You left out what they'll review presented by the PT:
Several backdated checks totaling thousands.
Cell pings of the tower closest to the gravesite.
Calls to QB posing as Joseph.
The truck in the video.
Chase's jailhouse recording.
Chase's growing alibi.
Chase's DNA in the Trooper on the driver's side.

100% agree.

The devil is always in the details, and those details aren't going away no matter what the DT does.

If they could do it they would have done it way before now during cross examinations, and in their extremely long, and boring CIC.

The PT has put forth plenty of evidence to prove CM is guilty BARD.

Even JSs list... though long..even he said he didnt list all of the evidence presented against CM that has been in the state's CIC.

I don't think it can be argued that this highly seasoned judge doesn't know what CE is when he hears it or how compelling he believes they are in this case or any other case he has presided over.

It's all those reasons he refused to dismiss this case plus other additional CE facts he said was entered he didn't list.

I think the QB activity and check forging are also difficult to explain. I can't fathom that Joey would give Merritt access to his money. Did Summer even have access to these things?

I wonder how the defense is going to explain the backdating and the call to QB. IMO, no reasonable person is going to believe in the alternative accounting and that Joey asked the two timed felon to call and delete QB because Summer had a spending problem. That is just preposterous, IMO. And we are to believe CM made the call to QB after he, CJ, and his daughter spent the weekend worrying about Joey. IMO

The majority of what the DT is throwing at the wall and hoping it sticks is preposterous and I'm confident the jury will see right through it. I would've liked to have been a fly on the wall in Merritt's apartment that weekend and the days after. How much did Merritt actually worry? Was he worried for his friend's well-being or was he worried about how he was going to pay rent at the end of the month?
 
Imo, JS gets it, and the jury who have been listening to the same compelling testimony against CM ...will get it too.

It's not a complex case to figure out the accused is guilty BARD as charged.

IMHO

If this is not that complex of a case to figure out, why are so many saying that they could see it ending in a hung jury?

I haven't seen hardly anyone commenting that they think it will result in a hung jury...unless you're referring to some of the L&C commentators (who IMHO are defense leaning anyway.) I have seen comments about the possibility of a mistrial - just mainly due to all the delays & defense antics.
 
Not only did the DNA not match the two timed felon, it did not match any of the McStays. That's kinda hard to explain, IMO.
Indeed. Yes there is no proof of SM being raped but for her bra being cut in two and her bleached pants. What would someone with common sense infer from that?

JM wrote checks on 2/4? Those checks were written on 2/5 and backdated.

CM wasn't at the Fallbrook house?
He was lurking early in the morning on that day or the day before.

No proof that he hated SM? Just listen to his interview with LE.

IMO, the DT has not successfully challenged one iota.

IMO, the PT has proven CM's culpability.

Could there be one or two hold outs? Of course. That's always a possibilty or there is a stealth juror, but I honestly do not believe that all 12 will vote NG. Imo, the best CM can hope for is a hung jury. Imo

Could I be wrong, and you are right ..that they are going to let a killer of two parents, and two little boys walk free? Absolutely.

I don't think he worried about any of it. He may have even felt relief. The deed was done. Lived life one day at a time, IMO.

It's the PT that was throwing stuffs at the wall from the beginning of the trial, having no idea what they had and hoping some would stick. Alas, not only didn't they stick to the wall, but they stuck to the magnets that the DT was playing with, and went on to serve the DT's case. :D:D:D

I guess we will see once the jurors decide on a unanimous verdict, unless it's going to end up a hung jury.
The DT have not really presented any evidence to deliberate with, only hearsay, IMO
 
For me, Agent Boles testimony was the most crucial testimony of all in this trial. He was so professional & well-spoken. And I love that he & the Prosecution mapped out Merritt's calls and notated with VR for victim residence, DR for defendant residence, MS for Metro Sheet Metal, etc. It paints a very clear picture for the jury of Merritt's calls and where he was when, and which direction he was traveling, and of course all the hours when his phone was unavailable/off/going to voicemail, etc. And the nail in the coffin were the phone pings near the gravesite. Can't beat that testimony with a stick.
 
I'm not sure if this is what Citygirl was referring to, but in Boles testimony below, he stated that Merritt's phone pinged twice - early morning - near the McStays on February 3rd. It's approx at the 52:00 mark.

Wow! Thanks. First pings at 8:31 am, and 8:34 am, very close. Then he starts heading up the 15.

I wonder why there hasn’t been more discussion of that.

I guess the best explanation is that he was down at the Pala casino picking up money to pay the rent, and his phone just pinged as he happened to pass by the McStays.
