Bob Bashara has prison guards on high alert

Bob Bashara is settling in to his new surroundings at the Oaks Correctional Facility in Manistee.

He is sharing a cell and will get a minimal amount of time outside of it. He can use his time for exercise or to study at the onsite library.

Bashara is one of almost 500 inmates being housed at the prison. The facility is state-of-the-art and equipped to handle the most violent offenders...

Investigation Into Alleged Falsified Overtime In Detroit Police Department

DETROIT (WWJ) – There’s an internal investigation into allegations that Detroit police officers falsely logged overtime during the Bob Bashara trial that they didn’t work.

The investigation began after a supervisor in the homicide section reported that officers were writing phony subpoenas – charging the city for overtime for court appearances that never happened – particularly during the Bashara trial.

The investigation could be widening reports WWJ’s Legal Analyst Charlie Langton. Chief James Craig says he will focus on other units of the department.

Reports show the budget for overtime in the department is $20 million. Since the investigation began court-time for homicide investigators has dropped 52 percent.

The Local 4 Defenders have obtained new documents showing a motion for a new trial has been filed in the case against Bob Bashara.

The former Grosse Pointe Park businessman was convicted of playing a role in his wife Jane's 2012 murder. He was sentenced to life in prison in January.

Bashara's new attorney is laying out the reasons he believes Bob should get another trial. Bashara said his attorneys failed to follow his suggestions for witnesses to be called and points to argue. He said he was told "they had this." ...

However, what he did want submitted were Jane Bashara's medical records from her gynecologist. In the documents, Bashara attempts to explain his kinky sexual lifestyle, saying Jane's physical ailments and their marital understanding would have put his lifestyle in the proper context, whether you agree with him or not.

Diallo said she will gladly testify about why she and McCarthy rejected many of Bashara’s various suggestions during his trial.

“There were certain things that he wanted introduced that you cannot introduce under the rules of evidence, or the evidence wasn’t relevant,” she said.

Diallo said she is not surprised that she and McCarthy likely will be challenged on the witness stand by Ambrose.
“You expect something like this after a trial of this magnitude,” she said.

She said Judge Evans “bent over backwards” for Bashara during the trial.

“He wants the bending to continue,” she said.

Bob Bashara seeks new murder trial, blames his lawyers

The filing also says: "A motion for an evidentiary hearing to further develop the record on the issue of ineffective assistance of counsel is requested." The motion, filed by his appellate attorney Ronald Ambrose, says Bashara had wanted investigators to "research and talk to or visit numerous places and people to aid and uncover specific information," and it says people and evidence that could have shown his innocence were "ignored or overlooked."

Convicted murderer Bob Bashara could testify today

In his quest for a new trial, Bob Bashara is expected to return to the Detroit courtroom today where he was sentenced to life in prison without the possibility of parole earlier this year for the murder of his wife, Jane Bashara.
The former Grosse Pointe Park businessman, whose home is now the Oaks Correctional Facility in Manistee, claims he was denied a fair trial “in a number of respects” and asked the court to toss his convictions in a motion seeking an evidentiary hearing and new trial.

Judge Evans is making this attorney nervous. She keeps asking him questions that he can't answer. She's now demanding the names of the witnesses that Bashara says weren't called and the attorney doesn't have a list. She tells him to move on but get her that list and add to the motion.

Bob Bashara waives attorney-client privilege and court is adjourned for "10" minutes.

An additional hearing has been scheduled for October 14 for additional witnesses. Judge Vonda Evans wants the defense to provide her with names and what they will say in their testimony.

Judge Evans is her usual self, cutting off the defense attorney Ambrose and telling him to simplify and give just the basics. They will go into detail at a later time.
