found that he has post-traumatic stress disorder due to abuse by his mother, as well as a major depressive disorder.

The defence is arguing that Dallas had PTSD from abuse by his mother. The psychiatrist testifying for the Crown believes the murder itself caused his symptoms:

“Dr. Alina Iosif, a psychiatrist called on by the Crown, agreed that Ly exhibits PTSD symptoms, but said the source of those symptoms stemmed from the killing of his mother.

"To be anxious around someone who is critical of you is not a PTSD symptom, it's just a fact of life," Iosif said in court Tuesday.

Iosif didn't interview Ly but sat in on his testimony and also heard Patel's evidence and read his reports. She said she doesn't agree Ly met the bar for PTSD at the time of the stabbing, challenging Patel's diagnoses of Ly.”

His father was briefly mentioned:

“Greenwood asked Dallas about his background. He told the court he only finished grade 11 and struggled in school. His mother also told him after his father left them, when he was 11, she told him his father had passed away in Vietnam after associating with bad people. Dallas said he only learned that his father was still alive when he found out his father had been interviewed by police.”

The jury was told they’ve now heard all the evidence and lawyers will deliver their closing submissions on Thursday. They’re expected to begin deliberations after Superior Court Justice Alfred O’Marra charges the jurors next Tuesday.

And then not until next Tuesday.

5/14/24 Tuesday, Trial Day 8: I “think” the defense rested after Dr. Patel testified. Dr. Alina Iosif, a psychiatrist called on by the Crown.
*The jury will hear closing arguments from the Crown & defense Thursday, 5/16/24, with jury deliberations expected to follow starting next Tuesday, 5/22/24.

5/21/24 Tuesday, Trial Day 10: The jury which was sequestered to begin deliberations on Tuesday. In his final instructions to the jury, Superior Court Justice Brian O’Marra told six men & six women that to convict Dallas Ly of second-degree murder, the Crown must have proven beyond a reasonable doubt that Ly, who was 21 years old at the time, intended to kill his mother, Tien Ly, or ought to have known the bodily harm he caused was likely to cause her death & was reckless. Around 4 p.m.Tuesday, the jury returned with a question for the judge asking if they could have a transcript of Dallas’ testimony since they had “conflicting memories of some of his statements.” O’Marra told the jury to rely on their collective memory of the evidence. “If there are areas of interest, we can review our collective notes & recount those areas of interest or alternatively, playbacks of the evidence can be arranged.”

IMO, he was laying in wait for her to return to the condo.

He’d had enough, having to work at her salon etc.

He’s a lucky fella to get only second degree murder IMO.
