ID - Kenneth and Kenna Guardipee, Devin and Aiken Smith, all fatally shot by neighbor, Kellogg, June 2023

I must be blind…. What’s the agreement? What’s his sentence I mean….
Sentencing hasn’t happened & isn’t yet scheduled. All four first degree murder charges were mediated down to four second degree murder charges. Additionally, the felony burglary charge (entering the duplex to hunt down & slaughter the last two victims, including the minor child) will be dropped.

ETA: the State very quickly announced it wouldn’t be seeking the death penalty on the four first degree murder charges on 6/21/2023 (the murders were in the evening of 6/18/2023).

Generally when accepting an agreement, the sentencing terms are known? Or am I wrong on this?

I am going to need time to process this. I want to support the victims' family and if they feel this is the right move then I can't be too angry but I feel like until sentencing and we know the penalty Kaylor will face it is hard to know if this will seem satisfactory.

Very disappointing. IMO, this was not in any way a second degree charge. Maybe the first murder, but not the other three.

So, this court is now sending the message that vigilante justice is a-okay with them.

MOO

To me, this most probably alludes that there was either background information that the victims family is not interested in making public. Oh well, I think we should respect that.
Not to me — the irony isn’t lost on me that from the beginning, the victims’ surviving family members have extended infinitely more grace to the murderer (and his children) than he gave to each of his victims. Such a stark contrast!

But if your theory is accurate, then the fact that sentencing remains unaddressed could well blow up in their faces & revictimize them, based on the Mediation Settlement Agreement.

IANAL, but it’s possible a Rule 11 Plea Agreement addressing sentencing might still be forthcoming. It would then be up to the judge to accept or reject it. I’ve seen pleas rejected in Idaho, sometimes because the plea was too lenient & sometimes too harsh. Only time will tell. Deep sigh.

(edited to fix unclear plea thought)

Notice of Hearing - change of plea

Prosecutors did not set any sentencing guidelines as part of the plea deal, and the agreement instead says that all involved parties "shall each retain the ability to argue openly at the time of sentencing for any sentence which said party deems appropriate."

The sentences for first- and second-degree murder are largely similar in Idaho, with each carrying a minimum sentence of 10 years and a maximum sentence of life without parole.
