The decision from San Diego Superior Court Judge David Danielsen came during a 5-minute status hearing for John Albert Gardner III, who is charged with murder along with a special circumstance allegations that it happened during the rape or attempted rape of Chelsea. Gardner spoke only once during the hearing, to acknowledge that he waived his right to speedy proceedings.

In a separate issue, his defense attorneys did not fight a legal request by the Union-Tribune and KGTV, the ABC affiliate in San Diego, to unseal a probation report in a 2000 case in which Gardner admitted molesting a 13-year-old neighbor in a violent attack in his parents Rancho Bernardo home.

The report, given to the judge prior to Gardner's sentencing in that matter, includes an interview with Gardner. The probation officer reported that Gardner maintained his innocence, and only took the plea to avoid getting "reamed" at trial. He reportedly denied beating the victim, blaming the child's wounds on her mother. Traditionally, probation reports are sealed. But if a person is charged with a subsequent crime, the law allows for it to be unsealed, Judge Danielsen said Monday in agreeing to unseal the report. Gardner's recent arrest has fueled interest in the previous case.

Probation report cites predatory traits of suspect

A decade-old probation report on a sex offender accused of murdering California teenager Chelsea King contained a psychiatrist's conclusion that the defendant had "significant predatory traits" toward underage girls and should be kept in prison for as long as possible. "The defendant does not suffer from a psychotic disorder," a probation officer quoted Dr. Matthew F. Carroll as saying for the report. "He is simply a bad guy who is inordinately interested in young girls." Carroll further said John Albert Gardner III's "predilection toward younger girls is a problem. He manifests significant predatory traits and is a danger to the community," the officer wrote.

The report says Gardner moved to five different cities through his childhood and recounts the breakup of his parents when he was 5. It also details his work in construction, as a lifeguard, ride operator for four months at a Santa's Village theme park, and at a fast-food restaurant and sporting goods store. The report also noted that the psychiatrist was disturbed by a trespassing incident in which Gardner had been hanging around a high school, as well as a statement by Gardner that a purported fiancee had an abortion because she was afraid she couldn't raise the child by herself. "This statement seems very odd to Dr. Carroll," the report said. "He finds pervasive oddness in this case." A defense sentencing memorandum dismissed the mention of the high school incident, saying Gardner was a student there at the time, it was after hours and no charges were filed.

Meanwhile, California Gov. Arnold Schwarzenegger ordered authorities to retain all parole records on sex offenders after learning the files of Gardner had been destroyed last fall, just a year after he had completed three years of parole supervision. The Department of Corrections and Rehabilitation disclosed the documents had been destroyed in a response Friday to a records request by The Associated Press. Department spokesman Oscar Hidalgo said 10,000 ex-convicts each month are placed on parole or released from parole. The system would be overwhelmed by paper records if it didn't shred them quickly, he said.

He also said portions of Gardner's parole records were transferred to his central file, which is kept for 30 years. Officials were reviewing what they can release, considering legal privacy restrictions and the judge's gag order.

Assemblyman vows to strengthen predator laws

The state assemblyman who represents the neighborhoods where Chelsea King lived and died has already begun working with family members of the 17-year-old murder victim to toughen sexual-predator laws. Nathan Fletcher, who was elected to office little more than a year ago, offered no details about what his proposed &#8220;Chelsea&#8217;s Law&#8221; would regulate. But he certainly drew an audience. No fewer than eight television news cameras crowded into the reception area of his Mira Mesa office earlier today to hear his announcement that he and Chelsea&#8217;s family are dedicated to better protecting California families from sex offenders. &#8220;The goal is very simple: to make sure that no family has to go through what the King family and the Dubois family are going through right now,&#8221; Fletcher said.

