Judge says John Goodman deserve new trial

WEST PALM BEACH, Fla. -- Wealthy Wellington resident and polo tycoon John Goodman has won a new trial, and it could be held before the end of this year.

In an 11-page ruling, Circuit Judge Jeffrey Colbath says Goodman juror Dennis DeMartin was not truthful during jury selection and as a result, Goodman was denied a fair trial.

Had DeMartin brought up the fact that his ex-wife had a DUI arrest, he would not have been chosen as a juror.

WEST PALM BEACH, Fla. —Wellington millionaire John Goodman will get a new trial, WPBF 25 News has learned.

The polo mogul was convicted of DUI manslaughter last year in the 2010 death of 23-year-old Scott Wilson.

A juror was accused of misconduct and this week was questioned by attorneys and the judge in the case.

Judge Jeffrey Colbath ruled just before 5 p.m. Friday that Goodman will get a new trial. Goodman has been serving his 16-year sentence on house arrest as the appeals process has played out.

A date for the new trial has not been set.

A Palm Beach County Circuit judge has ordered a new trial for polo mogul John Goodman, who was convicted of DUI manslaughter last year.

The judge made the decision based on problems with trial juror Dennis DeMartin, who at a hearing on Monday emphatically denied lying his way onto the jury for the Wellington polo mogul's DUI manslaughter trial last year.

This just makes me sick and sad. I feel so sorry for the parents of the victim Mr. Wilson.

And now the DT are asking that Judge Colbath allow the killer to remain on house arrest. They promise to call him if they haven't heard from Goodman in a week. Really!? That's nuts IMO.

I also read that attorney Roy Black was no longer on his DT.a

WEST PALM BEACH, Fla. —Polo mogul John Goodman will remain on house arrest, but his bail will be reduced.
Judge Jeffrey Colbath issued the ruling Wednesday as the International Polo Club Palm Beach founder awaits a new trial.

During a hearing last week, Goodman's attorney asked that his client's bond be reinstated to the same release conditions he had before his DUI manslaughter conviction last year. However, the assistant state attorney argued that Goodman was a flight risk because of his wealth.

John Goodman's new attorneys may want the polo mogul's new trial moved out of Palm Beach County because of extraordinary publicity in the case, according to a request filed Wednesday.

Palm Beach County Circuit Judge Jeffrey Colbath twice last year denied Goodman's former attorneys their desire to move his trial to Miami due to an intense media focus on the DUI manslaughter prosecution.

But Colbath on May 3 granted Goodman, 49, a new trial because of juror misconduct, wiping out his conviction and 16-year prison sentence.

Goodman attorneys Roy Black and Mark A.J. Shapiro then left the team, and attorneys Douglas Duncan and Scott Richardson took the reins.

In their new motion, the defense asked Colbath to cancel a planned Monday conference on trial scheduling, citing that they need "sufficient, reasonable time to investigate and prepare Mr. Goodman's case for trial." They said they would not request a November trial as originally planned.

The attorneys asked for a September court date to review the status of trial preparations and reveal at that time whether Goodman will again seek a change of venue.

I guess Mr. Black doesn't want to lose the case again. John Goodman will be convicted again! Juror misconduct, resulting in a new trial, won't change any of the evidence in this case!
 
Agreed, Isabelle! And wealth can be a wonderful thing, or so I've been told.

So okay, he gets a new trial -- the evidence is still there, etc., etc., but the spitfire prosecutor has retired -- that's a big blow for the State's case, however. Oooh, she was so sharp & missed nothing, but she was all above-board and not sneaky or underhanded in any way. She will be missed.

I'll believe it when I see it (I hope it will be streamed again...), but at least we've got a date. OTOH, I can't hardly see them delaying it any longer. It's been a long, long, time, as the song goes. Justice has been delayed too long.

Will he and his Big Bucks slide out of it this time? He really does need to spend some time in prison, IMO. He was drunk, IMO, and he hit & killed another human being.

We had a somewhat similar case here in NC a couple of years ago. The guy blew a .19, was found to be going between 85 -- 100 mph, did not try to stop, and got a scratch on his wrist & a redness on his forehead -- not even a Band-aid. His car struck a young woman's car from behind & shoved the trunk into the backseat of her car. She never regained consciousness, of course, & died about 40 minutes after the crash [ETA:] at the regional Trauma unit. She was a talented & aspiring ballerina and she was 20 years old. [end ETA.]

He got 3--5 yrs for Felony Death by Vehicle (the jury didn't go for M2), & was out on work release during the days and monthly weekend stays at home during his last 9--12 months of incarceration. Not a bad deal, IMO. The victim is still deceased.
