Parents of Brian Laundrie ask Florida court to let them take over his estate
Brian Laundrie, 24, left no will upon his death. As a result, his parents are requesting access to his estate as beneficiaries. Officially, the court filings from the Laundrie family say Brian died on Oct. 20 and due to lack of any surviving spouses or children, they were the closest relations.

In terms of what makes up Brian’s estate, Chris and Roberta Laundrie are estimating the final value of his belongings to be $20,000 in Bank of America checking and savings accounts. The filing reported that Brian did not have an indebted estate, and no creditors had filed claims for portions of his property.

Should their request be approved, the Laundrie parents would each receive half of the value held in the accounts. The documents were filed in court on Dec. 8.

Gabby Petito's parents start foundation to counter domestic violence, find missing persons

On the eve of their first Christmas without their daughter, Gabby Petito's mother said some days can be harder than others.

"We have our days where we just need to shut down and take a moment. But … the whole goal is prevention and helping other young people," Nichole Schmidt said. "We hope that we save lives and in Gabby's name and because of what happened to her, that that gives us a lot of hope."

FBI Denver Provides Final Investigative Update on Gabrielle Petito Case — FBI
Yesterday, the family of Gabrielle Petito met with the FBI at the Tampa Field Office as the investigation will be closed in the near future.

“All logical investigative steps have been concluded in this case,” said FBI Denver Division Special Agent in Charge Michael Schneider. “The investigation did not identify any other individuals other than Brian Laundrie directly involved in the tragic death of Gabby Petito. ...”

On September 19, 2021, the search team located the remains of Ms. Petito at the Spread Creek Dispersed Camping Area near where she and Brian Laundrie had been seen together. ... The Teton County Coroner’s Office subsequently concluded Ms. Petito died of “blunt-force injuries to the head and neck, with manual strangulation.” ...

The following is a timeline of the investigation:
  • The FBI investigation revealed that, between August 30 and September 1, 2021, Mr. Laundrie had used Ms. Petito’s debit card without authorization on his drive back to Florida from Wyoming.
  • After Ms. Petito’s death, there were several text messages identified between Mr. Laundrie’s telephone and Ms. Petito’s telephone. The timing and content of these messages are indicative of Mr. Laundrie attempting to deceive law enforcement by giving the impression that Ms. Petito was still alive.
  • On September 15, 2021, Mr. Laundrie’s Ford Mustang was recovered from the T. Mabry Carlton Jr. Memorial Reserve and Myakkahatchee Creek Park in North Port, Florida.
  • On September 17, 2021, Mr. Laundrie’s parents reported him missing shortly after law enforcement conducted a welfare check at their residence.
  • On September 18, 2021, law enforcement officials commenced an extensive search of the park where Mr. Laundrie’s vehicle was parked and did not locate Mr. Laundrie. The area where Mr. Laundrie’s remains were later found was part of this search area, but the area was submerged due to recent flooding at the time of this initial search.
  • On September 22, 2021, the U.S. District Court for the District of Wyoming issued a federal arrest warrant for Mr. Laundrie. The warrant was issued pursuant to a Federal Grand Jury indictment for violation of federal statute 18 U.S.C. § 1029(a)(1): “Use of Unauthorized Access Devices” related to Mr. Laundrie’s activities following the death of Ms. Petito.
  • On October 7, 2021, after law enforcement made a request through Laundrie family attorney Steven Bertolino, the Laundries provided personal effects to law enforcement which were to be used to assist in the search of the Myakkahatchee Creek Environmental Park.
  • On October 20, 2021, after water had receded from the area and the park was reopened, Mr. Bertolino notified law enforcement that Mr. Laundrie’s parents intended to return to the park to search for Mr. Laundrie. Law enforcement officers were present when Mr. Laundrie’s parents located an item in the park later determined to belong to Mr. Laundrie.

According to an announcement from the National Domestic Violence Hotline on Monday, Dec. 20, the Gabby Petito Foundation made significant donations in the month of December to the National Domestic Violence Hotline, SafeSpace and The AWARE Foundation.

"These three organizations are doing incredible work on the front lines of missing persons and responding to those impacted by abuse," said Petito's father Joe Petito. "Our foundation is honored to present them with this support."

According to the report, Laundrie’s remains and belongings were in plain sight along a trail in the Carlton Reserve. The report says that a water line on the trees was evidence of approximately three feet of water that had previously kept the remains hidden from view.

