Dzhokhar Tsarnaev Trial Discussion *GUILTY* **Appeals court overturned death sentence, 2020** #2

Almost laughable if it weren't so sadly ironic. Media coverage prevented him from getting a fair trial, but media coverage and calls from a sitting Congresswoman, well, y'all know what she said, had no impact whatsoever on the fairness of Chauvin's trial? How's that work? Seems like our judicial system, blind/impartial as it's supposed to be, can't seem to do much these days but check which way the wind is blowing. AMOO
I'm really sorry that you're just now finding this out about our criminal justice system. Someone should've told you sooner that its a clusterfuck. Gonna blow your mind when you start hearing about pedophiles getting 2 yrs and a pot dealer getting 20 yrs. Personally don't give a crap about Chauvin, but the fact that you feel the need to compare the two cases, says that you do. Sorry buddy, guy screwed up bad on camera and has a history. if you have to back the blue as a matter of principle, at least go for something less shady or more likely unjust like Amber Guyger.

High court reimposes Boston Marathon bomber's death... | Daily Mail Online

"The Supreme Court voted 6-3 to reinstated the death sentence for convicted Boston Marathon bomber Dzhokhar Tsarnaev, rejecting claims that his jury should been told about his accomplice brother's influence on him.

Voting along conservative-liberal lines on Friday, the court agreed with the Biden administration's arguments that a federal appeals court was wrong to throw out the sentence of death a jury imposed on Tsarnaev, 28, for his role in the bombing that killed three people near the finish line of the marathon in 2013."

When <modsnip>Boston folks want the death penalty for a criminal, I gotta say, the guy deserves it.

Boston Marathon bomber Dzhokhar Tsarnaev’s attorney urged a federal appeals court Tuesday to throw out the 29-year-old’s death sentence because of juror misconduct claims just months after it was revived by the nation’s highest court.

Tsarnaev is making a renewed push to avoid execution after the Supreme Court last year reinstated the death sentence imposed on him for his role in the bombing that killed three people and injured hundreds near the finish line of the marathon in 2013.

His lawyers are now challenging issues that weren’t considered by the Supreme Court, including whether the trial judge wrongly denied his challenge of two jurors who defense attorneys say lied during jury selection questioning.

The Boston-based 1st U.S. Circuit Court of Appeals did not throw out Tsarnaev’s death sentence. Defense lawyers had pushed for that while claiming bias by two people who sat on the jury that convicted him for his role in the bombing that killed three people and injured hundreds near the marathon’s finish line in 2013.

But the appeals court found that the trial judge did not adequately probe Tsarnaev’s claims of juror bias, and sent the case back to the judge for a new investigation. If the judge finds that either person should have been disqualified, he should vacate Tsarnaev’s death sentence and hold a new penalty-phase trial to determine whether Tsarnaev should be sentenced to death, the appeals court said.

“And even then, we once again emphasize that the only question in any such proceeding will be whether Tsarnaev will face execution; regardless of the outcome, he will spend the rest of his life in prison,” a three-judge panel of the appeals court said.
