A new affidavit has been released, including parts of a text conversation between NC and her boyfriend that indicate KD had kissed, groped, and generally not taken no for an answer from her shortly before she was kidnapped.

New affidavit: Man accused of killing Nichole Cable tried to 'kiss and grope' her in previous encounter

BANGOR, Maine — A search warrant affidavit in the investigation of Nichole Cable’s death released Thursday states that Kyle Dube — the 20-year-old Orono man charged with her murder — attempted to “kiss and grope” the 15-year-old the day before she died.

What's worse is they turned up a whole conversation between NC and KD from the night that she died, where she still believed that she was meeting the real Bryan Butterfield to smoke, said she was a little scared, and KD convinced her to go through with it. There is also evidence that she ran and there was a struggle, her sweatshirt when found was dirty on the back and had been torn or cut up the full length of the front. :cry:

From the above affidavit, Nichole rejected Dube, so the next day he decided to kill her by luring her out of her home. :furious:

The state medical examiner has ruled Cable’s death a homicide. The cause of her death is expected to be released Friday or early next week, Mark Belserene, a spokesman for the state medical examiner’s office, said Thursday.

Asphyxia due to compression of the neck doesn't fit in very well with Dube's story of her being found dead in the truck after placing duct taping Nichole's face.


The truth is starting to come out.

BBM. Compression of the neck can be a form of positional asphyxia. Nichole could have been alive when Dube put her in his vehicle, but due to the combination of being restrained and her physical orientation in the vehicle a resulting neck compression could have resulted in her asphyxiation.

The position Dube restrained Nichole in could account for her subsequent (possibly unintended) asphyxiation while he was driving the vehicle. In which case, his account of the night's events may be substantiated by the ME report. In any event, the duct tape on her face did not directly cause her death.

A Maine man accused of using a phony Facebook profile to lure a 15-year-old girl to her death is due to stand trial this winter on murder and kidnapping charges.

The attorney general's office says it received notice Tuesday of a tentative trial date of late February.

Jury selection is underway in the trial of a Maine man who's accused of using a phony Facebook profile to lure a teenager to her death.

The judge set aside Wednesday and Thursday to select a jury in the trial of Kyle Dube of Orono. The trial date is scheduled for later this month.

This should be a good trial to follow.

Apparently the defense is now trying to put the blame on Dube's ex-girlfriend for the killing of Nichole.

The defense also put in an objection opposing a motion from the state to exclude evidence of alternate suspects in the case. Dube's attorneys said they have evidence Dube's ex-girlfriend killed Nichole Cable, including text messages containing strong language sent from the ex-girlfriend to Dube.

The messages include strong language like, "I don't give a (expletive) it's the truth. She's a stupid (expletive)." Another says, "IT'S HER FAULT FOR BEING STUPID SO I'M [laughing out loud]."

Also someone up thread was wondering (hoping) if Nicole might of put up a fight. According to this article Dube had scratch marks on his face, which he credited to his place of employment were he took care of people with disabilities. What a coincidence. I hope Dube's DNA was found under Nichole's fingernails too. That would pretty much seal the deal as far as who killed Nichole. JMO

Investigators found evidence of a struggle and a chase.

A mask bearing Dube's DNA was discovered on the ground and Dube had scratches on his face, investigators said in the court papers. Cable also lost her sneakers as she apparently tried to flee, they said.

Dube, who remains in jail, told state police detectives that he got the scratches on his face at his job in Bangor, where he worked for an agency that cared for people with disabilities, authorities said.
