Seems to me TB has never flinched -- she wants a jury trial-- or she's holding strong not to be released, yet.

I think these kids must be afraid of federal indictments. I also think the group-think was to kill NB over this fear. Otherwise, I don't understand how 4 others would participate if this was only about the death of Hanish.

MOO

.
She can't be released now because she's still serving time for a Star City area burglary she and one of her associates committed. Her earliest release date from Rockville is 03/05/2021. Then, we have this:

12/22/2020 = Order on Hearing
Order Resetting PTC for 2/8/21, Remanding Deft to Custody of NC Sheriff During Pendency of this Cause - Once Deft is Released from DOC, She is to Remain in the Custody of NC Sheriff with a $25k Bond w/10% Permitted

After reading through TAB's case summary beginning March 2019 for the charges of assisting a criminal, I'm convinced that the defendant is feeling no urgency for her case decided or to leave jail. With the exception of replacing her lawyer last Sept, the defense seems to be responsible for this case continued and still no trial date. I'd also like to know what the defense was holding that caused the State to demand they produce the docs/discovery within 30 days.

It's a competition between Mathis and Beckley for extended stay points. I think Beckley's the wildcard. I wonder what if any news will result on Monday?

She has to run out her jail time in Rockville; maybe conditions are better for her in the Newton County jail? I'm assuming the time she has been serving in Newton counts toward her prison sentence. She knows she can get out on bond as soon as her time ends in Rockville if she can come up with the money. She's sure no stranger to the system so what would be the most advantageous to her?

Maybe she needs some free time on the outside to do whatever. She probably knows how far out trial dates are being scheduled.

Once they pick a trial date, won't there be a time period where she can enter a plea?

Sure, she can strike a plea agreement at any time. I've seen deals announced on the day of the opening statement.

I recall seeing Beckley in court-- giving a shout out to her daddy that was in the gallery. I've wondered if she might be the type of offender that enjoys a close relationship with her family during incarceration because she's clean and sober -- which does not appear to be the case whenever she's outside. And Mathis too that couldn't stay away very long.

A plea deal was made in the Star City burglary; she ended up with the same number of days sentenced for 2 charges but the projected release date differed by 6 months. She had a 9/03/2020 projected release date on the possession of meth charge and a 3/05/2021 projected date for the burglary charge.

On 8/18/2020 she filed a motion for jail time credit and on 9/02, the court replied:
Court having considered both Defendant's request and State's Response finds the Plea Agreement gave specific credit days. Court may have indicated belief that time would start but DOC calculates time, not the Court. hr
That was probably a really bitter pill for her to swallow. Maybe she's not trusting plea dealing for the time being.

On 8/31, she also filed this, which I assume is this case with a couple numbers omitted. I wonder what was in it.
Correspondence to/from Court Filed
Defendant, pro se, files a letter regarding case number 56D01-1904-F5-0041. jt (E-Notice Gaumer & Probation)(copy CCS Beckley)

Then there was the issue with a restraining order, which the court removed when the victim did not reply to the letter sent by the court.

  • #659
The time served calcs are a very touchy issue, and I'm not surprised at the response by the court to defer to the DOC for the calculation.

I recall the headlines after Colorado DOC Director Tom Clements was slain by an inmate released earlier than calculated.

  • #660
Sorry - I'm confused - o_O So on the felony count of assisting a felony - she got time served - or some burglary & possession charges? I don't have those charges on my notes, so not paying attention to those. Anything on the felony charge?

TIA! :)