The report defines two scenes of investigation; the main scene and a secondary scene that was described in the report as being 100 to 250 feet to the east.

At the main scene, investigators found what was later determined to be Laundrie’s nearly complete skeletal remains, including his jawbones that were used to help identify the remains. Investigators also found personal items, including green shorts, a green belt, slip-on shoes, a backpack, a white metal ring, and a revolver that contained two live rounds and a spent one.

Using a metal detector, investigators found a projectile in the ground about 50 feet from where the skull fragments were found.

Investigators found animal skeletal remains, a handwritten half note, and a hat at the second scene.

The report says about 250 feet southwest of the main scene, a drybag was found containing a journal, a wooden box containing a small notebook, and photos, including at least one of Laundrie.

The autopsy report lists the cause of death as a “gunshot wound to the head with extensive, associated craniofacial fractures.”

A reconstruction of Laundrie’s skull determined that the gunshot went from left to right and exited his head. Laundrie’s sister says that her brother was right-handed.

FGCU actually played a significant role in this investigation. Heather Walsh-Haney is a forensic anthropologist and chair of The Department of Justice Studies at FGCU. She played a massive role in figuring out precisely what happened to Laundrie.

In January, the FBI released a statement saying that after a review of the notebook found near Brian Laundrie’s body, it “revealed written statements by Mr. Laundrie claiming responsibility for Ms. Petito’s death.”

Autopsy Report Reveals Disturbing New Details on Brian Laundrie’s Death (yahoo.com)

The report, conducted by District 12 deputy chief medical examiner Dr. Wilson Broussard, states that Laundrie died from a self-inflicted gunshot wound to the head. When the FBI finally found him days into his disappearance, he was discovered near a European American Arms revolver, which was marked as a .38 special on one side of the barrel and as a .357 magnum on the other, the report states.

“The cylinder contained two live rounds and one spent round of ammunition,” the report states, noting that Laundrie had been partly eaten by animals by the time his remains were discovered in a Florida swamp.

Much of Laundrie’s corpse had “moderately extensive carnivore activity evidenced by multiple gouging and gnawing marks,” according to the medical examiner. “These areas are consistent with carnivores and/or omnivores including canines such as feral dogs and coyotes along with rodents and raccoons.”

The remains included a “right and left scapulae, right humerus, right femur, two tibiae, two fibulae, two clavicles, two pelvic bones, the sacrum, one right ulna, one right radius, and multiple ribs” the report continues. “Also, multiple fragments of cranium and skull along with a generally intact mandible with attached teeth and the lower aspect of the maxilla with attached teeth are noted. Cervical, thoracic, and lumbar vertebrae are also located nearby.”

In the new lawsuit, Petito’s parents allege that Laundrie told his parents what happened “on or about” Aug. 28.

“It is believed, and therefore averred that… Brian Laundrie advised his parents, Christopher Laundrie and Roberta Laundrie, that he had murdered Gabrielle Petito,” the lawsuit states. “On that same date, Christopher Laundrie and Roberta Laundrie spoke with Attorney Steve Bertolino, and sent him a retainer on Sept. 2, 2021.”

“While Joseph Petito and Nichole Schmidt were desperately searching for information concerning their daughter, Christopher Laundrie and Roberta Laundrie were keeping the whereabouts of Brian Laundrie secret, and it is believed were making arrangements for him to leave the country.”

In the lawsuit, Petito and Schmidt accuse the Laundrie family of acting “with malice or great indifference to the rights of” Petito’s family.

“Christopher and Roberta Laundrie exhibited extreme and outrageous conduct which constitutes behavior, under the circumstances, which goes beyond all possible bounds of decency and is regarded as shocking, atrocious, and utterly intolerable in a civilized community,” the lawsuit says.

This lawsuit also claims Laundrie tried to "hide the fact that she was deceased" by using Petito's phone to text his own phone after the murder as if she was alive. One text in particular alarmed Gabby Petito's mother, Nichole Schmidt, because the text referred to her grandfather by his name, Stan. Her mother claims Gabby Petito "never called her grandfather by his name."

In response, Laundrie family attorney Steven Bertolino, of East Islip, said in a text message: "As I have maintained over the last several months, the Laundries have not publicly commented at my direction which is their right under the law. Assuming everything the Petitos allege in their lawsuit is true, which we deny, this lawsuit does not change the fact that the Laundries had no obligation to speak to Law Enforcement or any third party including the Petito family. This fundamental legal principle renders the Petitos' claims to be baseless under the law."
