Flooding hinders search for missing Neb. student

Nemaha County Attorney Louie Ligouri said searchers have been periodically checking the river banks near Peru for Tyler "Ty" Thomas but there have been no recent searches of the Missouri, which has swollen to record levels and is expected to remain high into the fall.

Sunday marked seven months to the day that 19-year-old Peru State College freshman Tyler Thomas went missing. The search for her continues, but has hit a rough patch over the summer months. Those close to Ty say they are frustrated with the way the search and investigation is going.

Why do we seldom hear about missing black children?

They are strangers whose faces and names we know intimately; JonBenét Ramsey, Elizabeth Smart, Dylan Redwine, Caylee Anthony. They are other people's children, but we worry for them, pray for them. In addition to being young and innocent, these well-known names have something else in common.

All are white.
 
Earlier this month, Peru State, Nebraska State College Board members and Board of Trustees of the Nebraska State Colleges asked a federal judge to dismiss the suit.

In a brief in support of the motion, attorney Ronald Krause said it wasn't foreseeable that placing Keadle in the same dormitory where Thomas lived would lead to an assault by Keadle on her.

He said actions Keadle may have taken against Thomas may have been egregious and shocking, "but the alleged failure of a representative of Peru State College to check into Keadle's background was, at most, mere negligence."

Update: Motion To Dismiss Lawsuit Granted In Thomas Case

A federal judge has granted the motion to dismiss a lawsuit filed by the parents of a missing Bellevue woman.

The dismissal motion says officials couldn't foresee that placing Keadle in the same dormitory where Thomas lived would lead to an assault by Keadle.

He has not been charged in her disappearance but remains a person of interest.

In this case, LaTanya Thomas and Kevin Semans asked Nemaha County District Judge Daniel Bryan to order a death certificate for their daughter so they can go forward with wrongful death lawsuits in state and federal court. They have sued Josh Keadle, who they suspect killed her, and the Board of Trustees of the Nebraska State Colleges, which they believe could have prevented her death.

It was four years ago this week when Tyler Thomas was reported missing. The Peru State College student was last seen December 3rd in 2010. Her killer was never convicted. Her body, never found.

But now comes a push for change to assure that the circumstances surrounding her disappearance will never happen again. Nineteen-year-old Tyler Thomas is still out there...somewhere.

August ruling anticipated on request to dismiss lawsuit

A federal judge says he hopes to decide in August whether to dismiss a lawsuit against Nebraska college officials over the disappearance of a 19-year-old student.

Her family filed a lawsuit for wrongful death against the Nebraska State College Board of Trustees, which governs Peru State, and a man who was suspected in Thomas' disappearance. The board is requesting the suit's dismissal.

The 29-year-old man, who had attended Peru State, told authorities that he and Thomas had met before she went missing. He isn't charged in her disappearance and is currently serving a prison sentence for an unrelated sexual assault conviction.

OMAHA, Nebraska — The family of a Peru State College student who disappeared nearly five years ago is still struggling to accept her presumed death and the lack of prosecution in the case.
"We haven't been able to go through that grieving process," she said. "We're just halted, suspended in air. Where is she? What happened?"

The family is pursuing a lawsuit against the college in state court for ignoring warnings that fellow student Joshua Keadle was a possible threat to women at the college.
