Monday, Dec. 3rd:
*Motions Hearing (@ 9am MT) - CO - Dylan Nicholas Redwine (13) (Nov. 19, 2012, Broomfield; found June 27, 2013 & Nov. 1, 2015 his skull) - *Mark Allen Redwine (55), "father" indicted (6-20-17) of 2nd degree murder & child abuse resulting in death. Plead not guilty. $750K bond.
9/10/17 update: Def. Att. asked to ban media interview w/Mark while in jail pending trial & a motion of about how evidence was handled. Could face from 16 to 48 yrs in prison on either count. Judge set a hearing for 12/15/17 to review Def. Team's progress analyzing the 13,000 pgs of evidence. If the defense is prepared to move forward with the case at the Dec. 15 hearing, Wilson would likely schedule an arraignment, a hearing in which Redwine’s attorneys would enter his plea in the case.
12/14/17 update: The defense team for Redwine asked the court for more time to examine thousands of pages of police reports and other documents in the case that garnered nationwide attention. District Court Judge Jeffrey Wilson scheduled Redwine for a second status conference on April 13. 4/13/18: Judge denies motion for continuance. Next hearing on June 29th for Redwine to enter his plea. Next Motion hearings on 10/11, 10/12, pretrial conference hearing on 11/19, trial will start 11/26 and will run about 4 weeks.
10/6/18 Update: Court site has change Trial to Motions hearing on 11/26.
10/10/18 Update: Plead not guilty to all charges. All dates have been cancelled (10/11, 10/12, 11/19 & 11/26). More than 100 motions have been filed by Defense attorneys. Those are scheduled to be heard during a two-week motions hearing starting Dec. 3 (thru 12/14). Among the motions to be discussed, at least one will seek to move the trial to a community outside La Plata County, while others will seek to admit or suppress possible evidence. Trial has been set for 2/25/19.

10/25/18 Update: More than 400 motions, exhibits, rulings, proposed orders and judicial orders have been filed. More than half of those filings came from public defenders who opposed expanded media coverage, sought to limit certain types of evidence, wanted to move the trial to a different judicial jurisdiction, objected to certain witnesses and attempted to suppress statements made by their client. One motion seeks to dismiss the case “based on the prosecution’s unreasonable five-year delay in bringing charges,” according to a register of actions maintained by the 6th Judicial District Court. Motions that have not been addressed by the court will be heard during a two-week motions hearing scheduled to begin Dec. 3. Redwine’s four-week trial is scheduled to begin Feb. 25. If convicted, Redwine could spend 16 to 48 years in prison.

Thanks again for the info. I agree with sleuther that your posts are so helpful!! You are a true advocate for Dylan (and so many others).

When we hear of so much evil going on in the world these days, it is very reassuring to come to WS and be able to interact with so many good people who have a heart, such as yourself.

And as for Mark Redwine, I hope that sweet Dylan haunts him every time he tries to go to sleep.

Two-week motions hearing underway in Mark Redwine murder case


Chief District Court Judge Jeffrey Wilson began hearing from lawyers about the admissibility of evidence and statements made to police Monday morning, the beginning of what is expected to be two weeks of hearings on hundreds of motions made by the defense and prosecution.

Those motions span a range of topics, including whether certain statements or evidence should be suppressed, whether the trial should be moved to a different judicial district and whether the case should be dismissed outright based on the fact that it took five years for an indictment to be filed.

In the past two days, attorneys have examined and cross-examined law enforcement officers about how they obtained statements and evidence from Redwine over the course of the five-year investigation into his son’s disappearance and death.

The jury trial that was to take place in February for Mark Redwine, the Vallecito man charged with killing his 13-year-old son, Dylan, has been vacated and will be rescheduled at a later date, giving lawyers more time to prepare their cases.

Chief District Judge Jeffery Wilson said it could take weeks before he rules on the dozens of motions argued this week in the case against Redwine. Those motions include one to move the trial to a different judicial district and several seeking to suppress evidence.

Defense lawyers made a case in closed court Friday for why they think the trial should be moved to a different judicial district, likely arguing that significant media coverage and other factors make it impossible for their client to receive a fair trial in La Plata County. Lawyers can request what is called a “change of venue” if they believe a jury pool may be negatively influenced by pretrial publicity.

The evidence in dispute includes statements Redwine made to law enforcement; the findings of a cadaver dog trained to sniff human remains; and media coverage that included local, state, national and international stories about Dylan’s disappearance and murder, including a two-part episode on “Dr. Phil,” among other issues.

Wilson said he would rule at a later date whether jurors will be allowed to watch the “Dr. Phil” shows, in which Redwine, his ex-wife, Elaine Hatfield Hall, and their son, Cory Redwine, appeared on the show.

They can move his trial to Texas! We would be happy to bring Justice to Dylan.

I think this trial could be postponed several times before it actually goes to trial. Just look how long it took him to get a divorce from Elaine. He will pull every trick in the book to cause more pain to Elaine and Cory. I hope the Judge doesn't allow it to happen.
 
The American Justice system is a joke. So Elaine gets months and months more of pain as Mark continues to play the system and make her suffer which after all is his game here. It’s never been about Dylan it’s always been about poor old Mark.

Also if he is found guilty then his time served already will be knocked off his final sentence. So it better be a long stretch as he will have already served two years.
 
I am hoping the Judge will not allow it. Do we know if his attorney is court appointed?

It's scary, how much evidence is in dispute.

And DR PHIL---I would love the jury to watch Redwine's fine performance on Dr Phil.
