There was a "Sarah Kirby" law put onto place on cruise ships to monitor how drunk passengers are and cut drinking off due to Kirby suing Carnival after going overboard.

I can't find anything about how the Sarah Kirby lawsuit against Carnival ended - just innumerable pages describing the lawsuit. Do you know specifically what was said in the new law? Because I can't find that either - and can't imagine cruise ships could function if they limited passenger's alcohol intake.

http://www.news.com.au/travel/trave...ival-cruise-ship/story-fnizu68q-1226806932077 You can google her name and find many articles about her. I watched her on First Edition and Dateline had a special on cruise line deaths including George Smith.

The link above actually has photos of her falling off the ship. She dropped the claim of medical personnel not treating her for her injuries. She is claiming that the bartender "pushed" drinks on her by giving away $5 coupons for the casino for every drink ordered. She was also on the cruise to celebrate her 30th birthday and was extremely drunk. She said that she leaned over the balcony to see the side of the ship under the balcony and fell.

Daily Mail also covers the story well as well as has the video of her fall.

Speakoncruises.com has January 19, 2014 article on the lawsuit.

I have a vague memory of there being some limit on carnival, like 15 drinks a day? Or maybe that's just the drink package limit. Still insanely high.

I cannot stand how people are always blaming others for their actions. Yes a bar can "overserve" or you could just stop drinking even though that's usually not what one would do. Then if you know you've been "overserved" why would you go to the railing of a ship in an ocean and then want to sue when YOU fall over? Everything can't have a warning label for idiots.
Oh because they didn't rescue you fast enough. Ridiculous. Not trying to argue that people are drunk and "can't think right". I get it. At some point people need to be responsible for themselves and not be able to sue for stupidity.

Anyways, I have gone on a few cruises and have ventured and wandered off by myself during the day and night. We didn't carry our phones with us so it was impossible to locate each other. We literally just walked around finding each other or I would spend almost 30-45 minutes going to rooms, bars, casinos, etc trying to find someone in our party or our meeting spot.

If I woke up and my cabinmates weren't there, I would assume they were already at breakfast or the pool. If I took my time getting ready, especially after a late night and then finally found them, it could be 9-10 am. Or if the others in our party didn't meet us at the pool right away, I wouldn't be pounding on their door at 8am. We just assumed they were off doing something else. It's vacation. We didn't call each other every morning to make sure they were awake. So I could very well see how if someone was out late, while others went back to the room, if they even shared rooms, they wouldn't necessarily notice them so called "missing".

I got sick on our trip and would sleep through dinner or go to bed early and would be out until morning. So if my bf didn't come back I honestly might not notice until morning unless I stayed up waiting or woke up and noticed. But where would I even begin to look that early in the morning? There's obviously so many possibilities depending on the situation but unless you're assuming your party is falling overboard, I would have to believe you aren't going to immediately call for a search party and alert the crew unless something suspicious happened.

Have they released any footage of her falling over like they did with Sarah Kirby. If they assumed she is deceased? Why did they do it in Sarah Kirby and not here? Dailymail has some good pictures of how high the railing is.

Probably because this is so new. Still being investigated.

DH and I cruise with Princess these days. Similarly to other lines, Princess now offers an "all inclusive" drink package. We've never purchased the package because we only drink wine with dinner and purchase a specific "wine package" on longer cruises (10+ days). To the best of my knowledge, there is no daily limit on the number of drinks allowed with the drink package. From the Princess website:

All-Inclusive Beverage Package

Take advantage of our All-Inclusive Beverage Package which includes any individual beverage item, such as soda, water, cocktails, spirits, wines, beers, coffee and tea, up to $10 (retail value). Bottles of wine are NOT included in the package; however, when purchased in bars, dining rooms or specialty restaurants, will be available at 40% discount from the menu price. Applicable to all bottles below $100 retail. Note: This package is available for consumption at all bars, public areas and dining venues (not room service and excludes mini bar items). Terms and conditions may apply.

In no way am I suggesting that Ms. Broberg was intoxicated when she fell off the ship railing. I'm sure her onboard account will be carefully reviewed to see what/when/where she purchased beverages and who served her. Bartenders are not supposed to serve individuals who may already be intoxicated.

(Hi there--by the way I'm still intending to follow up on our cruise related PMs :))

This is what I was thinking of:

http://www.cruisecritic.com/news/news.cfm?ID=5165

It does refer to the beverage package. But that article is from 2013. Either way, I'm not sure if it would have been for cost-cutting or for liability issues. Both?

(I can't imagine drinking 15 alcoholic beverages in one day but I'm not a good drinker at all.)

It is impossible to fall off of a ship unless you climb up onto the rails which is a stupid thing to do because of the very real threat of going overboard. Usually a person who falls overboard will end up under the ship and it and its engine propellers will pass over the person, suck them upward and shred them. It is due to the shape of the ship, the movement and pull of the water and wake of the ship.

It is sad that people are so carefree with their lives.

Of course, cruise ships are also chock full of hundreds of workers ( the one you don't see on deck) from 3rd world countries who can be of questionable character and thousands of passengers, some of whom can do evil things to innocent people who are drunk, tired or just wandering the decks alone at the wee hours of the morning.

I think this is a tragic result of someone who drank too much, strayed from her friends and decided to do something that she would not have done if sober.

JMHO

I think that WS proves that there are plenty of people living amongst us in '1st world' countries who are of questionable character. I'm not sure what's relevant here about the countries of origin of crew members. Or did I misunderstand what you're saying here?

Sarah Kirby's cabin mate was in the bathroom and they were talking back and forth and heard Sarah when she went overboard. She immediately notified crew. Captain insisted on searching the ship for ninety minutes before turning around.

I had a free "unlimited beverage package" on the Norwegian cruise I took in February. No limit.

I don't think she had a Carnival CHEERS beverage program because according to the fine print, you cannot get CHEERS until the 2nd day of a cruise out of (among others) Texas:

https://help.carnival.com/app/answers/detail/a_id/1106/~/cheers!-beverage-program

Her cruise left Thursday afternoon, she went missing 2:00 a.m. that night. CHEERS would have started on Friday morning at 6:00 a.m.

Also:

Program allows for up to 15 alcoholic drinks per 24 hour period (6:00am-6:00am); once the limit is reached, the guest will not be served ANY additional alcoholic drinks.

I'm not sure what you're basing this belief on. I'm not trying to be snarky, it just seems to me that it would be very likely someone committing suicide might rest up there a moment, say a prayer, whatever, then go backwards.

If they really thought it was an accident or suicide they'd have released the video footage by now. Seems they think it's murder.

FBI Investigates Death of Texas Mom Who Went Overboard on Carnival Cruise Ship

...The FBI's coordination with Carnival is standard procedure in a case like this, Special Agent Shauna Dunlap, a spokesperson for the FBI's Houston office, tells PEOPLE.

"We get called in whenever there is a death that occurs that is uncertain in how it occurred," says Dunlap. "The FBI is coordinating with Carnival on an ongoing death investigation."

A spokesperson for Carnival tells PEOPLE, "There is no foul play suspected here. Absolutely not." ...

It's still being investigated and the FBI is involved, nothing points to murder at all at this point.

Gee, wonder what's going on right now that people feel increasingly comfortable and virtuous making generalized statements about "others".:notgood: That one took me aback as well.....

I found a blog post from someone who was on the cruise and it made me cry. I can't imagine how the crew and passengers felt trying to find her and then knowing what happened