Dorian read a brief statement from Chelsea&#8217;s parents but took no questions. &#8220;Chelsea has given us the opportunity to make the kind of changes that will save precious young lives like hers,&#8221; Dorian said, quoting Brent and Kelly King. &#8220;We do not yet know when or how these efforts will take shape but our commitment to to carry her light forward is steadfast. We have decided to collaborate with Assemblyman Fletcher on these yet undefined initiatives.&#8221;

Fletcher said he has approached Amber&#8217;s family about joining the effort, which so far amounts to a working group including Sheriff William Gore, District Attorney Bonnie Dumanis, crime victims and regular citizens. &#8220;Everything is on the table,&#8221; he said. &#8220;We will look at every aspect of how our state deals with sexually violent predators.&#8221;

Fletcher already has targeted a policy adopted by the California Department of Corrections and Rehabilitation that allows field notes of convicts who successfully complete parole to be destroyed. State prison officials conceded earlier this week they routinely burn or shred such files one year after parole terms are served, although they save notes they consider important in a centralized record. &#8220;From what I&#8217;ve seen in the year and a half I&#8217;ve been in the Legislature, (the Department of Corrections and Rehabilitation) is a fairly inefficient, unresponsive agency,&#8221; Fletcher said. &#8220;Corrections needs to do a much better job.&#8221; Prison officials said Monday they are reviewing their records-retention policy.

Governor: Retain parole records on sex offenders

SACRAMENTO, Calif. - Gov. Arnold Schwarzenegger on Tuesday ordered California corrections officials to keep sex offenders' parole records indefinitely after he learned the files of a man now charged with killing a 17-year-old girl had been destroyed.

The Department of Corrections and Rehabilitation disclosed the documents on John Albert Gardner III had been destroyed in a response Friday to a records request by The Associated Press.

Gardner pleaded guilty in 2000 to committing lewd and lascivious acts on a 13-year-old girl. Officials said his parole file was destroyed last fall, just a year after he completed three years of parole supervision.

Schwarzenegger called the practice unacceptable. He also told the department to make as much information available to the public as legally possible.

Court documents released to the public on Tuesday are offering a look into John Gardner's molesting conviction in 2000. The probation report from 2000 was released Tuesday after legal wrangling ended on the issue, which was raised Monday in court. Gardner was convicted in 2000 of molesting and beating a 13-year-old neighbor girl after luring her to his house. He served five years of a six-year sentence, though his plea agreement allowed for nearly 11 years and a court-appointed psychiatrist urged "the maximum sentence allowed by law."

The psychiatrist also said Gardner showed no remorse for the crime and denied any responsibility for it as well, making him an "extremely poor candidate for any sexual offender treatment." In the end, the doctor called for the maximum possible sentence.

On Monday, one of Gardner's public defenders, Mel Epley, requested a stay or the release pending an appeal, which Danielson granted until Tuesday at 9 a.m., when he could review a written request. When none was forthcoming, the records were released.

John Albert Gardner III made a brief but important court appearance Tuesday in connection with the murder and possible rape of Chelsea King.

Seated in the custody box, behind a sheet of white paper, Gardner was not visible for most of the hearing. When he did stand to address the judge, Gardner looked at the bench and said "yes" twice in response to questions. His eyes appeared heavier than they did at his arraignment with dark, puffy circles under his eyes. When he returned to his seat, his eyes looked into the gallery but it's unclear where he was looking or who he was looking at.

Gardner's attorneys, Mel Epley and Michael Popkins, asked for a delay of next week's scheduled preliminary hearing, saying they had not received police reports yet and were unable to prepare their defense. Prosecutor Kim Speiler said she planned to provide the first batch of discovery to Gardner's attorneys by Wednesday. At the preliminary hearing, the prosecutor will lay out its case against Gardner, with evidence and witnesses. But this is a very complicated case, and experts say the lawyers will delay that hearing. "You know, it's important that the defense work hard to prepare, and it's important that the prosecutor work hard to prepare," said Colin Murray a former prosecutor. "Sometimes in a big case like this, with lots of investigation, lots of forensics, they want to leave no stone unturned, those just take longer." Judge Danielson also signed a protective order for Gardner designed to limit public discussion about the case by law enforcement and other authorities at the close of the hearing.

