Austintown murder suspect ‘not competent’ to stand trial nearly 30 years later


YOUNGSTOWN, Ohio (WKBN) – The Arizona truck driver accused of raping and killing a woman in Austintown almost 30 years ago will be going back to a psychiatric facility for treatment.

Samuel Legg is charged in the death of Sharon Kedzierski back in 1992. Her body was discovered behind the site of an old truck stop.

In court Wednesday afternoon, Judge John Durkin ruled Legg is still not competent to stand trial after undergoing treatment in June.
 
The hearing is still listed on the court site - so it might be a video conference - so I'll post this. And I can shorten it up a bit too.

5/10/19 Update: Legg was ordered to undergo further psychological treatment at his competency hearing Friday morning. An independent psychologist determined Legg, who has also been linked to 4 homicides in the 1990s, had not responded well to prescription medication & remains psychotic. To undergo psychological treatment at Northcoast Behavioral Healthcare for a period not to exceed four months. Trial has been cancelled for 5/28. Back in Sept. 13 for a competency review hearing.

Suspected serial killer charged with 1997 Lake County, IL murder of Julie Konkol

WAUKEGAN, Ill. -- A suspected serial killer in custody in Ohio has been charged with the 1997 murder of a woman at an abandoned truck stop near Illinois' border with Wisconsin.

Samuel William Legg III, 52, is charged with two counts of first-degree murder for the death of 39-year-old Julie A. Konkol, according to a statement from the Lake County sheriff's office.

Konkol was found strangled on Oct. 23, 1997, behind the abandoned Senter's truck stop in the 43000 block of Old Route 41 in Russell, the sheriff's office said.

In 2006, DNA from her case was matched with a 1996 homicide in Wood County, Ohio, officials said. The same suspect's DNA was matched in 2012 to a 1992 homicide in Mahoning County, Ohio.

In 2018, the suspect's DNA was tested looking for a familial or direct connection, which led investigators to Legg. He was "found to be a one-in-one-trillion match as being the source of the DNA found on Konkol," the sheriff's office said.

Lake County sheriff's investigators traveled to Ohio, where Legg remains in custody, to interview him in connection to the homicides. He was subsequently charged with Konkol's murder and will eventually be extradited to Illinois to face the charges.

His bail in the Lake County case was set at $3 million, according to the sheriff's office.

Officials say the DNA of Samuel Legg III, a former long-haul trucker, was linked to other murders in Mahoning County, Ohio and Lake County, Illinois.

WOOD COUNTY, Ohio — An Arizona man who authorities say has been linked by DNA to the slayings of four women at truck stops in Ohio and Illinois during the 1990s has been indicted for the rape and murder of a woman in Wood County in 1996, according to the Wood County Prosecuting Attorney.

On Thursday, the Wood County Prosecutor's Office said Samuel Legg III, 51, has been connected with the murder of Victoria Jane Collins, whose nude body was found behind the Union 76 truck stop in Lake Township on Dec. 20, 1996. She was 27 years old.

At Wednesday's hearing, Legg's attorney argued that under Ohio law, if a defendant hasn't been restored to competency after being at a mental hospital for one year following a court order, the charges have to be dismissed. Legg was ordered to Twin Valley Behavioral Healthcare in September 2019. Judge Kimbler found that Legg, by refusing to take part in the hospital's treatment program, had stopped the running of the one-year restoration period. She found that the time period should be extended by 6 months & could be extended even longer if Legg continues to refuse to take part in his treatment, and ordered the hospital, through the state of Ohio, file monthly reports regarding Legg's cooperation with his treatment. Legg has been diagnosed with neurosyphilis & schizophrenia, according to the Ohio Attorney General's Office.

Suspected rapist and serial killer Samuel Legg III will remain in state custody in Franklin County, where he is under treatment in an effort to make him competent enough to stand trial in Medina County.

Medina County Common Pleas Court Judge Joyce Kimbler ruled Wednesday that prosecutors have at least an additional six months to restore Legg to competency. Legg is facing two rape charges in Medina County as well as two murder charges in Wood and Mahoning counties and an out-of-state murder charge in Illinois.

At Wednesday's hearing, Legg's attorney argued that under Ohio law, if a defendant hasn't been restored to competency after being at a mental hospital for one year following a court order, the charges have to be dismissed. Legg was ordered to Twin Valley Behavioral Healthcare in September 2019.

Kimbler found that Legg, by refusing to take part in the hospital's treatment program, had stopped the running of the one-year restoration period.

She found that the time period should be extended by six months and could be extended even longer if Legg continues to refuse to take part in his treatment, and ordered the hospital, through the state of Ohio, file monthly reports regarding Legg's cooperation with his treatment.

9/16/20 Update: Legg will remain in state custody in Franklin County, where he is under treatment in an effort to make him competent enough to stand trial in Medina County. Medina County Common Pleas Court Judge Joyce Kimbler ruled Wednesday that prosecutors have at least an additional 6 months to restore Legg to competency. Legg is facing two rape charges in Medina County as well as two murder charges in Wood & Mahoning counties & an out-of-state murder charge in Illinois. At Wednesday's hearing, Legg's attorney argued that under Ohio law, if a defendant hasn't been restored to competency after being at a mental hospital for one year following a court order, the charges have to be dismissed. Legg was ordered to Twin Valley Behavioral Healthcare in September 2019. Judge Kimbler found that Legg, by refusing to take part in the hospital's treatment program, had stopped the running of the one-year restoration period. She found that the time period should be extended by 6 months & could be extended even longer if Legg continues to refuse to take part in his treatment, and ordered the hospital, through the state of Ohio, file monthly reports regarding Legg's cooperation with his treatment. Legg has been diagnosed with neurosyphilis & schizophrenia, according to the Ohio Attorney General's Office. Next hearing in February of 2021.

IL - *Julie A. Konkol (39) (found strangled Oct. 23, 1997, behind the abandoned Senter's truck stop in the 43000 block of Old Route 41 in Russell) - *Samuel William Legg III (27 @ time of crime/49/now 51) charged (7/30/20) with 2 counts of 1st degree murder. $3M bond. Lake County
Will eventually be extradited to Illinois to face the charges.
OH - *Victoria Jane Collins (27) (found behind the Union 76 truck stop in Lake Township on Dec. 20, 1996) - *Samuel William Legg III (26 @ time of crime/51) indicted & charged (8/20/20) with 2 counts of aggravated murder, murder, 1st degree rape & 1st degree kidnapping. Wood County
Legg's DNA was linked to her death.
8/20/20 Update: Bench warrant issued. 8/27/20: Motion for determination of competency of defendant filed. Prosecuting Attorney's Request for Issuance of Warrant on Indictment-filed by Alyssa M. Blackburn Dolan.

OH - *Angela Marie “Angie” Hicks (14) (disappeared July 21, 1990, found by Midway Mall on Aug. 30, 1990, Elyria, Lorain County) – suspect in ongoing investigation.
Legg (21 @ the time) was Angela’s step father. DNA link to 3 homicides in Ohio & 1 in Illinois.
