Braunschweig - Day four in the trial against Christian Brückner (47), and again there was a riot. Now the prosecutors are backing!
The two prosecutors commented on defense requests. And made heavy accusations against the lawyers of the man who is said to have kidnapped and murdered little Maddie McCann (then 3) in 2007.
Defender Dr. Friedrich Fülscher (39) had requested that two texts written by the defendant and found on a USB stick during a search in 2016 not to be allowed as evidence. The reason for the search was fake in order to find evidence in the Inga case. In addition, a file was only created four days after securing the USB stick.
According to Chief Prosecutor Vanessa Beyse, the search was necessary: On the defendant's property, it stank after decay. The police officers would not have known whether they would find human or animal remains.
In fact, they dug out Brückner's dead dog - and a Lidl bag with data carriers, on it child *advertiser censored* and the controversial texts. "Undoubtedly pure coincidence," says Beyse.
The public prosecutor's office requested that all applications of the defenders Dr. Fülscher (r.) and Prof. Bock (l.) to reject
The accusation that the text file was only created after the seizure really got the prosecutor's attention.
The defense meant "seriously that after the seizure some official invented the story and put it on the USB stick". In fact, Brückner had the text in which a first-person person fabulates how he kidnaps mother and daughter and abuses them in the most disgusting way, years before in his e-mail inbox. The accusation of defense is a "consciously defamatory and defamatory claim of state investigative authorities".
Brückner's defender Dr. Friedrich Fülscher (39), for his part, rejected the accusation that he had accused police officers of having written the text. He was concerned with the date of creation of the file, not the text itself.
There was also an explosive response to a second request from the defense.
The defense wanted to hear an expert as a witness who doubts an expert opinion from 2019.
In it, a hair on the bed of the raped American Diana M. (then 72) had been assigned to the defendant, which earned him seven years in prison. The public prosecutor's office rejected an interrogation of the witness - and quoted from the statement of an ex-crackis who was in custody with Brückner. He claims that Brückner had in prison about two rapes he committed in Portugal. One of them was a woman about 70 years old.
And the prosecutors rejected two more motions from the defense.
An ex-BKA official who wants to have been squeated by Brückner's cell, and also Chief Prosecutor Beyse herself cannot be heard as a witness, according to prosecutor Ute Lindemann. Both facts have nothing to do with the current trial - but with the investigation into the Maddie case. With the application, the defense "only wants to investigate whether there were investigative measures in other proceedings, the result of which the defense would like to know," says prosecutor Ute Lindemann.
The court must now decide on the applications. The trial will take place on the 3rd. April and should last until the end of June. As a precaution, Judge Uta Inse Engemann asked all parties involved to name free dates by the end of October. »
