10.45am: The day will commence with a closing address from barrister Michael Byrne QC, for the accused.
He opened his address with the aid of a power point slide.
11.49am: Mr Byrne told the jury in his closing address, there was, on the evidence, “a complete absence of a crime scene” at the Baden-Clay home on Brookfield Rd at Brookfield.
1.01pm: Mr Byrne asked the jury to consider the evidence of transportation of the body, including the absence of mud in the Captiva, on the wheels of the car, on shoes, around the house or on Gerard Baden-Clay’s clothing.
3.15pm: Barrister Michael Byrne QC, for the accused, continued his closing address to the jury.
He said insurance policies were taken out in respect of Allison and Gerard Baden-Clay.
4.40pm: Mr Byrne took the jury to the evidence of GP, Dr Candice Beavan, who agreed in cross-examination the marks she saw on Baden-Clay’s face looked similar to injuries that would be seen in a shave biopsy

Gerard Baden-Clay Trial Live Coverage: Day 15, Week 5

Date July 7, 2014 - 10:00AM

4:48pm Wrap: This afternoon ...

Defence counsel Michael Byrne QC continued his closing address to the jury, focusing on three key points.

The scratches

Mr Byrne said the scratches which appeared on Mr Baden-Clay's on the morning he reported his wife missing could not be relied upon to convict his client of murder. Mr Baden-Clay has dismissed the injuries as shaving cuts, although four forensic experts have told the court the abrasions are more consistent with fingernail scratches. Mr Byrne said expert forensic witnesses could not rule out that the injuries were caused by a razor.

"You will not be satisfied that razor scrapes cannot be excluded and that would be the end of your consideration of that piece of evidence," he said.

The depression

Mr Byrne pointed to evidence from forensic psychiatrist Dr Mark Schramm who reviewed Mrs Baden-Clay's medical records. Dr Schramm said Mrs Baden-Clay may have been on the verge of a relapsing into depression after the revelation of her husband's infidelity.

Mr Byrne said Mrs Baden-Clay may also have been disillusioned by the birth of her nephew in Canada because she had wanted to bear a son to continue the Baden-Clay name.

The alternate scenario

Mr Byrne also painted an alternate scenario for the jury, one in which Mrs Baden-Clay went for walk in the very early hours of April 20, 2012, to "clear her head", but became disorientated and kept on walking.

"And at some time and for some reason she ends up in the river," he said.

Gerard Baden-Clay defence says he does not know how Allison died

The Australian|
July 07, 20146:46PM

POSING a series of “what ifs”, Gerard Baden-Clay’s legal team has asked a Queensland Supreme Court jury to consider if his wife could have drowned, fallen or jumped from a bridge to her death.

Mr Baden-Clay has pleaded not guilty to the murder of his wife on April 19, 2012. He says he went to bed that night at around 10pm, leaving Allison Baden-Clay sitting on the couch watching television. Her body was found 11 days later, dressed in walking clothes, on the muddy banks of Kholo Creek, nearly 14km from the Baden-Clays’ Brookfield home in western Brisbane.

Barrister Michael Byrne QC, for Mr Baden-Clay, has spent today delivering a closing address to the Queensland Supreme Court jury in Mr Baden-Clay’s murder trial.

Byrne tells jury they can't ignore evidence for Crown's sake

Rae Wilson | 7th Jul 2014 10:58 AM Updated: 4:32 PM

GERARD Baden-Clay's lawyer has argued an "unplanned spontaneous eruption of murder caused by emotion with the Footsy Show as the background is just as unbelievable".

Defence barrister Michael Byrne also said any notion his client had killed his wife because of financial pressure was "ridiculous" and that convicting Mr Baden-Clay for his infidelity was not acceptable.

He told the jury they could not make links or ignore certain evidence to fit with the Crown's theory.

"You do not ignore evidence, you don't make excuses for the complete absence of any link between Kholo Creek and the house at Brookfield road because Allison's dead and someone must be punished," he said.

"Our system presumes people to be innocent unless the evidence overwhelms other inferences."

Gerard Baden-Clay Trial Live Coverage: Day 16, Week 5

Date July 8, 2014 - 10:00AM

Wrap: This afternoon ...

* Crown prosecutor Todd Fuller QC continued his closing address to the jury.

* He spoke of the scratches which appeared on Mr Baden-Clay's face on the morning he reported his wife missing. Mr Fuller said the scratches were "damning" and linked the real estate agent to an act of violence "without a doubt".

* Mr Fuller also spoke the pressures on Mr Baden-Clay's life at the time of his wife's disappearance - the pressure from his wife, his long-time mistress Toni McHugh and his flagging business.

* He also showed the court pages from Mrs Baden-Clay's journal indicating the mother-of-three longed for the love of her husband and was determined to make her marriage work.

"I would give anything if my partner would love me and make love to me," Mrs Baden-Clay wrote in 2010.

"I am afraid of losing my marriage - being a single mum - my husband leaving - my marriage failing."
