Bill Cosby back in court before retrial, loses bid to dismiss sexual assault case

NORRISTOWN, Pa. — A day after Hollywood's first Oscars of the Me Too era, Bill Cosby went to court Monday seeking to get his sexual assault case immediately tossed out, but the judge rejected his bid.

His lawyers next turned to trying to stop some of his dozens of accusers from testifying at his April 2 retrial.

On the first day of two days of pre-trial hearings, Cosby's lawyers argued that telephone records, travel itineraries and other evidence show the alleged crime with which he's charged couldn't have happened when prosecutors say it did.
[.....]
Judge O'Neill also dealt with a skirmish involving the two sides: He put Cosby's team on notice after they falsely accused prosecutors of hiding or destroying evidence in his sexual assault case, and he rejected the prosecution's request to throw Cosby's new lawyers off the case.
[....]
They (Cosby's lawyers) said they would seek to delay the retrial if any of the women were allowed to testify so they could have more time to investigate their claims.

Jury selection is slated to begin March 29.

Judge shoots down defense efforts to derail new Bill Cosby sex assault trial
by Tracy Connor

NORRISTOWN, Pa. — Bill Cosby returned Monday to a Pennsylvania courtroom where a judge rejected attempts to scuttle a new sexual assault trial and began hearing arguments that will determine how many women can take the stand against the actor.

The two-day pretrial hearing was Cosby's first public appearance since the death of his daughter Ensa last month, and he stood to accept condolences from Montgomery County Judge Steven O'Neill...

Not saying BC should not pay a price for his actions, but should he be jailed, society is going to be footing the bill to take care of him as he ages. By the time this trial is over, he could be 85 or more. Something to think about.

Bill Cosby will face up to 5 other accusers at second trial, judge rules

It won't be just Andrea Constand on the stand next month accusing Bill Cosby of sexual assault. The judge presiding over Cosby's retrial ruled that up to five other accusers of the former "America's Dad" will get to tell a jury he drugged and/or raped them, too.

The prosecution team wanted to call 19 other accusers, some of the five-dozen women who have come forward since October 2014 to accuse Cosby of drugging and/or sexually assaulting them in episodes dating back to the mid-1960s.

At the first trial, O'Neill allowed only one other accuser to testify that Cosby assaulted her in Los Angeles in the 1990s.

The result: A hung jury after an 11-day first trial in June 2017. The jury deliberated for five days but failed to reach a unanimous verdict on three charges of aggravated sexual assault. At least one juror said afterward that the problem was "not enough evidence."

Now Cosby is to be retried on Constand's accusations starting April 2 in Norristown, Pa., with jury selection to begin March 29. The Judge has already ruled against Cosby on a number of his pre-trial motions to dismiss the case.

So.... he’ll spend less years in jail than a younger rapist. Wish he was caught years ago, but I don’t get where his money comes into it, except he’s spent loads to avoid justice for years.
Hopefully civil suits will drain his bank account dry eventually. But yeah, he belongs in jail, ASAP. Long overdue.

Bill Cosby's next sex abuse trial will be much more than a rerun
Bill Cosby's retrial will be a big departure from the legal drama that ended in a hung jury last year.

Some things are the same: the famous defendant and his key accuser, the prosecutors, the judge and the Pennsylvania courtroom.

But the second trial of Bill Cosby on sexual assault charges is shaping up to be far different from the first, which ended in a mistrial last June with a hopelessly deadlocked jury that could not agree on whether "America's Dad" drugged and molested Andrea Constand at his home in 2004...

Anyone know if this will be live streamed or tweeted?

TIA!

If found guilty and no jail time, what should the punishment be? Just curious....

The government waists money on all kinds of needless things like the "Bridge to Nowhere" but I will gladly let my tax dollars go to locking up and institutionalizing people who are convicted and deserve it.

Cosby’s strategy hinges on judge his team attacked
Michael R. Sisak, Associated Press

Norristown, Pa. – Bill Cosby’s lawyers first pressured the judge in his sexual assault retrial to quit, and now they are counting on him to make rulings critical to their plan to portray the accuser as a greedy liar who framed the comedian to get rich.

Judge Steven O’Neill could rule as early as Friday on whether the defense can call a witness who claims Andrea Constand spoke about falsely accusing a celebrity before going to police with allegations Cosby drugged and molested her at his suburban Philadelphia home in 2004.

Prosecutors said the theory that Constand wanted to set Cosby up is undermined by his testimony in a 2005 deposition that she only visited his home when invited and that he gave her pills without her asking...

BBM. Marguerite Jackson is the lady who claims Andrea spoke to her about an idea to falsely accuse a celebrity. The question I have: Why didn't Marguerite come forward with this claim during the civil case, 13 years ago?

Im going from memory of watching BC in some attorney deposition or something and from his own words I know he is guilty of the charges because if I remember right he actually admitted to giving the woman prescription drugs which were most likely qualudes on at least some of the occasions.

First it is a federal offense to give anyone your own prescription medicine and secondly he knew fully well that a qualude will knock someone totally out especially mixing with alcohol.

When he claimed it was just to make them relax or whatever words he chose it was words full of deceipt IMO because he knew full well it would incapacitate them and then he would do whatever he wanted with them.

He is a sick deviant arrogant person IMO and for his SO to stand by him makes me sick. Reminds me so much of the SO of Jerry Sandusky. As they proudly walk side by side with someone that I assume they know the truth and dont care. :cuckoo:

Cosby retrial set to begin and #MeToo will likely make an impact, experts say
One initial test of #MeToo’s impact will be jury selection.

When Bill Cosby’s retrial on sexual assault charges begins next week, legal experts expect him to have a harder time making his case because of something that happened since a mistrial was declared nine months ago: the #MeToo movement.

The man once labeled “America’s Favorite Dad” faces a retrial on three felony counts of aggravated indecent assault for allegedly drugging and sexually assaulting a woman at Cosby’s home outside of Philadelphia in 2004...
