The man accused of raping and killing a 6-year-old girl from his West Jordan neighborhood was back in court Tuesday.
Terry Lee Black, 41, appeared in 3rd District Court .....
Black, was only in court briefly — long enough for another date to be set for Oct. 9.
"We're going to ask for a preliminary hearing to follow very soon," deputy Salt Lake County attorney Robert Stott said.
The "horrible nature" of the crime creates urgency to move the process along, Stott said, but it must be handled deliberately due to what is at stake. If convicted, Black could face the death penalty.
The hearing was fairly quick and routine. Black stood in silence next to his newly appointed public defender, wearing handcuffs and shackles. It took less than five minutes for the judge to work out the next phase of the case with the attorney’s on both sides.
Investigators say Sierra’s DNA was still on Black’s clothing.
Prosecutors believe they have a strong case against Black, but say it will take some time

Black’s charges are all aggravated felonies, meaning he is eligible for the death penalty. The Salt Lake Count DA’s Office has not decided yet if they will pursue it.

About three hours after Sierra Newbold disappeared from her West Jordan home, a neighbor spotted a man hovering just yards away from what police would later determine was the 6-year-old girls watery grave.
The man, the witness recalled, was acting oddly at 5:30 a.m. that June 26 day. He was hunched over at the waist, holding his hands out in front of him and rocking back and forth about 60 yards from where Sierra Newbolds pink pajama bottoms and white underwear were later found in a freshly burned field.
When Blacks wife was later shown a picture of her husband from the day he was arrested, she told investigators she had last seen him June 20 when he left and didnt return. Blacks wife also said he was wearing the same clothing as when he left nine days earlier a darker-colored Los Angeles Angels shirt and black shorts with red stripes down the side that extended below the knee.
When investigators spoke with Black, he told them his wife had kicked him out, but would not say where he had stayed during the interim.
Terry Lee Black was charged with two more counts of sexual abuse of a child and two more counts of aggravated sexual abuse of a child. Documents filed with the new charges claim the abuse happened sometime between 2007 and 2009.
A girl who would have been 11 or 12 years old at the time attended a sleepover with members of Blacks family....

In a petition filed July 18, Black's four attorneys said they have met with the man almost weekly for the past year "and believe he is suffering from limited mental functioning."
With a ruling from the Utah Supreme Court, the criminal case against a man accused of kidnapping, raping and killing a 6-year-old West Jordan girl in 2012 can resume.
Terry Lee Black's case has been at a standstill in district court for nearly a year and a half as attorneys argued before the Utah Supreme Court over issues concerning the judge who was hearing the case.
If not for the support from the community, the Newbolds say, they don't know how they would have survived. It's because of that support that the Newbolds intend to continue living in the same home from where their daughter was abducted.

Now, the community wants to give the Newbolds their "forever home" a remodeled house that they'll "never want to leave," Kathy Newbold said.

The bedroom, for one, where Sierra slept and from where she was abducted, will be remodeled. Today, Sierra's younger sister, T who has gone through counseling still cannot sleep in the room. The Newbolds want to change it make it special to her.
Their kitchen will also be remodeled and will include a new table that no longer has four corners, which, her mother says, makes Sierra's empty spot at the table stand out even more.
The Newbolds will also be getting a new door, replacing the sliding glass door that Black allegedly used to enter the house and that was hauntingly still open when the family got up that morning.

Not all areas of the house conjure up unhappy memories. The hallway is where Sierra's mother remembers her daughters playing and laughing, and that area will not be remodeled.

Lawyers for Terry Lee Black, 44, have raised questions about his mental state, and Judge Douglas Hogan is expected to receive the results of a psychological evaluation shortly, said his lawyer, McCaye Christianson. Black appeared in court Monday in a yellow jail jumpsuit, with long hair tied back and appearing much thinner than he did at his last court hearing in 2013.
Prosecutor Robert Stott says that the girl's family is glad to see the case resuming. "They're just amazed how long this has taken," he said.
Black is due back in court on Oct. 22, though no decision is expected on whether he's competent.
On Tuesday, Hogan said that updated competency findings suggest Black's condition has "gotten substantially worse in some areas."
Black is unable to appreciate the nature or severity of the proceedings and he lacks the mental fitness to assist his attorneys with his defense, the judge said...
Stott said the experts who have evaluated Black have diagnosed him with multiple mental illnesses, including "borderline intellectual functioning, learning disorder, cognitive disorder and psychotic disorder."
