Still Missing KY - Crystal Rogers, 35, Bluegrass Parkway, 3 July 2015 #4 *arrest in 2023*

April 19, 2024

LOUISVILLE, Ky. (WAVE) - One of the men charged in the Crystal Rogers murder case is now pushing to get his trial separated from the other two.

An attorney for Joseph Lawson filed a motion to sever Friday.

Joseph Lawson is accused of helping Brooks Houck carry out the murder of Crystal Rogers and then helping him cover it up. His father Steve Lawson is facing the same charges

But in this new severance motion filed, Joseph Lawson’s attorney is saying they don’t want these trials lumped together. They want Lawson to be tried independently.

The main reason Lawson’s attorney is pushing for this is because they’re worried that the other two defendants may try to point the finger at Joseph Lawson for certain aspects of this crime in out-of-court confessions.

Is BH's brother still a POI?

Does anyone have any thoughts on whether the state has more evidence other than the word of the Lawson's?

Are they all charged with identical charges? TIA
Here are the charges for the three:
  • Brooks Houck is charged with murder and tampering with physical evidence, in connection to the death of his girlfriend Crystal Rogers. Steve Lawson and Joseph Lawson are also charged in the case -- accused of conspiracy to commit murder and tampering with physical evidence.

About NH:

When asked by the judge if prosecution was investigating any other cases that may be linked to Crystal's case, special prosecutor Shane Young revealed new details about the Tommy Ballard case. A gun supposedly involved in the murder of Crystal's dad was allegedly purchased by NH.

I have donned and adjusted my little tin foil hat so I can share my theory - and remember, I could be totally nuts and hopefully don't get banned for it, but here goes - I think NH was up to something nefarious way back - drugs, firearms, who knows. I think Officer Ellis found out or suspected and had be to taken out of the picture - remember he was not driving his vehicle that night and his canine was not with him, someone had put tree branches in the road to make him stop. Who would have known what vehicle he was driving?? Regarding the Netherlands, I think the daughter saw something at school or after school and confided in her mother. I think her mother called the police on her behalf and said they needed to speak to someone. The person that killed them came to the front door - which they very seldom used. Who is going to come to the front door?? Mom was shot basically in the doorway and the daughter was shot fleeing thru the house. Crystal and her daughters - were they becoming a problem to BH? threatening to leave and take the little boy? After all, BH was only interested in the son - not the other kids that were not his. NH says - theoretically - no problem bro, i can help you out! Small town, good family - Tommy is yelling long and loud about his daughter and so he has to go as well. someone heard the car leave very shortly after the shot was fired, so sounds like two people in the car. Disclaimer - most of my thought processes come from the miniseries about Crystal and could be completely erroneous. But in my opinion, NH has been in this up to his eyeballs since day one. Apologies in advance if I stepped on anyone's toes.

Just got off the phone with Steve Lawson's attorney Ted Lavit. He told me the attorneys and prosecutor on the case met this week and agreed to move the trial to Christian County, KY- about two hours from Bardstown. They will now give this suggestion to the judge, who will make the final decision.

I don't know about the Netherlands but I once did a post on some subReddit that makes this basic argument: Ellis and Tommy are linked by the way they were murdered; BH wanted Crystal out of the way. The Netherlands were killed by someone who had killed before and liked killing, but I don't know who.

The case reminds me of the plot of Shakespeare's Macbeth. Once Macbeth commits the first crime, a murder, he has to do more and more to feel safe. That's these guys.

I don't think the Netherlands case is related to this one so can it have its own thread

3/15/24 Update: Defendant Gouck's response in objection to Commonwealth's Motion to Consolidate filed by Brian Butler, Michael M. Denbow & Jennifer Henry Jackson. Link see post #467, page 24, Thread #4). Houck's attorney claim the prosecution has little hard evidence including "no crime scene, murder weapon or realistic motive." They are fighting back against the prosecutor's request to combine all three trials, claiming that would result in prejudice against Houck. The documents claim both Joseph & Steve Lawson were subject to a “biased investigation” using “coercive interrogation tactics", with the goal of building a case against Brooks Houck. Status hearing & motions hearing to consolidate the trials & defense’s motion for change of venue (to Boyd or Deviess County) on 3/21/24.
3/21/24 Update: Discovery has been completed by prosecutors. Prosecutor Young clarifies there was 276GB of remaining evidence turned over, not a terabyte as he mentioned during the last hearing. Two interviews are missing, however, which will be turned over in the next two to three months, he said. He also agrees with the defense that the trial should be moved out of Nelson County. Young said attorneys should have a location chosen within a month. The ruling of combining trials will come later as Young plans to respond to Butler's motion not to combine the trial 7 each suspect plans to file a response to that. Prosecutor asked for time to response to motion for immunity from Steve Lawson's defense attorney Theo Lavit. Lavit said they will need to being in witnesses & play audio & there "may" be the need for another hearing to discuss evidence about promised immunity in Steven Lawson's motion to dismiss charges. Hearing set on 6/13/24 @ 9am on pending motions. While Prosecutor Shane Young has pushed for all three defendants to be tried together, arguing that the charges rely on many of the same key details, all three defense attorneys have requested separate trials. Both sides will be given additional time to lay out their arguments in writing before a 6/13/24 motions hearing scheduled to address the issue. Another hearing has been scheduled for 5/1/24 @ 1pm to review if attorneys have chosen the new venue for trial. If not, the Judge will decide where to change it to.
4/19/24 Update: An attorney for Joseph Lawson filed a motion to sever on Friday. “A joint trial would prejudice Mr. Lawson because his codefendant’s out-of-court statement against him would deny him his right to cross-examination & would deny him his fight to present a defense,” the motion reads. It goes on to say that a joint trial “risks that the jury will be unable to make an individualized determination as to culpability for each defendant.” What this argument boils down to is Joseph Lawson wants to be able to defend himself in court, and if the government lumps these trials together, it might be difficult to do that.
4/25/24 Update: The attorneys & prosecutor on the case met this week ^ agreed to move the trial to Christian County, KY- about two hours from Bardstown. They will now give this suggestion to the judge, who will make the final decision.
