On October 31, 1975, the stabbed and bludgeoned body of 15-year-old Martha Moxley was found in the backyard of her family’s Greenwich, Connecticut, home. While the initial investigation brought forth several suspects, major strides would not be made in the case until the late 1990s and early 2000s, when investigators circled around the only person ever charged, tried, and convicted of Martha’s murder — her neighbor, Michael Skakel, a relative of the Kennedy family.

But Michael’s conviction was ultimately vacated in 2018 due to inadequate representation by his trial attorney, and to this day, it is still unclear what happened to the young woman. The first photographs taken at the crime scene, however, were able to give investigators key insight into the brutal slaying...

.Tommy later stated that on the night of Martha’s murder, they had a sexual encounter. Michael also allegedly later admitted that after Martha went home, he climbed into a tree outside her residence and masturbated in it.

I am thinking that with better DNA analysis available today this crime would have been solved quickly. Evidence from the above, as well as DNA on the golf shaft.

Connecticut Won't Retry Kennedy Cousin In Martha Moxley Murder Case

Connecticut prosecutors are closing the door on the 45-year-old murder case involving Kennedy cousin Michael Skakel, who was previously accused of bludgeoning to death his 15-year-old neighbor Martha Moxley in Greenwich.

Chief State's Attorney Richard Colangelo Jr. said Friday — exactly 45 years after Moxley's death — that the state will not seek a second trial for Skakel.

During a hearing in Stamford Superior Court, Colangelo filed what is known as a "nolle" — a legal declaration allowing for the case in question to be dismissed after 13 months, his office confirmed to NPR.

The decision comes after Colangelo's review of the case found that of 51 potential prosecution witnesses, 17 have died, making it difficult to prove the case beyond a reasonable doubt, his office said.

The tree is BS excuse for his um..DNA...being present. And he wouldn't need to climb a tree anyway, she was under the tree..where he left her..and his DNA.
What a shame. Bless her.

Been thinking of Mrs. Moxley and watched all 3 episodes of Murder & Justice (June 2019) in tribute.

The Moxley family had only lived in the neighborhood for a year when Martha was murdered. I don't think I'd heard this before. The Moxley home is long gone -- two homes exist on the property today. The Skakel home is still there and reportedly looks pretty much the same as it did 45 years ago.

Who killed Martha Moxley?

Since 1975, the tony neighborhood of Belle Haven, in Greenwich, Connecticut has been haunted by the death of Martha Moxley, a 15-year-old girl who was bludgeoned with a golf club.

Now, for the first time since Martha Moxley was murdered, her childhood friends Richard Burns and Tori Holland are speaking together to "48 Hours" correspondent Erin Moriarty.
 

I think Skakel is ill advised to open this case back up in any way. He served eleven years but should have been there much much longer. There is no doubt in my mind that he killed Martha.
I hope he gets caught in his own "web".
Sounds to me like he is going to march out all the old suspects - his brother, the tutor, the two guys in the neighborhood that did not live there etc etc
Is he just a self sabotage type guy, an attention *advertiser censored*, does he need the money ? What could his motivation possibly be. He got a "get out of jail free card" and now he wants to revisit the whole thing - foolish on his part IMO.

The arrogance of this man. The only thing that results from a civil rights claim is a judgement for $$$. This is an attempt for a cash grab, and hope it fails miserably. The residents/jurors should see through this facade. JMO

The new lawsuit alleges the investigator, Frank Garr, was intent on getting Skakel convicted and withheld key evidence about other potential suspects from Skakel's trial defense.

The defendants in the lawsuit “knew that there were other more likely suspects and that there was no probable cause to arrest and/or maintain a prosecution against the Plaintiff [Skakel], but continued to do so intentionally and maliciously, in order to convict a ‘Kennedy Cousin,’” the suit alleges.

The state attorney general's office, which is defending Garr, declined to comment Tuesday. A lawyer for Greenwich did not immediately return an email message. A message also was left at a phone listing for Garr.

Skakel's attorney, Stephan Seeger, called the lawsuit a civil rights action against Garr and the town.

If true, this will be a problem for the prosecution. Withholding evidence from the defense is serious, especially if the defendant is found guilty and is incarcerated.

The problem might arise if LE didn't include exculpatory evidence or information with discovery. Not saying he's innocent, but LE didn't always follow the rules back then.