Amber's father, Maurice Dubois, was present in court for Tuesday's hearing. Outside the courthouse, Dubois spoke to the media and asked them not to listen to other friends or family members who claim to be speaking for the family. "The only spokesperson for Amber will either be me or Carrie [McGonigle Amber's mother]," Dubois said. While Dubois didn't elaborate which reports he was referring to, a local television station has been reporting information from Amber's grandmother Sheila Welch who has said she is angry with investigators for dismissing information gathered by hired search dogs last August. If police develop strong evidence against Gardner linking him to Amber Dubois' death and if the District Attorney charges Gardner with that crime, the D.A. will add that allegation to its current case against Gardner.

According to court documents, Gardner began touching the victim inappropriately and rubbing himself against her. When she objected, he allegedly hit the girl in the head repeatedly before she managed to escape to a neighbor's house. The same court records indicate that Gardner may have had another run-in with authorities the year before. In the fall of 1999, when only 19, Gardner also fondled a 14-year-old girl. The documents indicate that incident was consensual.

New details about accused murderer John Albert Gardner III emerged today in the probation case report from his 2000 molestation of a young girl in Rancho Bernardo.

It describes Gardner as a high school graduate with a 3.2 GPA and a relatively high IQ who didn&#8217;t get along well with his parents and claimed to have taken 18 different medications. It says he worked a variety of jobs, including as a seasonal lifeguard at a resort and a ride operator at Santa&#8217;s Village, a now-defunct amusement park. He aspired to be a math teacher or join law enforcement or the military, but realized before he was sentenced in his 2000 case that those dreams were gone.

The report also says Gardner was engaged at the time and notes that Dr. Carroll was disturbed by Gardner&#8217;s comments that she had become pregnant at some point in the recent past and got an abortion &#8220;because she was afraid she could not raise a child by herself.&#8221; Carroll said that statement seemed very odd and found &#8220;pervasive oddness&#8221; in the case.

Did Gardner Use Running Club To Target Women?

SAN DIEGO -- 10News received information that may indicate accused killer John Gardner used a social gathering that included his parents to allegedly target women to attack.

Photos obtained by 10News place Gardner's mother, Catherine Osborn, a nurse, and his stepfather, Kevin O'Reilly, a photographer, at an event at the Rancho Bernardo Community Park on Dec. 27 -- the same day he is accused of attacking a jogger.

The event was hosted by a local chapter of the Hash House Harriers, a popular group that is part drinking club, part running club. The group encourages members to adopt sexually explicit nicknames.

On Dec. 27, about 50 members met at Rancho Bernardo Community Park for a run scheduled for 2 p.m. Photos taken at the event showed Gardner's parents helping with the registration. 10News is still trying to confirm if Gardner had helped with the run's set up or participated in the run.

Hours before, in the park, a 22-year-old woman was jogging on the park trails. In a recent interview with 10News, the woman's mother said her daughter jogged past a man who then bodyslammed her to the ground. She said her daughter threw an elbow at her attacker and was able to get away. The jogger identified Gardner as her attacker.

As the case against John Albert Gardner III is set on a "slow track," the wheels are in motion to create a Chelsea's Law to address issues raised in the wake of her killing.

King's parents, Brent and Kelly, are partnering with the state Assemblyman who represents them in Sacramento, Nathan Fletcher (R-75th District), who is already putting heat on corrections and parole administrators. He's looking at a long menu of ideas for new legislation. "Everything is on the table: longer prison sentences, a better system of probation, a strengthened one-strike provision, changes in our parole system, online reporting, GPS monitoring," Fletcher told journalists at a news conference Tuesday in his Mira Mesa office. "We will look at every single aspect."

Chelsea's aunt Stephanie Dorian represented the Kings at Fletcher's news conference, reading a statement that said, in part, "We do not yet know when or how [these] efforts will take shape, but our commitment to carry her life forward is steadfast." Fletcher said he was outraged to learn that state corrections officials followed department policy and shredded "field notes" written by Gardner's parole officers a year after he went off supervision. Fletcher is demanding investigations by the state's inspector general and a government accountability committee.

Gardner told a probation officer that his parents divorced when he was about 5 years old. He said he suffered form Attention Deficit Hyperactivity Disorder and was treated with Ritalin and other drugs. The defendant said his father spanked him with a belt, and he felt the older man went over the line to abusiveness, according to the report.

