The big issue centers on where 11-month-old Mercedes Lain was killed. The coroner ruled her death a homicide yesterday, but if she was killed outside of Marshall County, there would be some jurisdictional issues.

However, Prosecutor Nelson Chipman says there are some jurisdictional issues that have to be worked out.

"Right now, there is a split of opinion as to what’s the proper venue if we were to upgrade the charge. I don’t think it takes much for you to realize from the affidavits and so forth that there are events here, there are events in Saint Joe."

While court documents don’t establish exactly where Mercedes was killed, if it happened in Mishawaka, it would technically fall under St Joseph County Prosecutor Ken Cotter’s jurisdiction.

Anderson sent a letter to the Marshall County Prosecutor Nelson Chipmanand asked him to investigate Child Services. The letter said in part that “another child has fallen through the cracks of the broken system.”

Chipman told I-Team 8 he has no intention of pursuing an investigation into Child Services because it’s “not in his jurisdiction.”

Anderson says she plans to send the letter to U.S. Rep. Jackie Walorski, a Republican from Elkhart, as the petition continues to grow.

I'm not FrostedGlass but I found the answer to your question and it says TRANSFER VENUE. Hmmmmmmm.......are they going to St. Joseph county?
