Sandusky (and Dorothy) Future

Probably more about the sentencing, but I'm wondering if the probation report will find that he is determined to be a violent sexual predator...if so, he can be kept in prison even after his sentence is over if he is found to be dangerous to the community...the U.S. Supreme Court has upheld that type of protective custody....

HARRISBURG, Pa. (AP)

Former Penn State assistant football coach Jerry Sandusky has been recommended for designation as a sexually violent predator, a legal status that would require lifetime registration with authorities, according to a person who has read an assessment board's report to a judge in the case.

The recommendation from the Sexual Offenders Assessment Board was disclosed to The Associated Press on Thursday by the person, who spoke on condition of anonymity because of the report's confidential nature.........

Some sex offenders must register under the Pennsylvania Megan's Law for 10 years, but that requirement is lifelong for sexually violent predators, who must update their residences to the state police on a quarterly basis and prove they are participating in approved counseling.

Also, the chief law enforcement official in the community where a sexually violent predator lives is required to notify the public by producing a flier that bears the offender's name, address, photograph and offense.


That is if he ever gets out of prison.....

Yada, Yada, Yada. It's always the same ole story. After the trial where they were found guilty they express how they should have taken the stand, cause they are so, so, so, so innocent.

NEW YORK (Reuters) - The attorney for convicted child sex offender Jerry Sandusky said on Wednesday he plans to appeal the case, arguing that he was not given sufficient time to prepare for the high-profile trial of the one-time Penn State football coach.

Joe Amendola said he plans to tell the appellate court he was an "ineffective counsel" due to lack of time not because his representation was flawed..........

He said Sandusky could be sentenced in October.

According to the article:

Sexual Offenders Assessment Board spokesman Leo Dunn said the board does not comment on any case, but he noted it has never failed to complete an assessment within 90 days, as required. The judge ordered Sandusky's evaluation by the board on June 22, shortly after the jury verdict.

Dunn said such evaluations are assigned to an investigator, who then reports his or her findings to a board member. The board member produces an evaluation, which includes a recommendation.

There’s little doubt that Jerry Sandusky faces a long prison sentence. In a few weeks, he’ll find out how just how long.

A judge announced Monday he will sentence Sandusky on Oct. 9, nearly four months after the retired assistant football coach was convicted in the child molestation scandal that brought shame to Penn State.............

Judge John Cleland scheduled a hearing for 9 a.m. at the courthouse in Bellefonte to determine if Sandusky should be classified as a sexually violent predator, a designation that subjects a convict to intense reporting requirements upon release. An assessment board has recommended Sandusky for the designation, though it’s expected to have little practical effect since he stands to die in prison.

Sandusky will be sentenced immediately afterward. Cleland ordered defense attorneys and prosecutors to submit written statements “intended to aid the court in the imposition of sentence” by Oct. 5...............

..............Trial transcripts posted online Friday offer a glimpse into Sandusky's decision to remain silent during his child sex-abuse trial.

"Mr. Sandusky had always wanted to testify on his own behalf. He always wanted to tell people his side to the allegations in this case," defense lawyer Joe Amendola said during a private conference in judge's chambers. "However, that potential evidence, whether true or not, was so devastating" that Sandusky felt he could not run the risk of testifying and subjecting himself to questions about Matt, he continued.

Amendola argued for a mistrial, saying "it was such an integral part of our case that Mr. Sandusky testify that we feel we have really put ourselves in a tough situation with the jury."

Prosecutors objected and Judge John Cleland agreed, telling Amendola that trials have a way of throwing legal strategies into disarray.

Mr. Sandusky's lawyers plan to argue that Judge Cleland, who denied several requests to grant a delay this spring, rushed the case to trial seven months after the attorney general brought charges against Mr. Sandusky in early November. Jury selection began in early June.

The lawyers will argue that a delay would have enabled them to take advantage of a state law passed in June allowing expert testimony about the behavior of victims of sexual assaults. The law is generally thought to aid prosecutors in explaining why victims often wait years to report abuse. Mr. Rominger declined to provide details about how the defense could have used such an expert."