Gardner said he worked as a lifeguard at a San Bernardino Mountain resort, then as a ride operator at Santa's Village amusement park near Lake Arrowhead until it closed down. The defendant told the probation officer he wanted to be a math teacher, but that was out of the question after his convictions. He denied ever receiving treatment for drug or alcohol abuse.

Gardner was sentenced to six years in prison and released in 2005. He was on probation until 2008 and registered as a sex offender using his grandmother's Lake Elsinore address, but he had reportedly been staying with his mother lately.

The defendant King&#8217;s death told interviewers in 2000 that, growing up, his father was abusive, he had a strained relationship with his mother, that he suffered from Attention Deficit Hyperactivity Disorder (ADHD) and that he took as many as 18 different medications until he was 16, including Ritalin, Sylert, Zoloft, Paxil, Tegretol, Mellaril, Impripramine and Wellbutrin.

The 2000 probation report was released Tuesday, the same day Gardner appeared in court to set a preliminary hearing date in the King case. Judge David Danielsen set the date for Aug. 4 and issued a gag order in the case.

In 2000, Gardner was convicted and pleaded guilty to two counts of lewd and lascivious acts with a child under 14 years old and a count of false imprisonment. According to the probation report, Gardner said he was &#8220;absolutely innocent&#8221; and took a plea deal because attorneys told him he&#8217;d &#8220;get reamed&#8221; if he went to trial.

Gardner told an interviewer he was bounced around as a child, moving four times before the age of seven. His parents divorced when he was five. According to the report, Gardner said his mom remarried and his stepfather was &#8220;an awesome dad.&#8221; Later, Gardner claims, though, his father, stepfather and an uncle were all alcoholics.

Fletcher&#8217;s proposal helps change prison policy in the aftermath of Chelsea King

A state prison policy of destroying field records one year after a criminal&#8217;s parole is completed has been &#8220;indefinitely&#8221; lifted after it was challenged by Assemblymember Nathan Fletcher (R-San Diego). In response to an argument made by Fletcher Tuesday, the California Department of Corrections and Rehabilitation (CDCR) will hold &#8220;all documents related to the parole supervision of all sex offenders indefinitely after discharge from parole supervision.&#8221;

The change in policy comes after Fletcher made his argument, days after he attempted to retrieve the records of convicted sex offender John Albert Gardner III, the suspect in the death of Poway&#8217;s 17-year-old Chelsea King. Fletcher represents the area where King lived. &#8220;I have worked closely with the Governor on this issue and share his belief that files related to sex offenders be retained for as long as possible,&#8221; said CDCR Secretary Matthew Cate. &#8220;I have directed my parole staff to immediately retain all information related to sex offenders. We will continue to support local law enforcement in their investigation into this matter.&#8221;

Earlier Tuesday, Fletcher criticized the CDCR for not holding Gardner&#8217;s documents. &#8220;This heartbreaking case leaves a lot of unanswered questions about how our criminal justice system fails to deal with sexually violent predators,&#8221; Fletcher said. &#8220;It is unacceptable and it has given all of us in public service a renewed determination to bring about change.&#8221;

The policy &#8212; number 08-36 of the California Department of Corrections and Rehabilitation &#8212; allows for the system to destroy &#8220;Field File&#8221; reports one year after a criminal completes his or her parole; however it maintains a &#8220;Central File,&#8221; which contains &#8220;pertinent information.&#8221; But Fletcher said the policy and system failed to factor in &#8220;reality.&#8221; Fletcher said he and his staffed were &#8220;shocked&#8221; when they requested field reports and in return, received a &#8220;fact sheet&#8221; a little more than one page long. He said his proposed legislation, Chelsea&#8217;s Law, would allow the state to determine how to improve the system so that the necessary documents are available when a case such as Gardner&#8217;s appears. Additionally, Fletcher has requested that the State Inspector General David Shaw investigate the record keeping process.

Chelsea King's accused killer appeared to be attracted to young girls and manifested predatory traits that made him a danger to the community, a psychologist said in a 2000 probation report released Tuesday.

John Albert Gardner III, who is charged with the rape and murder of the 17-year-old Poway High School senior, pleaded guilty 10 years ago to sexually assaulting a 13-year-old girl.

