MANSFIELD, La. – A man previously convicted of killing a Stonewall child more than 13 years ago soon will be in the courtroom again as his second trial is expected to get underway before month’s end.
Pre-trial matters related to jury selection in Brian Horn’s capital murder trial will be handled Monday in the Vernon Parish Courthouse in Leesville. Court personnel will return June 19 to begin jury selection.
Once selected, the jurors will be taken to DeSoto Parish for the trial proceedings. Prosecutors are hoping to start the trial on June 26.

Conviction was overturned 9/7/18. 9/7/18: The U.S. Supreme court said Friday that Horn's rights were violated when his lawyer conceded at the 2014 1st degree murder trial that Horn killed Justin in DeSoto Parish. Horn disagreed with that strategy & made it known to the district judge before & during the trial, the ruling said.

3/10/21 Update: A DeSoto Parish Grand Jury takes up the 1st degree murder case against Horn today, 3/10/21. He is on death row at Angola for the 2010 murder of 12-year-old Justin Bloxom. During the initial trial, Horn's attorney admitted in front of the jury that his client had killed young boy. But appeals attorneys for Horn say that admission went against Horn's wishes. And because of the U.S. Supreme Court ruling in the McCoy v. Louisiana case, The high court ruled in that case that such concessions from an attorney during a trial violate a defendant's right to counsel. The attorney was trying to get the jury to find him guilty of the lesser crime of 2nd degree murder. But that strategy did not work. DeSoto District Attorney Charles Adams will be presenting the evidence against Horn to the grand jury. In Horn's original trial, he was convicted of first degree murder & sentenced to death. DA will still be seeking the death penalty.
3/10/21 Update: Defendant Horn was indicted by a grand jury for the 1st degree murder of Justin Bloxom. Following the close of evidence at trial, a jury unanimously found defendant guilty as charged & at the conclusion of the penalty phase of the trial, recommended the death sentence. In his appeal to the Louisiana Supreme Court, defendant raised 70 assignments of error. Finding merit only in defendant’s assignment of error asserting a violation of his Sixth Amendment right to counsel, the Court vacated defendant’s conviction & sentence & remanded this matter to the district court for a new trial. He will again face the death penalty.
5/4/21 Update: 42nd Judicial District Court, Parish of Desoto, State of LA: indicted Brian Horn with 1st degree murder & had specific intent to kill & inflict great bodily harm & was engaged in the perpetration or attempted perpetration of 2nd degree kidnapping, cruelty to juvenile & 2nd degree cruelty to juvenile. Had a motions hearing on 1/31/22. 1/31/22 Update: Next motions hearing on 8/31/22.
10/6/22 Update: The Louisiana Supreme Court last week chose not to hear an appeal filed by Horn convicted & sentenced to death for killing a 12-year-old Stonewall child. The Supreme Court denied a writ application from Horn, meaning the justices did not even take a look at it. At issue were motions filed by Horn’s defense attorneys alleging the DeSoto District Attorney’s Office did not give them adequate notice of what crimes Horn was being charged with. Horn was convicted & sentenced to death in 2014 in the March 2010 death of Justin Bloxom. He sat on death row at the Louisiana State Penitentiary in Angola until the fall of 2018, when the Louisiana Supreme Court overturned his conviction & death sentence because of precedent set by another Louisiana case. In both cases, the defendants accused their attorneys of conceding their guilt before the juries without their approval. But the panel still said there was sufficient evidence to find Horn guilty. A DeSoto grand jury indicted him on the same charges in 2019. Then a superseding indictment was returned in 2021. DeSoto District Judge Amy Burford McCartney recently set a trial date for Horn on 6/19/23. The jury will be picked from Vernon Parish & transported to DeSoto for the trial proceedings. Hall said there is one other issue pending appeal to the 2nd Circuit Court of Appeal. The defense is challenging the state’s plan to introduce evidence of Horn’s other crimes. Hall has asked for a hearing on the issue.

The 2nd Circuit Court of Appeal had overturned McCartney. The DeSoto District Attorney’s Office appealed that decision to the state Supreme Court. Trial set to begin on 6/19/23.

The vine link update is that he was moved 6/18/23 to Lee Parish County Jail, which is where the jury is being picked from for the re-trial. I will check again tonight and/or in the morning.
