this makes me think of that TX DA who "stabbed" the mattress over and over again in the murder trial of a woman accused of killing her husband - she's the famous one - can't think of her name now - will edit - but in closing what if they swing a bat 15 times?????

ETA:Texas woman who stabbed husband to death gets second chance at sentencing - CNN.com
Kelli Siegler re-enacted it in court. ugh.

That reminds me of a case where the DA in his closing statement (I think) slammed his hand on the table 7 or 8 times to represent how many times the victim was hit. I can’t remember which case. I just remember that because it had a profound effect on the jury- some members jumped when they heard the slams.

Hopefully someone knows which case I’m talking about. Regardless, I think that is a very effective method that sits with the jury before they go into deliberations.

You are a true professional at this Pommy, good to see you!

I’m so glad they weren’t though! Ever since the Caylee Anthony case judges are more cautious about it. That jury refused to find her guilty on anything (multiple available charges like child neglect, etc.) that would’ve led to a sentencing phase and more sequestration.

“Courts have generally moved away from sequestration during jury deliberation in recent years, and sequestration during the evidence portion of the trial is particularly uncommon.”

“Being sequestered means staying in a hotel with strict limits on your personal movement, on what you can read and watch, and on your communication with friends and family. The confinement and isolation can take a heavy toll on jurors as a trial drags on, ratcheting up the pressure to reach a verdict, according to experts. “People describe, initially, loneliness, boredom, and discomfort,” said Greg Hurley, an analyst with the National Center for State Courts. “That will convert over time for some people to a lot of anxiety, stress, depression, and generally negative feelings … You’re removed from your lifestyle: You’re not going to have your TV, your couch, your loved ones, your pets,” he said.”
How the Psychological Toll of Isolation Might Be Affecting Bill Cosby Jurors

“It’s rare. I can’t recall a North Carolina jury that has been sequestered. Based on the scarcity of appellate case law interpreting or applying G.S. 15A-1236(b), it seems that sequestration is not even requested very often. (Summaries of the relevant cases appear at the end of this post.) This Slate article asserts that sequestration “has fallen so far out of favor that judges rarely bother anymore,” because jurors don’t like it and tend to drop out of sequestered trials based on personal hardships.”
Jury Sequestration

The judge tightly controlled the media in this case and it’s not as insane as some cases. I think sequestration is terrible and causes jurors to rush decisions and even to decide not to find a defendant guilty of that would lead to more sequestration.

After the fact, I am liking that forever and ever in eternity, this has been one of the most detailed cases written in the media by tweets. And Then followed by articles which were posted immediately, and then updated for perhaps two or three days to get the entire testimony for it to be documented. It indeed is a new era.

For everyone to see, forever!

It backfired on Patrick who wanted to be very private and didn't want anybody to know and not have media coverage, but the no media coverage made the media step up to the plate, and do very very detailed step-by-step and blow-by-blow testimony for each and every person on the stand. Kudos.

Maybe he thought she’d be dead with one blow. People make that mistake. But if he had beat cows with bats before he’d know that’s not true.

But after 2 or 3 blows to the head it would be obvious that 15 were not needed.

Maybe many of them were to a different part of her body. He was determined to inflict maximum damage... not quickly.

Once at our HS baseball game a batgirl (picks up bats after batter hits) was hit in the mouth by the on-deck hitter (next hitter in order) standing off to the side. Knocked like 4 or 5 of her front teeth. It was accidental, not at maximum strength, and devastating all at once. Think what a grown man could do to a head using maximum strength... horrible.

This testimony is difficult for the #Berreth family. Her father is crying, prosecutors have teary eyes. At one point Dan May stopped questioning and asked #Berreth’s dad if he’s ok
@FOX21News

This is horrific.

I'm devastated for KB's poor dad.

He's being forced to listen to the graphic account of how his beloved daughter's body was beaten, and broken, and battered, while her savage killer sits blankly staring mere feet away.

Listening to how his daughter pleaded for her life, until her voice was silenced.

It must have been exceedingly difficult for the DA to call forth such testimony, knowing full well how traumatic hearing such graphic details would be to KB's dad.

Dan May: You're a Hero, Sir.

Thank you and the entire prosecution team for doing a yeoman's work throughout the trial.

Justice must be served.

Right?!

A little louder for the people in the back:

PATRICK FRAZEE TRIAL: Blood spatter 'absolutely' fits baseball bat murder
[...]

A bloodstain pattern analyst testified that blood left in Berreth's Woodland Park townhouse is consistent with the account of a grisly attack described on the stand earlier this month by Frazee's mistress.

"Oh absolutely," said the expert, retired police officer Jonathyn Priest.

[...]

Priest said a victim of such a beating could have been conscious beyond the first blow — enough to say "Please, stop," as Berreth allegedly told Frazee in seeking mercy.

[...]

Priest told the jury he wasn't surprised by gaps in DNA at the crime scene, given that Frazee's mistress allegedly used bleach to clean up afterward.

"To create this stain, that requires a significant blood source in order for the blood to flow in there," Priest said of the hardwood floor. "This is more than a drop of blood. This is a lot of blood."

[...]

The fact that she was hit by a baseball bat as many as 15 times doesn't necessarily mean that he beat her after she was dead.

I think it's actually much, much worse than that.

I think KB was alive for most, if not all, of those blows to her body.

He's Evil Incarnate.

JMO.

I agree with your assessment. Blood continues to flow while the heart is beating. It stops flowing when the heart stops. It then pools in the body. I think her heart was still beating while PF continued to bludgeon her. He was obsessed with inflicting as much pain and destruction as possible.

Kelsey fought for her life. She had a baby to protect.

I'm horrified... for what Kelsey endured, for her family, having to hear this.... he was alone with Baby K for HOURS.... we can be sure he was ignoring her....

There is just no humanity in this.

Just damn

It would be very stupid of a prosecution to state in opening that the jury will see something that doesn’t exist. I’ve never seen that myself.

I have seen the defense do that though.

Didn’t Jose Baez do that in his opening? Accused dad of sexual abuse and then never brought it up again?
