Patrick Frazee found guilty in murder of fiancee Kelsey Berreth, given life without parole plus 156 years
It took a Teller County jury less than four hours Monday to find Patrick Frazee guilty of murder in the death of his former fiancee Kelsey Berreth.

Frazee was then sentenced to life without parole plus 156 years. Under a mandatory sentence, Frazee would have served life without parole.

The verdict came after 10 days of testimony from 60 witnesses who strung together evidence that Frazee fatally bludgeoned Berreth at her townhome before absconding with the body and burning it at his ranch.

[...]

In searing letter to court, Cheryl Berreth - mother of Kelsey Berreth - said Frazee “tortured to death” Kelsey Berreth, leaving her toddler daughter to “call out for mama in the middle of the night.”

[...]

Fourth Judicial District Judge Scott Sells began to choke up when delivering the sentence to Frazee.

"Your actions were vicious, senseless, without reason or explanation," he said.

'She mattered': Kelsey Berreth murder suspect sentenced to life plus 156 years
[…]

Jennifer Viehman, the lead prosecutor on the case, spoke following the verdict and sentencing of Frazee.

“This is, without a doubt, one of the most brutal murders that I’ve ever seen," Viehman said. “Mr. Frazee took a shining light from this Earth that we’ve heard over and over again from everybody who knew her. And he not only took her life on Thanksgiving Day of last year, he planned for months to do it."

[…]

“Patrick took Kelsey’s life, she was our daughter. A devoted, loving mother, a sister, a friend, and a valued pilot teaching the military how to fly. She was a positive contribution to society, beautiful inside and out," Berreth said.

“Patrick, how would you like to find out your daughter’s life ended the way that you ended Kelsey's? [Your daughter] deserves a letter of sincere apology. You need to take full responsibility for your actions," Kelsey's mother added.

[…]

“Your actions were vicious, senseless, without reason, explanation. Kelsey spent her last night caring for you, and you repaid that kindness and humanity by viciously beating her to death," Sells said.

“After you beat her, you burned her body like a piece of trash. You solicited Krystal Lee three times to murder her before Thanksgiving of last year, Kelsey was a wonderful mother, a beloved daughter, sister, and accomplished pilot," Sells added. “Your crimes deserve the absolute maximum punishment legally available in the state of Colorado.”

Patrick Frazee Sentenced To Life Plus 156 Years For Murder Of Kelsey Berreth, Prosecution Calls It 'A Sweet Day'
[…]

“It’s a sweet day in the sense that justice is brought to Patrick Frazee for this brutal, gruesome, senseless murder,” said District Attorney Dan May.

[…]

At the sentencing hearing, Kelsey Berreth was described as a wonderful smiling woman. Her mother Cheryl’s written statement called Frazee a “sick man” and questioned whether he would have killed their baby, Kaylee, after killing her mother.

“When we first learned how terrible it really was, it was a nightmare because we knew what her last moments were like,” said Prosecutor Jennifer Viehman.

Clinton Cline knew Frazee and had worked with him on a wild donkey herd.

“[Frazee] doesn’t meet the profile of the guy I knew,” said Cline. “But people do things you get shocked about all the time.”

Patrick Frazee murder trial wraps, lawyer analyzes case

Nov 18, 2019

To dig deeper into how Kenney's involvement played a role in this case News 5 spoke with Stephen Longo, attorney & founder of the Longo Firm.

Longo said, "I think it's very difficult especially when it goes really against everything that they want to do as officers of the court and the oath they take to prosecute crimes against people facing charges...I think what they recognized in this case was that making that deal was the only way they were going to seal a conviction against Patrick Frazee."

Especially when a lot of the evidence was circumstantial.

"Whether it was high velocity blood splatter or jailhouse notes and when you're dealing with circumstantial evidence what you're trying to do is still really take a puzzle and piece it together so the jury can still see the big picture."

Another piece of the puzzle is where Berreth and Frazee's daughter, Kaylee, will end up.

"We forget about there's a really big human element involved."

Kaylee is currently in the temporary custody of Kelsey's parents, but Frazee's conviction giving them the upper hand, Longo believes, in getting permanent custody.

Patrick Frazee found guilty of murdering fiancee Kelsey Berreth, sentenced to life in prison
He was found guilty on a total of six counts: two counts of first-degree murder, one count of tampering with a body, and three counts of solicitation to commit murder.

Frazee received the maximum sentence: life without the possibility of parole, plus 156 years in prison. Sentencing occurred shortly after the verdict Monday afternoon. Prosecutors did not seek the death penalty against Frazee.

Patrick Frazee trial: Rancher gets life term plus 156 years in 'vicious, senseless' murder
[...]

Frazee’s mother, Sheila Frazee, walked straight to her SUV, staring through her windshield and pulling away without responding to requests for comment from a Gazette reporter at her driver's side window.

In the hallway after sentencing, Jennifer Viehman, one of three prosecutors, wiped tears as a crowd swirled around her.

The victim’s mother, Cheryl Berreth, phoned in to Frazee's sentencing, but opted not to speak. But in a searing letter to the court, she said Frazee’s crime robbed her family of a “devoted, caring mother,” and left the couple’s toddler daughter to “call out for mama in the middle of the night.”

[...]

Prosecutors opted in July not to pursue the death penalty against Frazee. On Monday, Cheryl Berreth said that while it would have been "well deserved," her family did not ask for it because they wanted Frazee to seek forgiveness, citing their religious beliefs.
