Defendant Beckly fails to amaze me. By all accounts, the safest place for her is behind bars where she appears to keep compliant and has many friends. Freedom is definitely wasted on her and when she's out, her court appearances are no different than the due date for a library book! By failing to appear in court today, she willingly violated her bond conditions-- forfeiting the bond and is now subject to a bench warrant for her arrest. She must be betting on her plea agreement for "recovery" insurance and convinced herself not to surrender any earlier than absolutely necessary -- in this case -- when the warrant reaches her. How painful for the Bowen family to know that she's out walking around. MOO

I wondered if Beckley got ticked-off because her new attorney failed to subpoena the toxicologist at the last court date. Maybe she knows how much time she's served and feels the whole thing is a bunch of nonsense?

Her sentencing is still on in Newton Co for the 26th.

So... with that bench warrant out for Beckley - did they find her & will she show up for her sentencing (Nicole) on Wednesday??

Her sentencing is tomorrow and if she shows up, that should put a hold on her for the warrant.

Pulaski Co. has her owing $2603.20 for court costs and filing fees plus a fine of $1.00. I don't know when that was added to her case.

Of little interest to anyone but me :D, that other person we're aren't following anymore (CM) still has active warrants.

But CM promised to testify against Kirts in the Charles Hanish murder case - didn't he - was part of his plea deal?
Have you checked White County yet for Kirts case on that? They were waiting for the Newton County case to wrap up - which it has.

I don't remember a case being opened for Hanish. The only cases I find for Kirts in White Co are criminal misdemeanors.

White County White County Prosecutor Bob Guy confirmed that he’s waiting for Kirts’ trial to wrap up in Newton County before filing any charges connected to Ray Hanish’s death in Reynolds. He declined to give many details, other than to say witnesses tied to the Newton County death of Nicole Bowen have cooperated in the White County investigation too. Alleged cause of death asphyxiation.

Maybe the Prosecutor Bob Guy hasn't got around to it....

I fear Prosecutor Bob Guy may have spoken too soon. I think these cooperating witnesses are addicts and liars that when push came to shove, could not pass the polygraph for the details they provided. Deja vu...

I recall RH's mother was meeting with the prosecutor last January and seven months later-- crickets. MOO

Monday, July 26th:

*Sentencing Hearing (Nicole’s case) (@ 10am CT) – IN – Nicole Lynn Bowen (30) (missing March, 29, 2019, Jefferson Township, Newton County, found March 30, 2019) – for *Talitha Ann Beckley (36/now 38) arrested (4/5/19) & charged (3/29/19) with felony count of assisting a criminal. Plead not guilty. $25K bond. In Rockville Correctional Facility; earliest possible release date: 3/5/21 serving time for a burglary. 12/21/20: Once released from DOC, she is to remain in custody of NC Sheriff & begin her case in Newton County. Bonded out $2500 cash on 3/8/21.
Trial was set to begin on 7/26/21 was vacated as Beckley agreed to a plea deal. Sentencing on 7/26/21.

Sentenced on 6/9/21 to 48 years for Murder, 30 years for conspiracy to commit murder & 3 years for assisting a criminal - charges run concurrently. Earliest possible release date: 4/16/2056.
*Garrett Kenneth Kirts (21/now 22) – Newton County: Nicole’s Case. 9/4/20: Plead guilty. Sentenced on 1/11/21 to 55 years in prison.
*Christopher Channing Mathis (27/now 28) – 9/18/20: Plead guilty & sentenced to time served (912 days). Out of jail. Cooperating with White County on Hanish case.
*Jasmine Nicole Parker (34/now 36) – 10/8/19: Plead guilty. According to the plea agreement, Parker also will serve four years in prison for being a habitual offender, based on felony convictions in 2018 for unlawful possession of a syringe in Jasper County & in 2004 for burglary in Tippecanoe County. Earliest release date 1/4/23.

I found this news about Talitha Beckly buried in the sentencing report for Ashley Garth -- probably explains why she's on the lam. They told her in advance that she's facing 8-12 years! (Plus - habitual offender sentencing enhancement is non-suspendable and mandatory incarceration).

Garth sentenced to 48 years in prison for murder

June 29, 2021

In related news, on June 28, 2021 a change of plea hearing was held in the matter of State of Indiana vs. Talitha Beckley. Beckley is charged with assisting a criminal for covering up the murder of Nicole Bowen in March of 2019 as well as being a habitual offender.

Beckley told Superior Court Judge Daniel Molter that she had knowledge of the murder of Nicole Bowen and did not come forward until a warrant had been issued for her arrest and she turned herself in on April 11, 2019.

Molter found that there was sufficient factual basis that Beckley had assisted Garett Kirts by concealing the murder and that Beckley has two prior unrelated felony convictions.

The matter has been set for a sentencing hearing on July 26, 2021 during which Judge Molter will sentence Beckley to between two and six years for the assisting conviction and will enhance the sentence by an additional two to six years for the habitual offender enhancement for a total range of 4 to 12 years incarceration. The habitual offender enhancement is non-suspendable and is mandatory incarceration.

Newton County Prosecutor Jeff Drinski has indicated that he will seek an 8-year sentence in the Indiana Deparment of Corrections at sentencing.

Usually they state the terms in the plea agreement, don't they? If the plea was left open for the judge to decide on, what incentive would Beckley have to accept it?

I think the incentive for TB to take the plea is to avoid a trial, and that the prosecutor is recommending a total term of 8 years incarceration (versus 12 years).

She's a wildcard for a plea deal because she has the habitual criminal enhanced penalty designation where the enhancement term imposed by the court cannot be suspended.
