Verdict is in! GUILTY of MURDER ONE - Hung Jury On Penalty Phase

Ryan Smith on HLN said this morning that the DA has already decided to follow through with the penalty phase and has given JM the go ahead. Did anyone else hear that?

I heard him say that, but afaik his comment was based on the statement released by the county attorney shortly after the hung jury was announced. The statement was this (bbm):

"We appreciate the jury's work in the guilt and aggravation phases of the trial and now we will assess, based upon available information, what the next steps will be. As of this point in time, the Court has set a Status Conference for June 20 and we will proceed with the intent to retry the penalty phase. Because, for purposes of a jury determination on punishment, this is still a pending matter, there will be no further comment."

Imo, they definitely have not yet decided whether they'll re-try it. Even if that's what they're thinking, they're not going to commit one way or the other at this early point.
 
I must be confused-the jury foreman voted for DP? I missed that if this was the case, because his interview makes even less sense to me.

It seems to me his vote must have been life. He says she was mentally and emotionally abused in his mind and that does matter to him, says it has to.
 
Yes, she sure did. Frail Jodi worked. Abusive Travis worked. and sadly our Juanderful did not work because we know this juror in particular found empathy for Jodi having to sit on the stand for 18 days.

I will never understand what this man said.

I think it's like this...imagine if someone came to you and said the young daughter of your neighbor commited a horrific, horrific crime where she stabbed her boyfriend to death. You would understanably be shocked, and WANT TO FIND A REASON AS TO WHY. What happened, did she snap? Did she have a mental breakdown? And keep in mind you had never heard anything bad about this girl, and she seemed really sweet and innocent. SO SOMETHING MUST HAVE GONE WRONG.
 
I can understand the foreman's statement about connecting the brutality of the crime when looking at Jodi. Sometimes I look at her and I just can't believe she slit another person's throat. Just imagine what it takes to do that to someone?
 
She sounded choked up to me, too. I would even go so far as to concede fighting back tears. Would be perfectly acceptable if she had been oh say a spectator. But if she couldn't hold back her emotions, a few terse words until she could compose herself would have been more appropriate.

She was emotionally exhausted as well but we count on the judge to be no nonsense, impartial and composed. Again, JMO.


Oh my gosh. Sounds like she will not give Jodi LWOP. For whom was she emotional for, me thinks Jodi. moo

While I understand the disappointment and the emotion behind it, attacking the jury who gave almost 6 months of their lives to working through this whole mess is WRONG. Put your emotions to GOOD instead.

No one is attacking the jury. I think they sucked but I am not "attacking" them. Just like the jury we are entitled to make a judgement call. JMHO. :)

No. This would be horrible. It would be so warped with political correctness and just simply politics that there would be no hope of true justice. Just look at our "professional" legislators these days!

I think our justice system still has great potential, but one change needs to be made... Get rid of UNANIMOUS decisions. Seriously, there are just too many biased people (we are all biased in some way or another), with their own histories or agendas. All jury verdicts should be decided by a 3/4 vote. 8 out of 12 should carry a verdict. And I'm not saying that because that happened to be the split this time. It would prevent the mistrials from the majority of hung juries. It would reduce the jurors who later claim that they were pressured to vote one way or another. But it also still protects from a person's fate being decide by a simple majority, 50/50 split, coin toss.
 
Looks like in light of the foremans comments ALV has found her place... A new career as a hired gun.

IMO, ALV was not believed, the texts and voicemails were believed but they were out of context
 
Beth still talking about the trial will be starting in July. Does not everyone know that Juan the prosecutor has another trail ..that it's beginning in July. I'm surprised the mainstream media has not learned that yet . they need to be reading here more often!

we should start a pool on when this starts again, IF it starts again. i seriously doubt anything will happen in july. how many continuances were there before this ever got to trial? it took almost 5 years!!

with the heat of the case so fresh, i think the DT will, once again, try to put the skids on the whole process, definitely ask for a change of venue, and anything else they can come up with to delay the whole thing.
 
YES I AGREE. This was not a jury of her "peers." Also, I think for older people it's harder to put to death a younger person. MOO. I think age did play a part in this.

I don't want this to come across as an insult or anything. It is not meant that way.

This is MOO. When I saw the jury getting on the bus after the verdict I was stunned to see the age demographics. To me they looked like they were getting on a seniors casino weekend bus. Honestly, that was my first thought and my second was that may have been part of the problem there. That generation may not "get" how relationships are these days or how people text each other. They may have looked at Jodi as somebody who could be their daughter.

Bingo. Totally agree. If the foreman wasnt going to play ball, what chance was there that the jury would be anything but hung? Now the deadlock after one hour thing makes incredible sense.

Good luck to this guy. I hope he feels he explained this to the best of his ability since he chose to go on camera with his version.

Professional juries would violate the right to a trial by a jury of one's peers.
And honestly don't you think after listening to a number of brutal cases that these professional jurors would become desensitized? And maybe compare one trial to another? As in "well this case isn't as bad as the last one I was a part of and we didn't give them the DP so we shouldn't here".The problem is the exclusion of relevant evidence in order to somehow protect the defendant...ie too prejudicial. :moo:
 
This is exactly why her best shot was with this jury. The strategy backfired, and they hung. The next one will put her down -- precisely because they wil not be near the contagion long enough to become infected.

You know that eject button on JW's seat that propelled her 10ft in the air whenever she objected? The jurors needed that for JA's chair during her eternal testimony. I would have been pressing the "eject" multiple times per day.
 
This is perfect! In fact your whole post is perfect! And again just another reason why this country should have professional juries!

As soon as you have professional juries you will have corruption. It would never work as well as the 'duty' option.

I was looking very forward to hearing their thoughts but felt confident that "abuse" would not have been coupled with "-ive" by any stretch of the imagination when talking about TA. I.e. "She totally lied about the abuse but we couldn't kill her because she's a sick puppy vs. we had to consider that he was mentally and verbally abusive." (<--just typing this makes me ill).

I was stunned by the hung jury outcome but not surprised. The rationale, however, actually surprises and horrifies me because of the double standard. If the jury had seen photos of JA decomposing after being slaughtered like an animal, there is no doubt in my mind that Travis would have been UNDER the jail. No matter what purportedly "abusive" IM's she had sent.

She will still be adequately punished no matter the outcome, but I just hate that her machinations had any effect at all on otherwise reasonably minded people.

I agree with everything you said. There will be motions galore. In the meantime the convicted murderer will be working the media through her "spokesperson" and her media friend, and losing more weight to look more frail.