The attack occurred in his mother's townhouse, which is located about a mile from Rancho Bernardo Community Park, where Chelsea disappeared Feb. 25 while jogging.

A convicted sex offender charged with murdering one teen and suspected in the death of another appeared in court Tuesday as a judge issued a gag order and delayed a key hearing in the case. Defendant John Albert Gardner III spoke only to acknowledge that he waived his right to speedy proceedings. Superior Court Judge David J. Danielsen rescheduled the preliminary hearing from March 18 to Aug. 4. The hearing is meant to show if there is enough evidence to send Gardner to trial.

Public defender Michael Popkins, who represents Gardner, declined to comment after the hearing.

Schwarzenegger's order came hours after Assemblyman Nathan Fletcher, R-San Diego, asked the department's inspector general to investigate whether records were improperly destroyed. Fletcher praised the governor for acting swiftly to correct what he called an irresponsible policy.

Did Gardner Use Running Club To Target Women?

10News received information that may indicate accused killer John Gardner used a social gathering that included his parents to allegedly target women to attack.

Photos obtained by 10News place Gardner's mother, Catherine Osborn, a nurse, and his stepfather, Kevin O'Reilly, a photographer, at an event at the Rancho Bernardo Community Park on Dec. 27 -- the same day he is accused of attacking a jogger. The event was hosted by a local chapter of the Hash House Harriers, a popular group that is part drinking club, part running club. The group encourages members to adopt sexually explicit nicknames.

On Dec. 27, about 50 members met at Rancho Bernardo Community Park for a run scheduled for 2 p.m. Photos taken at the event showed Gardner's parents helping with the registration. 10News is still trying to confirm if Gardner had helped with the run's set up or participated in the run. Hours before, in the park, a 22-year-old woman was jogging on the park trails. In a recent interview with 10News, the woman's mother said her daughter jogged past a man who then bodyslammed her to the ground. She said her daughter threw an elbow at her attacker and was able to get away. The jogger identified Gardner as her attacker. Legal experts like defense attorney Jan Ronis expect prosecutors to take a close look at the Dec. 27 incident. "Just to be able to place him in the general area within a general time is a significant point from the prosecution point of view," said Ronis.

When told of 10News' information, an aunt of the jogger said, "It's sick and wrong if he used his family's event to look for victims &#8230; but if having family nearby prevented him from chasing down my niece, that's good." Officers of the running club declined to comment, but did say they don't recall ever seeing Gardner at any of the runs.

King suspect&#8217;s gold Pontiac figures in investigation
Possible link with other cases noted

The car used in the attempted abduction of a Lake Elsinore girl in October was hardly nondescript. It was a gold 1990s four-door sedan. Turns out the man accused last week of raping and killing Poway teenager Chelsea King drove a gold 1999 Pontiac with four doors. He was most recently living and registered as a convicted sex offender in Lake Elsinore. John Albert Gardner III was driving the Pontiac in June when he was stopped on Interstate 15 near Escondido going 82 mph in a 70-mph zone, according to court records The San Diego Union-Tribune obtained Monday. &#65279;A California Highway Patrol officer cited him for driving without proof of insurance. DMV records show Gardner has owned the car since June.

Gardner, whose face resembles an artist&#8217;s sketch authorities released after the Oct. 28 incident in Lake Elsinore, lived less than four miles away from where the attempted abduction occurred. Sgt. Joe Borja, a spokesman for the Riverside County Sheriff&#8217;s Department, which is investigating the incident, said deputies know about the car Gardner drove but are looking for &#8220;something solid.&#8221; He has been cited for several traffic violations since December 2006, when he failed to stop at a red light in Loma Linda. He was cited for marijuana possession in Buccaneer Park in Oceanside in November 2008 and for an open container of alcohol and not having his license in Escondido last April.

Riverside County deputies began exploring Gardner&#8217;s potential involvement in their attempted abduction after he was charged Wednesday with 17-year-old Chelsea&#8217;s murder. A news release about the investigation had been removed from the sheriff&#8217;s Web site but was restored, along with the artist&#8217;s composite sketch, on Thursday.
