And that thing about Investigative Subpeona. I looked that up and it looks like they don't have to have anything but a suspicion to get one.
It has to be justifiable and legal to be approved by a judge. And judges tend to be pretty sticky about the evidence. Finally, cases where someone is clearly guilty get thrown out because the evidence is finally determined to be so flimsy (or deceptive) that it should never have been used to justify a warrant.
