im hardly an expert on legal matters or the sex trade, but my non-expert belief is:

1) solicitation means buying an illegal act, not doing the illegal act IIRC

2) it is common for sex workers, who don't want to be caught in a sting, to ask for proof that a person is not LE. Exposing oneself would That, since LE would not do that while intending to arrest.

a. I think the undercover asked Burke to prove he was not a cop (but did not ask him explicitly to expose himself) in order to appear more realistic as an undercover.

The wording was confusing because the payment arrangements have not been disclosed.

It is quite possible that Johnny Pius III was murdered by an adult. We really don't know since the investigation was so tainted.

That occurred in Smithtown. Smithtown is in Suffolk County.

Massepequa Park is hardly far away in Nassau.

I can't think off hand of a "gimme" for their knowing each other before adulthood for similar illicit recreation interests.

Rex testified to being involved in competition rifle, though when and where? Idk. Reportedly, he had to get home from school to mom.

I don't know if they were both Catholic and doing Catholic kid things?

James Burke was reportedly a low-level criminal and marijuana enthusiast in his HS years.

The not-wild speculation is Jimmy Burke, a young JD-type, got off of some minor charge by helping Spota, a young prosecutor, close the Pious case. And he did it really well, a fantastic lying states witness. (We can add child abuse to Spota's rap sheet-you don't teach children to crime better for your own convenience.)

The park police recommended charging Burke, 58, with offering a sex act and fifth-degree criminal solicitation in addition to public lewdness and indecent exposure. County officials announced Burke's arrest and the four charges at a news conference last week.

But the county dropped charges of offering a sex act and criminal solicitation after discussions with Suffolk police detectives, Suffolk County spokeswoman Marykate Guilfoyle said Tuesday.

Suffolk District Attorney Ray Tierney’s office ultimately charged Burke with public lewdness and indecent exposure, court documents show. Officials also confirmed the dropping of the two charges.

I hope it's one of two things.

I hope the County got something useful in exchange.

Or, in the spirit of fairness to this despicable ex-cop, I hope there was reason to believe Burke didn't know the undercover was posing as a sex worker and sincerely thought the undercover was just friendly.

But mostly, I hope the first thing. I hope Burke had ooodles of something with a street value on him that could have gotten him locked up, and Burke decided to give investigators something of value up to stay free.

The source for the article is John Ray and is mostly quotes/statements/ allegations from him. It's fairly wordy but an interesting read.

It also strikes me after reading about all this child *advertiser censored* etc stuff re Burke, that the Burke Spoto relationship may perhaps have been "sexual" in nature - beginning when Burke was only 14 yrs old, with Spoto "grooming" him etc and that is why the tie is so strong. I don't know much of anything from that time period so obvi just my specualtion.

See snippets from the article below - Ray alleges childporn was taken from Rex's house - not confirmed by LE - and Ray wonders if there are ties between the Rex and Burke.

After reading through this piece - if some of the claims have any validity, it would seem that Burke needs to stay as far away from the investigation as possible so not to taint it. Also an independent investigation should be opened to look into Burke. Otherwise I can see Rex's attorney using Burke and his obvious deviant proclivities - which were totally unchecked it seems - to" muddy" the waters. Hopefully there are not any of Burke's "guys " currently working on the task force as those optics could be fuel for Rex's lawyer also.

Do you think then that his arrest was a chance for LE to gain information, or something else, from him regarding the RH case, in return for reduced charges? MOO.

I doubt any of Burke's guys are on the task force.

I'd be more worried about someone becoming one of Burkes guys, perhaps unwittingly. For example, by falling prey to one of Burkes guys pretending to be a journalist buying leaks for a high price for a book they promise won't be published until the case is adjudicated. Or some such scam.

It is far more than a "claim" from John Ray that there were decades of corruption in SCPD. Burke already did time for what is well established. Spota and McFarland are still locked up.

The Sun is The Sun, fwiw, but John Ray is John Ray. One of the few people who brought us facts about LISK, especially in regards to Shannan Gilbert's Murder.

Maybe it's more wishful thinking. But yes. I'm hoping the rumors of drugs being part of the story are true, and Burke had serious charges before him, worth some serious talking by him.

"There was a showing of a snuff film in the police department, presumably for evidentiary reasons," Ray told the Sun on Monday while citing an unnamed source in the police department. "And Burke was there, and he was giggling.”
