While bond has been lowered in Madison County, she still faces $1 million bail on the Fremont County charges.

Mallard decided to decrease bond to $50,000 on each charge totaling $150,000. She noted that Daybell would still need to post $1 million in Fremont County to get out of jail.

The judge said if Daybell is able to post bond, she can have no contact with her husband Chad Daybell.

A jury trial on the three charges was scheduled for Jan. 25-29, 2021. A preliminary hearing on the Fremont County charges is set for Aug. 10 and 11.

NEW BOND AMOUNT: Judge Michelle Mallard rules that Lori Vallow’s new total bond amount in Madison County is $150K. That’s 50K for each of the three misdemeanor charges against her (resisting/obstructing officers, solicitation to commit a crime and contempt of court). Vallow’s attorney Mark Means asked for around $100K on the bond while prosecutor Rob Wood said it should be no lower than $250K.

Remember, the $1M bond in Fremont County for two charges of conspiracy to conceal, destroy or alter evidence still stands. Means argued that his client had been a model inmate with no criminal history.

The jury trial for the Madison County case is set for January 25-29, 2021. Vallow still has a preliminary hearing in Fremont County related to conspiracy charges on August 10-11 next month.

BOUDREAUX CASE: Maricopa Co. judge rules Melani Pawlowski’s (Lori Vallow’s niece) motion to hold ex-husband Brandon Boudreaux in contempt is denied. Court says BB showed persuasive evidence that “controverts” MP’s testimony she had nothing to do w/ attempted murder of Boudreaux.

Pawlowski’s initial motion accused Boudreaux of giving misleading & false statements to the court. Boudreaux said Pawlowski was hiding from law enforcement after an attempt was made on his life (10/2/19).

Based on circumstances the court does not find it unreasonable for Boudreaux to believe Pawlowski was hiding from LE.

Court also states Pawlowski never provided Boudreaux with her new address when she abruptly moved from Arizona to Idaho in late October or early November. Her new husband (Ian Pawlowski) noted she did not want him to share her full name with anyone in fear of Boudreaux locating her. Boudreaux was trying to serve her a motion for temporary orders.

Court says evidence showed service was effective and Pawlowski knew about 12/11/19 hearing that she did not show up for. This led to Boudreaux getting sole-legal decision making authority for their four children.

What does this all mean? The Court just ruled in favor of Boudreaux in regards to allegations of making false statements in this case.

The shooting and attempted murder of Boudreaux is still being investigated by Gilbert Police. Alex Cox, Pawlowski’s uncle is believed to be the shooter according to Boudreaux but he died on 12/12/19.

The prosecutor is worried cameras will make it more difficult to pick a fair jury.

“The public and press constitutionally have a right to be there, but they have under American common law no right to see a live broadcast,” said Idaho State University Media Law Professor Zac Gershberg. “That is at the discretion of the judge.”

“I think if they’re going to severely limit the number people present during Coronavirus, then constitutionally they should make the stream available,” Gershberg said. “If the judge agrees (with the motion) and locks out the courtroom and doesn’t provide the stream, then we’re talking about something that would likely go to the Supreme Court of the United States.”

MOTION TO RECONSIDER: Special Prosecutor Rob Wood asks the Court to not allow video coverage of Lori Vallow’s prelim hearing in Fremont Co. for conspiracy charges. Wood says broadcast/live stream makes it more difficult to pick an unbiased jury.

This is not a motion to close/seal the hearing. Wood says audio & transcript would be available so news organizations can still report on the prelim if State grants the motion. “The whole state of Idaho has been inundated with media coverage regarding the children (JJ Vallow/Tylee Ryan).”

Wood points to the challenge of jury selection w/ increased media coverage “harming a defendant’s rights to a fair trial.” The prelim is set for 8/10-8/11 & Court TV is currently approved to broadcast the hearing.

Prosecutors are requesting #LoriVallow/#Daybell’s preliminary hearing NOT be live streamed saying it could taint a jury pool. They say pictures are fine, audio & transcripts would be available. Hearing- on conspiracy charges- is currently scheduled for Aug. 10-11.

In the Lori and Chad Daybell cases, a motion hearing is now scheduled to hear argument from Rob Wood about having no video cameras for the preliminary hearing set for August. Last week Wood asked Judge Faren Eddins to change his order governing courtroom conduct.
 
The court has granted permission to Post Register to photograph (not video/audio record or broadcast) LVD's preliminary hearing on August 10th/11th; and JP has responded to the prosecutor's motion (for court's reconsideration regarding video coverage of CD's preliminary hearing on August 3rd and 4th), with no objection to court's decision to allow video coverage:-

Without video cameras, and based on the rules in place by the Idaho Supreme Court, there is no way for the public or media to observe the Daybell hearing if Wood’s motion is approved.

On Friday, EastIdahoNews.com jointly hired Idaho Falls attorney Steve Wright to object to the motion. Other media outlets participating include the Post Register, KIFI Local News 8, KPVI NewsChannel 6, The Idaho Statesman, KIVI Idaho News 6, KSL TV 5, Court TV and NBC News.
