Patrick Frazee's defense makes case for appeal of his guilty conviction for the murder of his fiancée - KRDO

In their brief of appeal filed in March of 2021, Frazee's defense team brings up several issues with their client's murder trial and the prosecution's case. These issues include testimony from key law enforcement witnesses, the impartiality of three jurors, and evidence introduced during the middle of the trial.

Frazee's appellate defense team now requests that the judgment of conviction be reversed and the felony murder conviction is vacated.

In the Colorado Attorney General's response to Frazee's appeal, they request that the appellate courts affirm the convictions.

During Tuesday's Oral Arguments Hearing in the Colorado Court of Appeals in Denver, Frazee's defense and the Colorado AG's office had 15 minutes to present their cases.

Judges on the Court of Appeals division hearing the case are Stephanie Dunn, Matthew D. Grove, and Timothy J. Schutz. The three judges will not provide an opinion on the case immediately following Tuesday's hearing.

According to a spokesperson with the Colorado Judicial Department, it can take weeks or maybe months before an opinion on the appeal is rendered.

... The defense team claims there was juror misconduct in the original trial, adding the prosecutor’s key witness is not credible. Krystal Lee, the former mistress of Frazee, accepted a plea agreement for her role in cleaning up the crime scene and acted as the key witness. The defense also claims there wasn’t enough evidence in the case as Berreth’s body hasn’t been recovered.

Frazee's attorney claimed testimony from an expert witness should not have been admissible in court and that three jurors had engaged in juror misconduct for Frazee's jury trial.

After hearing the claims, the prosecution said there was "overwhelming evidence" that Frazee was guilty of killing Berreth.

"Few if any errors occurred" during Frazee's trial, prosecutors said, and any errors that did occur were "harmless."

Attorneys for Patrick Frazee make arguments to vacate conviction

In their appeal brief, attorneys for Frazee argued that three jurors discussed the case during his trial and formed opinions prior to deliberations. They also argued that when the court became aware, not enough was done to address the potential issues.

The defense also took issue with some of the evidence presented at trial, including the failure of the court to suppress statements Frazee made to a Department of Human Services worker while he was being held at the Teller County Jail.

His team alleged that prosecutors were repeatedly allowed to present "irrelevant, unfairly prejudicial bad character evidence."

Investigator hired by family of convicted killer Patrick Frazee claims his trial was 'skewed' - KRDO

Dan Corsentino, the former Pueblo County Sheriff and the director of DC Investigations & Security based out of Pueblo, says he was hired on by Patrick’s mother Sheila Frazee, to review her son's case. Corsentino told 13 Investigates that Frazee’s mother retained his investigative teams' services nearly two years ago for an undisclosed financial amount.

“At this point, his side of the story has not been told,” Corsentino said. “I think you'll find (Frazee’s story) to be very different than what the prosecution has convicted him on.”

“I can't get into where our investigation is with her, what our thoughts were in regards to the FBI, CBI,” Corsentino said. “I can tell you that she probably was the most uncredible individual in the case and for the prosecution to make her the cornerstone of their case. We believe that was not good judgment.”

Corsentino said he composed a team of former law enforcement professionals with more than 150 years of experience to review the case. The former Pueblo County sheriff said his team was tasked with reviewing around 25,000 pages of discovery, which included all of the interviews, statements, testimony, and evidentiary findings from the Frazee case.

Appellate Court rejects Patrick Frazee's appeal to guilty murder conviction | KRDO

On Dec. 29, the Colorado Appellate Courts reaffirmed the murder conviction for Patrick Frazee, the Teller County man found guilty of killing his fiancee in 2018.

These issues include testimony from key law enforcement witnesses, the impartiality of three jurors, and evidence introduced during the middle of the trial.

The Colorado Appellate Court affirmed the guilty conviction, however, the reasoning for their decision is unclear to the public.

The Colorado Appellate Court judges did not publish their opinions. According to the judges, the ruling did not require a published opinion because it did not meet the necessary standards per state law.

Nearly 600 people in Colorado have been missing for over a year

Families with missing loved ones gathered at the state capitol on Friday as lawmakers approved a resolution, officially recognizing Saturday, Feb. 4 as Missing Persons Day in Colorado.

Hartman runs Justice Takes Flight, a Lafayette, Colorado-based nonprofit made up of volunteers who try to help families find their missing loved ones.

For Hartman, the Berreth case was a big turning point in her life.

“From there, all of us decided that what we were doing was important and needed, so we decided to form a group. And that's when we applied for the nonprofit status,” said Hartman.

Hartman says the group’s name, Justice Takes Flight, was inspired by Berreth’s love of piloting.

Hartman and volunteers with Justice Takes Flight help families by making flyers and spreading the word about missing people on social media.

In some cases, they conduct searches themselves, with the help of their tracking dogs.

“As of this year, so far, we've helped seven cases,” said Hartman. “Last year, we had 37 cases that we helped, and we had two dogs that had their first find last year.”

“All the people that we've helped, it's because of her,” said Hartman. “In a way, she's being carried through our memories and our actions and she's touching a lot of lives.”
