Grandmother of 10-year-old found stuffed in trash can suing DFCS
Emani's grandmother Robin Moss has filed suit against the state Department of Family and Children's Services. The lawsuit says that caseworkers were aware of deteriorating conditions in the home, and could have stepped in sooner, possibly saving Emani's life.

According to the lawsuit, four months prior to Emani's death, in August 2013, the Department of Family and Children's Services received an anonymous call that said Emani was being neglected by her father and stepmother and "that she appeared to be thin."

The lawsuit said that DFCS did not follow up on the call, and "screened the call out 'due to having no current address and no current maltreatment.'"

In order to avoid the death penalty, Eman Moss accepted a plea deal, pleading guilty to two counts of felony murder, two counts of first-degree child cruelty and one felony count of concealing a death. Investigators said at the time that while he helped to dispose of his daughter's body, he was likely not the main culprit in Emani's death.

Meanwhile, Emani's stepmother Tiffany Moss is expected to go to trial later this month in Gwinnett County Superior Court and faces the death penalty. She insists on representing herself in the case.

A different article I read said that the trial has been delayed. The state Supreme Court is reviewing the judge’s decision to allow Tiffany Moss to represent herself.

"She’s produced no list of witnesses she plans to call at trial. She has yet to look over the boxes of discovery turned over to her by the state. She brings no documents, not even a legal pad, with her into the courtroom.

Yet on Monday, Tiffany Moss will represent herself as Gwinnett County prosecutors seek the death penalty against her....

Moss has said she is leaving her fate in God’s hands, rather than the two experienced public defenders who were initially assigned to represent her. They work for the state’s capital defender office, which is credited as a primary reason no one has received a death sentence in Georgia in more than five years....

“It looks like a prolonged suicide,” said Atlanta attorney Jack Martin, who has defended a number of capital cases. “God may be an all-powerful and merciful force in nature, but he’s a lousy criminal defense lawyer.”

During a pretrial hearing last Monday, Moss, 35, told Chief Superior Court Judge George Hutchinson III she was ready for her upcoming trial.....

During Monday’s hearing, District Attorney Danny Porter said he’s offered Moss the same plea agreement he offered her husband. If she pleads guilty to Emani’s murder, Porter will withdraw the death penalty and allow her to be sentenced to life without parole. But that offer stands only until a jury is selected, expected sometime this week, he said...."

"After a week and a day of grueling, though often repetitive, questions asked during jury selection in the Tiffany Moss death penalty case, the court has reached the required number of qualified jurors to begin the process of selecting the final jury.

Shortly after 4:30 p.m. on Monday, Gwinnett County Superior Court Judge George Hutchinson announced the court had reached its 54th qualified juror, a determination made through a series of questions asked by the judge, prosecution -- District Attorney Danny Porter and Assistant District Attorney Lisa Jones -- and Tiffany Moss, who is defending herself in the trial.

The 56 total qualified jurors -- the court continued interviewing potential jurors until after 5 p.m. on Monday -- come from a pool of more than 100 potential jurors who the court began questioning last Monday....

Once the final jury and its alternates are selected, the court will recess until Wednesday, when opening arguments will begin, Hutchinson said. It's not exactly clear how long the actual trial will last."

BREAKING: Lawyers seek to intervene as woman facing death penalty mounts no defense

"They have watched their former client sit silent throughout her death-penalty trial this week, doing nothing as she acts as her own lawyer. Now two capital public defenders are trying to take the case away from her if and when the jury decides whether she should be sentenced to death.

In a motion filed Thursday, defenders Brad Gardner and Emily Gilbert acknowledged that the right to self-representation is permitted during the guilt-innocence phase of a trial. But it doesn’t extend to the sentencing phase of a death-penalty trial, they said.

Their motion asks Gwinnett County Superior Court Judge George Hutchinson to reappoint them as Tiffany Moss’s lawyers if the jury finds her guilty. That way, they could represent her when the jury considers evidence and hears testimony in the penalty phase of the trial, expected next week...."

"...11Alive News has obtained a motion which says Moss had “neuropsychological testing data that showed the defendant to have damage to the premotor and prefrontal regions of the brain.”

Moss faces six counts of murder and concealing the death of her stepdaughter in Gwinnett County, plus two counts of felony murder and first-degree cruelty to children.

We reached out to the Director of the Brain Research Laboratory at Emory University, Dr. Don Stein. He’s a national expert in brain injury and repair and has written more than 400 papers on the subject. Dr. Stein has not examined Moss, but explained what damage to the premotor and prefrontal regions of the brain can mean....

“Frontal lobe syndrome, and that is kind of what we’re talking about here, can lead to the loss of executive function and impulse control.”

The actual results of the neuropsychological testing done on Moss are sealed, but it does call into question what many prospective jurors have been wondering during the trial: Is Moss fit to represent herself?..."

This is horrific. I'm listening to the father's testimony, and he keeps saying "the spanking incident" when referring to the 2010 beating of Emani.

He said he worked one job from 630am to 330pm. He'd leave around 5am, return at 430pm. Then leave at 530pm and get home at 1-130am from the second job. He started the second job before they got the first apartment. He had the weekends off. Tiffany went out with her friends and family on the weekend.

He was a total failure to that child. His mother kept asking for the child. She was thin, and she was acting out -- according to Tiffany. So why wouldn't he send her to his mother? His pride, he claims.
 
What is this about Emani and feces all over the place? At first, I thought it was a lie. Now I'm thinking Tiffany decided to deal with Emani's bowel issue by NOT feeding her anymore.
