Judge Guy Bradberry granted a change of venue for Kevin Daigle due to extensive publicity, but only for jury selection.

Daigle is charged with the first-degree murder of State Trooper Steven Vincent and the second-degree murder of Blake Brewer, but the cases will be severed - or tried separately. The Vincent first-degree murder trial will be first.

The jury will be picked in Benton La., which is in Bossier Parish - the 26th Judicial District - and then brought to Calcasieu Parish for the evidence part of the trial.

A jury questionnaire for the capital murder trial of Kevin Daigle, 55, was finalized Monday in state district court.

Daigle, charged with the Aug. 2015 first-degree murder of state trooper Steven Vincent, 44, near Bell City, is set to go on trial March 13, 2017. Prosecutors are expected to seek the death penalty against him.


Jurors will be chosen in Bossier City and brought to Lake Charles for the trial. The change of venue for jury selection had been granted on July 11.

A new trial date for the man accused of fatally shooting a state trooper in 2015 will not be set until after a May hearing.

Kevin Daigle, 55, charged with the August 2015 murder of Steven Vincent, 44, near Bell City, was originally set to go on trial March 13 in state district court with jurors brought in from Bossier City. But on Feb. 7, Judge Guy Bradberry granted a defense motion for a continuance due to the cancer diagnosis of attorney David Price of the Baton Rouge Capital Conflict Office, who sat as first chair for the defense. Bradberry did not set at new trial date at that time.

On Wednesday, Bradberry reset Daigle’s trial to Sept. 18. But he told attorneys that the court would still need to check with officials in Benton on the compatibility of that date. Jurors are to be selected from Bossier Parish and be brought to Lake Charles for the trial.

A hearing on “Jackson” evidence — prior bad acts or violent criminal behavior that is introduced at the penalty phase of a capital case — was set to begin on Wednesday. But the hearing was reset for June 14 — the day Bradberry will issue his ruling on the prosecution’s motion for Daigle to undergo an independent medical exam.

According to testimony in a pre-trial hearing, Kevin Daigle has said he wanted to kill a cop.

Daigle is charged in connection with the killing of State Trooper Steven Vincent in 2015, who died after being shot with a sawed-off shotgun.

Daigle was in court for a hearing to decide which information jurors will get to hear during the trial.

The state wants to use evidence of Daigle's past crimes and bad acts when he goes on trial. For example, a former girlfriend testified he said numerous times he hated cops and that if he ever had the chance he would kill one. She testified Daigle didn't let go of grudges and that he had a "hit list."

Daigle's defense team asked for the continuance after his lead attorney, David Price, died on July 27. Daigle is set for trial on Sept. 18.

"As this Court has said from the start of this trial, justice delayed is justice denied," Judge Guy Bradberry wrote. "Both the Defendant and the community deserve a resolution to this matter. Therefore, the September 18, 2017, trial date will not be continued."

"I don't have another lawyer to help me with the case and we are supposed to have two lawyers in a capital case for a very good reason. It's an enormous undertaking, that really is not possible to be done with one lawyer," she said.

Also, Romanach says Daigle is willing to plead guilty and spend life in prison if the state will take the death penalty off the table.

But Bryant says-- no deal:

"His criminal history is lengthy. number two, he killed not one but two people and he was on his way to kill a third. so that day, he killed his roommate, he killed trooper Vincent and then he was on his way to shoot his son as he said in his interview. so, he is a terrible individual who deserves to face capital punishment. It's up to the jury whether to impose it or not," said Bryant.

Kevin Daigle's Sept. 18 trial date has been pushed off until April 30, 2018. Judge Guy Bradberry granted the continuance on Thursday afternoon.

That was after it became clear the defense is not ready to move forward - and doesn't have the two attorneys required in a death penalty case.

Defense attorneys for Kevin Daigle were in state court on Friday asking for his trial to be delayed again and that the judge choose a different place to pick a jury.

The judge denied the request to move the venue or delay the trial again, telling attorneys, "There is no perfect time."

On January 8, at 1:30 p.m.,Judge Bradberry is to rule whether testimony from Daigle's daughter, about him allegedly molesting her, will be allowed in the penalty phase of his trial. Again, the trial is set for April 30, 2018.

The defense attorneys say Bradberry and Vincent's wife have known each other for many years, are Facebook friends and that he has "liked" pages supporting the slain troopers family.

Defense attorneys say she's believed to have worked in the juvenile justice system and would have likely had regular contact with Bradberry.

However, prosecutor Cynthia Killingsworth says it's a tactic to delay the trial.

"They really don't have a basis for it. They're grasping at straws. I really think it is a tactic to get a later date for trial," she said.

Judge Guy Bradberry will remain on the Kevin Daigle capital murder case unless an appeals court says otherwise.

"To remove a judge is a major undertaking. You have to show bias or prejudice to remove him. The only thing that they could show was that Katherine Vincent worked in the juvenile court system, and that Judge Bradberry was on the bench and that she was in the courtroom handling some cases with juveniles over the years," said Bryant.
 
Judge Bradberry recused from Daigle trial

The supreme court finds that while there has been no allegation or showing that Judge Bradberry harbors any actual bias, the circumstances require recusal as a constitutional safeguard against the risk of bias.

Lead prosecutor Rick Bryant says the Supreme Court ruling may mean a major delay in the case going to trial.

"The new motions obviously will be heard by a different judge and I"m sure defense will try to re-litigate this entire case. They've been successful in pulling this thing along for three years, maybe they're going to try to get three more years, who knows," said Bryant.

Judge Clayton Davis on Tuesday was named as the judge who will oversee the upcoming trial of Kevin Daigle.

The state Supreme Court, in a decision handed down Monday, removed Judge Guy Bradberry from the case.

Defense attorneys for Daigle have several other motions pending, including the change of venue motion, which had also been scheduled to be heard just before jury selection began but none of those motions have been heard.

Jury selection is still set to take place at a future date in Benton in Bossier Parish. Once a jury is selected, jurors will be brought here for trial.
 
Daigle trial moved to Lafayette
Judge Clayton Davis has granted a full change of venue for the trial. The jury will also be picked in Lafayette.

Daigle's jury was to be picked in Bossier Parish and brought back to Calcasieu for the rest of the trial. But the new judge--Davis-- has ordered the whole trial-- from start to finish, in Lafayette as requested by the defense. If Daigle is convicted of first-degree murder of Vincent, the state will seek the death penalty.
 
Davis moved the case to Lafayette and has set a trial date for July 1 of 2019 and ordered pretrial motions be filed by April 16. Davis is expected to conduct the trial.

In the Daigle case, Judge Davis has also ordered that jurors will be addressed only by juror number unless otherwise permitted by the court.
