The only person convicted in the disappearance of Erica Baker more than eight years ago will have to be resentenced for his crimes.

Christian Gabriel is currently serving time in prison for gross abuse of a corpse and tampering with evidence. On Friday, he won part of a seven-part appeal.

An opinion handed down by the Court Of Appeals said a portion of the state sentencing statute read by the judge in Gabriel’s original trial was unconstitutional.

I live in Cincinnati, so I am very familiar with this case also. I really hope they find her to give her family closure.

I can't even remember the names, now, of the people who were thought to be involved. Would be interesting to see if either of them lived in the Enon area. The place where they are looking is kind of ..... well, it's not a very good area, to put it nicely.
 
This case breaks my heart. It's so hard to accept something like this can happen in your hometown. I live about 5 minutes from where Erica went missing. Over the years I've occassionally seen Pam, her grandmother, around town. She always had Erica's picture plastered on buttons on her clothes and purse. She looks like such a kind woman... my heart just hurts for her and the rest of Erica's family.

Erica Baker Has Been Missing 10 Years

...It was Feb. 7, 1999, when Kettering police got the call that Baker had gone missing. She had left home to walk the family dog near the Kettering Recreation Center.

The dog was later found with his leash still attached...

Gabriel, 40, was convicted of gross abuse of a corpse and tampering with evidence in 2005 following a jury trial. Sentenced to six years, he entered prison on Oct. 20, 2005. Gabriel was given 105 days of jail credit, said JoEllen Smith, spokeswoman for the Ohio Department of Rehabilitation and Correction.

After years of therapy, Erica's mother says she's finally ready to dedicate a monument to remember her daughter who would've turned 24 this year.

It's also a way for her to thank the everyone who helped search for the little girl.

The ceremony will take place Saturday morning at 10 AM at David's Cemetery in Kettering.

"People have been asking me for a place to go. It kind of felt to me like giving up but i can't look at it that way, because they're not really giving up, they're just wanting a place to go to think of her," says Misty.
 
I still think of this little girl often. Wish her mother could get proper closure.
